      @SeaKrait571 3 หลายเดือนก่อน

@@johntwohy8337 China's exemption was considered and denied by the Tribunal.
      Exceptions and Limitations to Jurisdiction
Finally, the Tribunal examined the subject matter limitations to its jurisdiction set out in Articles 297 and 298 of the Convention. Article 297 automatically limits the jurisdiction a tribunal may exercise over disputes concerning marine scientific research or the living resources of the exclusive economic zone. Article 298 provides for further exceptions from compulsory settlement that a State may activate by declaration for disputes concerning (a) sea boundary delimitations, (b) historic bays and titles, (c) law enforcement activities, and (d) military
activities. By declaration on 25 August 2006, China activated all of these exceptions.
The Tribunal considered that the applicability of these limitations and exceptions may depend upon certain aspects of the merits of the Philippines’ claims:
      (a) First, the Tribunal noted that its jurisdiction may depend on the nature and validity of any claim by China to historic rights in the South China Sea and whether such rights are covered by the exclusion from jurisdiction of “historic bays or titles.”
      (b) Second, the Tribunal noted that its jurisdiction may depend on the status of certain maritime features in the South China Sea and whether the Philippines and China possess overlapping entitlements to maritime zones in the South China Sea. If so, the Tribunal may not be able to reach the merits of certain claims because they would first require a delimitation of the overlapping zones (which the Tribunal is not empowered to do)
      (c) Third, the Tribunal noted that its jurisdiction may depend on the maritime zone in which alleged Chinese law enforcement activities in fact took place.
      (d) Fourth, the Tribunal noted that its jurisdiction may depend on whether certain Chinese activities are military in nature.
The Tribunal recalled that its Rules of Procedure call for it to rule on objections to jurisdiction as a preliminary matter, but permitted it to rule on such objections in conjunction with the merits if the objection “does not possess an exclusively preliminary character.”
For the foregoing reasons, the Tribunal concluded that it was able, at that time, to rule that it has jurisdiction over certain of the claims brought by the Philippines, but that others were not exclusively preliminary and would be deferred for further consideration in conjunction with the
      merits.

Philippine economy is absolutely not dependent on Philippine- China trade. Biggest chunk of Philippine economy are from western investments, such as Business Process Outsourcing employing millions of Filipinos, others is from the remittance from abroad and manufacturing. I beg to disagree that Philippine economy is dependent on China. It's actually the other way around, Filipino helping Chinese economy through the investment such as the SM group of companies. With Americans now focusing their investment in the Philippines, the Philippines don't China at all.

I agree to the nth degree. Because facts based on statistics is clear that even over decades of trade relations between China and the Philippines, even from the perspective of exports alone, the Philippines receives $53.6 billion worth of exports from China, while China only receives $15.3 billion from the Philippines. This significant disparity clearly indicates that China earns more than the Philippines in their trade relations. Therefore, it is evident that China holds an economic advantage, as highlighted by the substantial value of exports amounting to $53.6 billion. Moreover, any attempt by the Philippines to decouple from China may result in more significant economic repercussions for China, given that the Philippines is a substantial market for Chinese exports. China is the one that needs the Philippines market and not the other way around. #BANtiktok #BANhuawei #banCHINESEproducts #closeCHINASembassy

The fact that this is territorial dispute that is beyond the scope of UNCLOS, UNCLOS only covers maritime entitled and not territorial sovereignty. Imperial France forcefully took and claimed sovereignty over the Spratlys and Paracels before World War II, knowing that they were China’s islands. One would think this is an ill-got gain for Imperial France. France then transferred these territories (Spratlys and Paracels) to the independent Vietnam.
France controlled and have sovereignty over the Spratlys and Paracels, and Vietnam inherited them. Why can’t Vietnam keep them? Well, . . . because. . ., it doesn’t seem right, right?
Suppose a criminal robbed your wallet with $10,000 in it, you want to reclaim it from him or from anyone who’s still keeping it, right? Suppose the criminal gave it to his son. You would want to reclaim it from his son, right? If the police caught the criminal or his son, the police would want to take the wallet and the $10,000 and return it to you, right?
By the way, Imperial Japan in WWII did the same trick as Imperial France did. Wouldn’t you want these islands return to the rightful owner? Throughout much of US, Britain and France’s diplomatic history with China, they always acknowledged that the sovereignty of the islands and other land features in the South China Sea belongs to China.

The first use of the term "West Philippine Sea" by the Philippine national government was only as early as 2011. It was never a term on any internationally recognized maps. It's all just a unliteral claim by the Philippine Government, which doesn't give Philippine's right to take over the sovereignty of others. If you look at the 1900 Philippine Map, none of the claimed islands were on it. Pretending to be weak and pitiful will not help you seize other countries' territory.

Moreover, the Ukraine war has clearly exposed US insincerity in helping Zelensky, as the US has not sent a single soldier to fight for Ukraine! Would the US do the same to the Philippines? 32:40 That is irrelevant. Overseas Chinese people are not citizens of the PRC and don't pledge allegiance to the PRC.

The Philippine warship is like a thief, and it is stranded on the islands and reefs like a rogue and cannot move away!

All Zelensky did was have his country invaded for the sake of securing the Sevastopol naval base, and ideally creating a Russian aligned puppet state

This is quite a balanced CNA reporting from both sides. I may not know the details of the claims, but it is quite obvious from the words n actions by Macros regime is gearing towards on domestic nationalist populism n a willingly US proxy to beef up himself n those (like the military) benefiting from US involvement. The reasons for allowing US bases set up near Taiwan is an outright provocation to China .. if Filipinos are worried, just do not send their workers there to works.. it is not your country, guys....it is your govt failure to provide employment in your own country… The reason why ASEAN members are not with you is your naive belief on Western ideology narration.. allowing US to deploy a strategic missile toward China is a red line to superpower! I hope ASEAN can just move on without Philippine since they decided to choose their destiny.. for not learning from Ukraine n Middle East conflict, I won’t empathise with Phillipine for dragging the region into another conflict. I can only wish my Filipino friends good luck! 😢🙏
