    But they haven't been paying their rents. Options for landlords are limited. The government and media should pay the rent and help fix the apartment instead of pointing their fingers.

    So it is NOT legal for the landlord evict the non paying tenants to fix the property and sell it but it IS legal for the squatters not paying the rent and hire a free lawyer paid by CA tax payers. Duly noted.

I have 30k (30,000) and still can’t put a down payment on a decent house a run down shit hole is 500,000$ (little more but rounded down) due to the “supply” being low due to bigger land lords sitting on property…. 15 million houses are empty in the usa and 114 million renters slightly more then 35% of the population (114million houses/units) and 0.5million homeless….. the usa replacement level is at 2.08 (.02 which is alot) means we are on a population decrease…. Which means supply will easily go up as long as no artificial stifling of said supply happens or destruction of houses for personal gains (or to mitigate property taxes while you buy surrounding property to eventually build a big property….)

      So you are OK paying over thousands of dollars for an unhealthy and unsafe apartment? What if your sink back ups and the landlord does not do a darn thing until 9 months later. This will cause mold in almost every section of the apartment.
      Sometimes people are stuck where they are. Remember when you move, you have to pay the the deposit, first and last months rent. So to say that the rent is $1,000 a month. to even move you need at least around $3,000 just to get the other apartment. This is not counting moving companies, or even renting a moving van.

    The landlord is definitely correct in this matter. He needs the place empty to fix those issues. Also, they are clearly using the pandemic to milk the issue as they don't want to work or leave to live with family, friends, or a new place. now they want to sue the guy?!?

      I think they can stay if they want to during the repairs,….but I wouldn’t recommend it. There’s gonna be a lot of banging, tearing shit up, putting new shit in, power tools, wet paint, the smell of wet paint, possibly some bad Mexican music, people running around and talking loudly possibly in more than one language, a giant dumpster in the driveway,…and it’s gonna go on for several days. I’m all in favor of tenants rights, but when it’s time to make repairs,….do you really wanna stay there??? Ok….you might wanna wear a hard hat.

      As a landlord , I will do my all to respect tenants rights and respect their privacy. But the mold is a dangerous issue that can impair on their health. Let the landlord correct the problem if possible. The tenants should be on the ball about getting rental assistance as soon as possible. This moratorium has cause more problems then fix the issue.

      I thought the loophole in this one state was remodeling. I've seen cases where that's the key to getting them out right now. Not fix things up but remodeling.cant recall all details, on if they needed to hire a company n sign a contract first then use contract in court to evict now. And they've been winning.

      @@haseleyes1 The repairs that need done didnt happen overnight though , they were paying rent and there was a water leak and nothing was fixed for months and nothing was said about being evicted at that point or about selling the place , then the mold was found , it wasnt fixed or addressed for months , that is when they stopped paying rent and to start doing repairs themselves , that is when the harassment , numerous evictions notices all with different amounts of days , endless emails , threats etc started and months and months later the mold issue hasnt even been fixed yet and the state of the floor under the carpet is disgusting and thjust rent it out again t issue has been going on for years . I actually dont believe he has any intention of selling , he will do a few minor repairs , jack the rent up substantially and just rerent it to new people .

      Yes a crime for greedy property owners rented a hunted home.
      I was rented before and signed 1 years lease. After one night I saw so many randoms acting weird and I used video recording cameras and left the house. I told the greedy property owners that did someone dies at the house and he said no. I have to rent a hotel til I find a new place and owner sued me for breaching the contract lease.
      He pissed me off and ghost was destroying my television and computer and thing. He accused me sabatogated my own things. Lucky I have always the recording on and I told the juries and judge I invited them to stay in house after I showed the videos. I thought I was going crazy and lucky juries found favor for me and I won small judgement $10k and double my deposit and hotel expense.
      My story isnt rares and most greedy property owners didnt do anything but want to extorting my wages.
      From the renting experience, I brought own lands and hired priest blessed the lands and new materials .
      Yes property owners can do something about it by building new and blessed lands but they dont.
      Islamic emirate states of America is coming. Equal for all.
      Dont fall for greedy property owner trick and lies. Documents everything from those greedy criminals. I'm lucky and God blesses to buy financial instruments and bitcoin. Now I hope nobody will have to rent greedy property owners and buy their new house.

      Eviction Defense is a non profit for tenants provided at no cost. theirs a reason law enforcement don't like cameras. it is in his best interest that might not only serve as a barrier to having his rights violated but in the instance where it would of happened since video evidence is highly admissible in a court.

    I don’t get how two grown able bodied adults haven’t been paying the back owed rent, especially in California where rent is so expensive. They are never gonna be able to pay the back rent. I get that they're apartment had issues but if you don’t pay rent the landlord won’t be able to fix it, and they could’ve fixed it and still payed the rent. People are just taking advantage of the system imo

    These tenants are milking the system. I hope the landlord wins. These are 2 healthy young men and they feel entitled. They cant go anywhere, because they messed up their credit and are milking this poor landlord for every dime they can, by not paying rent. These two guys should be ashamed of themselves. Once that eviction shows up on their credit report, they're going to wish they continued paying their rent. To the young men: No one owes you anything.

    As far as I knew if you don’t pay rent or a mortgage you loose your apartment or house, did I miss something ?
    If these two can hire a attorney they can pay rent ! Another thing, if your rental is in need of repairs you can pay your rent to a lawyer’s escrow account and there is zero the landlord can do !

The county has services for those in need in the form of shelters. "I could sleep on my mom's couch" Yes, that is where you go when you cannot pay your rent and mom would be on you day and night to find a job quickly!       Landlords been milking the system for years. Milking people wages and putting people in situations every time they raised the rent. Tables turned and landlords are feeling the pain many tenants have been going through all along.

      But the repercussions of the tenants milking the system are already in evidence and these will hurt no one except those looking to rent.
      In my area, there are almost no home rentals available where there used to be dozens.
      A lot of people sold their rentals when home values went up and interest rates were at all time lows.
      I own a home now but when I rented four years ago, there were tons of nice rentals under $1500 in this area. When looking a couple of months ago, for someone else that needed to rent, I could barely find any.
      Rents are much higher and landlords are asking for, and probably getting, first and last month rents in addition to a security deposit.
      How many people can afford to dish out $5K before they even move in?
      Who is going to be hurt by the actions of these deadbeat tenants in the future?

      @@trainsandlocomotives the tenants agreed to it. They agreed to pay rent. They signed a contract agreeing to it. The government has no right to nullify a legally binding contract that was already approved. The constitution guarantees you the right to property you own. It also guarantees the right to equal protection under the law, therefore if the tenants don’t obey the law and can’t be forced to pay, then the landlord can’t be forced to obey the law either and can’t be forced to pay for repairs, mortgage, etc.

    People who don't pay their rent are not tenants they are squatters and they should be harassed by the land owner. The eviction moratorium has gone on way to long here in
    California should have never happened in the first place protecting all the lazy ass cry babies. as the land owner losers his property because they can not pay there mortgage.
    They want you to fill sorry for those to young men who look able to do some kind of work unbelievable. I am in my 60's and not afraid to do any kind of work to pay my bills.

    The best thing they can do is move out to a better place for them. I know it is not ok to do this to people, but who in their right mind stays in a place full of mold and not pay rent for almost a year. Guys please things would had been much easier if you just ignore that moratorium and do your part. Treat people like you want to be treated. I understand that these two beautiful young men may have no place to go but if you don't pay your rent this is what you will get. Guys please think about it. This poor old man is probably going through a hell of sleepless nights, anger, and desperation but yet all you guys just think about is yourself. Do your selves a favor if you are not ready to face the real world please don't leave mommy or daddy coach, no one is responsible to provide free shelter to anyone. I understand that you may be struggling but the best thing to do is not call the news but fill out jobs applications and rental assistance. Just incase anyone else is in this same situation.     This is awful. My friend was on disability when she moved out of her house to a friends house. The 4 people living there stopped paying. And she eventually just sold the house so she didn’t have to deal with the moratorium. She is a renter now

    No rent. May. June. July. August. Sep. Oct... The landlord can sell and evict but the law says he has to pay relocation costs on top of 6 months unpaid rent. Plus tenant gets free activist lawyer. Eviction notice is not bullying. Bungling landlord was trying to DIY an eviction process. At this point landlord is behind on his mortgage and cannot afford a lawyer. Stop accumulating so much debt and milking taxpayers. Supply is low and people actually waiting to move in. Move out.

    It's a double edged sword. Landlords need to be paid as they have bills (not every landlord is a large corporation that can afford to wait till rent relief comes through). Tenants all over the country have faced unemployment and rents are out of control everywhere, even in bad neighborhoods so they would not be able to rent somewhere else. The flip side is that if they get evicted, it stays on their record and they will have trouble finding a decent place in the future. It may be cheaper for the landlord to pay them to leave than wait this out for another year. Super important for people to know that this is not the first or last time we will have this issue. Prepare by putting aside money every month for a rainy day. If that means moving back home and saving up, then so be it. It's humbling to have to move back home as an adult but we have to do what we have to do.

    My mom met a fella about 35 years ago. She moved into his house and rented out hers in Berkeley when they got married. Her husband died. That house that she moved into with her new husband now goes to his kids and she needs to move back into her house. She is 81-years old. The folks living in her house have been paying below market value for the last 25 years. If she doesn't perform repairs, she is a 'slum lord.' The folks want $250,000 to move. My mom is not that rich. She would had have to take a loan on her house. It's insane. We've already spent $10,000 on attorney fees.

    Although this is not a good case. The truth is there are landlords all over harassing tenants that have paid their rent and performed repairs out of their pocket, with no reimbursement or credit towards their rent. There are landlords that want tenants gone so that they can move a tenant in that will pay the extreme increase in rental rates. Again, this is not this case because clearly there are other issues going on.

The law states you have to tell the landlord then it's their discretion who gets hired to do the work and what kind of work is being done. What you are describing is unauthorized remodeling of a dwelling that you don't own and in every case I've ever seen that is grounds for immediate eviction. Stop pretending the landlord demanding the legally owed rent is harassing you.

    I can see both sides - but how is a landlord supposed to fix anything if they stopped paying their rent? They claim it was just to try and do the repair themselves? so did they do it?
    If I was the landlord I would just sell it with the deadbeats in it and take the loss. maybe its a huge loss, but it sounds like California is a terrible state to be a landlord in with this kind of tenant - it will drag on and on and it sounded like the landlord is required to apply to the state to get rent from them?! in stead of evicting. that just sounds like a nightmare.
    If I was the landlord I might try to do the same thing and let the place fall apart and get condemned -> then the renters have to get out and I'll get to fix the place and finally sell it.

    Im in another state but I sold my rental townhome 1 month after COVID hit. The renter was a policeman that was being relocated so he did not want to renew his lease. TG I did, it's not worth the stress!

    Under CA laws on rents and unsafe and unhealth conditions in apartments, a renter can and may stop paying rent, but must put the rent in a trust account with a lawyer. And if the landlord does harrass the tenants, the tenants can file a restraining order on the landlord if they feel unsafe.
    This is depending on state and local laws. Restraining order for the tenants to keep the landlord away from them and the apartment, unless he is there to fix the health problems. Then the tenants can sue the landlord for harrassment in court for thousands of dollars.
    This will depend on who will file the court papers first. The tenants or the landlord.

    San Francisco is terrible. Tenants should pay a rent but if they cannot, they should leave immediately. Why landlord had to go through this kind of crazy situation. They should change the law, which should be more landlord friendly. If they don't pay at the restaurant, they will be arrested. It is the same. Tenant should be arrested if they don't pay a rent.
