Can your employer legally STOP you from discussing your salary?

  • Talking about wages with coworkers is usually something people avoid.
    In most workplaces, discussing how much money everyone makes is taboo. But can an employer legally stop workers from talking about their paychecks with coworkers?
    WHAT WE FOUND:
    In 1935, Congress enacted the National Labor Relations Act, which protects the right of employees and employers to encourage collective bargaining, among other things.
    "Every company that you can think of is allowed under the law to discuss their compensation with other employees without fear of retaliation or being fired," Mauney said.
    Because of this law, Mauney says it's illegal for an employer to discourage employees from talking about their wages.
    "If the employer violates that right, you can take them to court," Mauney said. "The law is pretty clear that you can prove your case in any court." #WakeUpCLT #VERIFY

    I literally got a mass text sent out from my boss saying “if anyone talks about their pay, you will be terminated immediately”

      Sounds like you'd have a nice payout if you did get terminated and took them to court.

      @@Alpatrixx I did.. it was a problem. In Texas your employers can pretty much do this legally though.

    I did it just found out me and 2 other co workers are getting underpaid doing this outlast contract says 20 n hour but we've been getting paid less then that

    I live in Germany and I really don't care what the contract says.
    If I ask a colleague about income and he is giving me an answer then I know that he's honest.
    If he wants to keep the info confidential it's also ok.

    doesn't it depend on state law? people don't usually bring action in federal court for pay discrimination

    Yes they usually fire you

      Thanks to the fair labors act, they legally cannot fire you for wage discussion as firing you is unconstitutional since the fair labor act gives you protection and allows for you to be open and discuss wages with other coworkers. If you get fired for wage discussions, you can take them to court for unconstitutional actions.

      @@jish55 That won't stop them from looking for any other reason to fire you. So it will result in them watching your every move like a hawk. That ain't fun either.

      @@343guardian5 Its still an in-kind labor violation. You only have to prove its more likely than not that theres a violation, not beyond reasonable doubt.

      @@343guardian5 Its not hard at all to get a %51 chance that they were doing something wrong. You're completely misunderstanding the difference between Preponderance of Evidence and Substantial Evidence standard.
