I was told in a telephone conversation with some fellah that I was unable to use the boat until I entered MOSS
This has nothing to do with making our oceans safer as people being targeted are experienced boaters, lets see what develops...

There was a case here in the BOP a while back where a guy was paid $10 for gas money from his mate (?) for a few snapper after a fishing trip , the authorities found out he ended up in court and ended up with a huge fine , I mean the fine was well and truly out of proportion to what had happened . But when tons of mackerel are dumped and wash up at my fishing spot nothing happens .

I'm sure there will be a lot of subscribers/patrons here that will help donate to foot the bill if you take em on. Set up a fighting fund if need be. If they won't give you a copy of the legislation then that itself should be illegal, as all laws/legislation are open to the public for review/discussion. No legislation/law passed by any parliament is kept secret as that process needs to be transparent. Good luck bro, take em on.

Welcome to the industry.
They are being dicks. Unfortunately, as a guy that works in advertising for over 20 years. The "gains" had by you having use of the boat can be attributed to your 'personal brand' or 'goodwill'. At the end of two years of posting vids, has your brand "kiwibushman" increased in worth through the use of having access to the boat - which is well branded etc.
It's pretty shitty and I feel they are making an example, but I can see how they can say you are profiting. Companies/brands do not need to be making a profit to be sold for literally billions, if the brand is well known. The good thing is they can't really tax you on it.

Also check for freedom of information acts in NZ as the legislation is public information = as a citizen, you have rights to lawful legislation as it should be in the public domain. The thing is that the boat doesnt make me a cent as far as Im aware of, any youtube revenue goes to the music labels, boat videos are free to watch for everyone, sponsors dont pay me a cent... maybe they were not aware of this when they came a knocking. Im not to worried about myself as I will start to make money when I enter into MOSS and get the boat surveyed, get my skippers ticket, as I will then be able to take people fishing for money, its the way they are going about it that is a bit dodgy, I dont think they know exactly who is liable and who isnt, a lot of other youtubers are going to have to shell out a heap of money to keep their youtube channel going or shut down. If anything its a good thing for my channel - just a bit stink for everyone else out there trying to get a discount on gear etc... cheers

You may be classified as a Commercial Fisherman if you are deemed to profit from filming fishing at sea. I doubt Maritime are targeting you due to your stance on commercial fishing industry but more likely of your increased exposure of your vids. Good luck with the fight but it will be expensive at best to reverse their decision.

No, I dont make a cent off fishing, it costs me a fair bit everytime I tke the boat out. All fishing videos are free to air, none of them are behind a paywall. All petrol and fishing equipment is paid for by me, not by my business. Yes I do plan to get paid for fishing in the future and when I do I will comply with the law but at the moment they are barking up the wrong tree. Its not such a big deal for me as I can get everything sorted with minimal cost but for other people with youtube channels/facebook pages/boatyards etc... that get a discount on fishing gear in exchange for advertising this will mean they will need to shell out thousands, or shut their channels down.

Joel, you seem to be mis informed, My youtube channel earns me money from people booking hunting and rafting trips. I am audited by Maritime New Zealand as a commercial rafting operator and operate under a Certificate Of Compliance and have done for over 10 years.
All boat videos have soundtracks so all the revenue goes straight to the music label, I dont see any of it. Not one of my sponsors pay me a cent, yes I do get loaned equipment but it costs me a fair penny to use the boat and when the contract is up the equipment goes back to the owners. Why have MNZ not supplied anything in writing? Why will they not stipulate what legislation they are reffering to? this is very fishy indeed.
Im not making a fuss for myself, its a fairly simple process for me to get the boat surveyed and an SOP written out for my operation, there is even light at the end of the tunnel for me as I will be able to book paying customers on fishing trips and make some coin from the boat.
Im making a fuss because for a lot of other youtube channels, this will mean they will need to spend a heap of money or shut down. Also as it stands the retail price of boats will go up significantly as every boatyard will need to put any boat they want to take potential customers for a sea trial on - into survey. Any boat featured in any magazine article will not be allowed to have visible logo's, unless its under survey and has been entered into MOSS.
Private sellers will not be able to take potential customers for sea trials either - as they stand to gain a reward from using that boat.
If they go after a few they will have to go after everyone. This will be a good thing for my youtube channel as it will weed out a lot of competition.

The fishy problem is that personal gain is seen as profit, private sellers usually aren't making a gain on selling a boat from their original purchase price. Being given a boat because of your videos would also quite easily be seen as gain or profit, therefore making it commercial. Boat sellers aren't making money from the boat per se anymore than the gas station that sell boat owners fuel, more the service they provide.
