    You may assume it is a legal requirement to display a blue badge if you use a disabled parking bay at a supermarket, and the signs dotted around the car park threatening "fines" of up to £100 probably reinforce this belief. Let's look at the law surrounding this, and examine whether it is really a legal requirement.

    Just to clarify my position: parking in a disabled bay if you (or a passenger) are not disabled is completely unethical.

    I’m a blue badge holder, but if we go to the supermarket and my wife goes in, we park in a regular space. We had a friend who used her husband’s badge (which he should have returned following an operation and posting videos on Facebook of them jiving and he climbing scaffolding), her reason for using his badge - “it won’t hurt, I’m only nipping in”. No longer friends.

    I had a situation were I parked in a disabled space at a centre I was attending for a physio session. Quickly remembering I had not displayed my blue badge I went out, and to my surprise had a parking ticket on my screen , took a photo and sent it to the parking firm, and ignored any more letters. I wish I had known about the information you have supplied .thank you. keep us informed.

    Awesome video forgot to display my blue badge got a fine from parking group for not displaying it in private car park..used this video almost to the word let's see what they say to the appeal lol..thank u for the legal jargon and help....
    Update! They accepted my proof and appeal all charges were dropped thank you amazing 😀

      Wow after 30 odd years of driving I’d never had a parking ticket.Now a badge holder I received my first one for not putting the clock on. I never thought to fight it. Iv noticed Men park their cars in the spaces so that they don’t get their cars hit by other drivers doors.

    Thanks for letting me know. The tesco store I live beside people use the disabled bays without blue badges all the time which is so annoying and I had a few run ins with some people. But I'll keep silent in the future

      Added to fact it's hard to get blu badge, many have hidden disabilities that need parking nearer locations but sadly council won't give them a badge, so soneone can be disabled and not have a blue badge

      Many disabled come under the equality act only not blu badge, so yes they have to accept we don't all have blue badge, in fact under the act we don't even have to provide proof of disability, it's self declared as well
      So example mask rules anyone can say thry can't wear a mask, state excempt, no proof of anything needed the equality act takes care of any asking for proof and that's classed as discrimination
      So me and others could go non masked anywhere and say to staff, excempt, some carried on asking or trying to restrict entry, some asked for the lanyards or other proof but there's no legal right to do so
      2010 equality act meant we don't have to show proof or evrn have a diagnosis of anything
      And this act allied to everything education, workplaces and yes disabled parking
      Companies with cameras poking for the blue badge my guess are also acting illegally as thst supermarkets has to be under disability act which means u don't have to show proof and indeed me saying about my disability and shoeing my dwp paperwork of bus pass should be enough anyway
      But equally I don't have yo shoe it, but to get help I prfere to and think it's better
      So can't show blu badge but am disable and have reason for being nearer to a venue when wiyh someone else in there car
      And my bus pass I have to say can't go to that supermarkets as its 5 minutes from bus stop or more from shop
      So I have to decide what shops I can go to without tiring myself out too much at times I can have a bit more energy say 10 minutes other times I can't
      And every supermarkets when u get in can be sitting for hour before able to do 5 minutes shop then hour or more sit down yet I don't qualify because dwp badly asses people for pip and make loads of errors in such assessments do we get wrong pip award

    Some people are too idle to walk and park as near as they can to the super market door, or use another persons badge.

    In the US it is illegal to park in ANY HC spot without the proper license plate or window placard.

      Not true in Iowa. You are required to display a disability placard, have disability plates OR HAVE A REGULAR PLATE WITH A DISABILITY STICKER ATTACHED. The sticker is about 1 inch by 1 inch square and affixes the same as the month/year expiration sticker.

    I've been disabled 23 year . I never parked in disabled bay until I paid for my blue badge last year.

    To park in disabled bays or parent & child bays when you don't need them is inconsiderate. I know my local supermarket has gym members using these spaces so they don't have to walk so far to the entrance to the gym. That baffles me.

    Some good info but those regs you have but the one's you have are the regs for England only which most of those regs may be different to the regs here in Wales. My son's badge is issued by Wrexham County Council. The badge is only used when he is with me other wise it stays in the glove box and I will park in a non disable bay. Thanks for this video👍

    My local Tesco supermarket car park has hardly any disabled bays (but TONS of mum with baby bays ... I wonder out of the two how many actually come to the shop?) and 9/10 people park there without badges. I asked the security guy inside about it and he just shrugged and said it wasn't his problem, the people who regulated the car, a separate firm from Tesco, had the job of checking on those.

    I received a parking ‘fine’ for not displaying my blue badge, (for some reason I had forgot to display it as I was in a rush I was in a disabled parking bay. My disability is not readily apparent, unless I’m using my walking stick or have a limp that day.)whilst I stopped at a shopping centre, they sent a bad cctv picture of my dash board from a distance…. So I appealed and I got a reply today to say, the car parking company felt their reporting of my parking was done correctly so my appeal failed. Bearing in mind when I sent my appeal in I included pictures of my blue badge. The letter goes on to say as away of goodwill they would reduce my fine to £20!!!!! They advised that I now need to make an appeal to POPLA….. this is crazy…. And makes me so angry 😡

    I detest the supermarkets for using pvt parking companies so we can park to purchase their goods. Perhaps a day per year when everyone doesn’t use the store

    So if there is a marking on the road parking bay they doesn't mean is a legal space if there is however a sign stating its a disability bay then it can enforcement on council land private supermarkets have to enforcement them selfs witch none do

    I've had someone call the police on me for parking in a handicapped space the cop cursed me and started writing a ticket I have a permanent set of tags that are for handicapped tags for handicap I pointed the handicapped state tags

    It's not illegal but if there's adequate sinage stating terms to park in a disabled bay including any penalty you can receive an invoice to pay the penalty.

    Yes i keep saying this blue badge has no legal relevance on any private land, and can set there own rules regarding parking, but are only vouuntary, not police or parking enforcement or council of any sort
    I don't have a blue badge as I have concessions pass but at 2 airshows igo to they asked on there website for blue badge for disabled parking, but on asking them direct I don't fit criteria for blue badge but for airshows I need to park in disabled if my friend /assistant is taking me abd being there for me
    And instead of blue badge they let me in one shoeing my esa and pip documents evrn though not mobility enough for blue badge
    One I send photo of evidence to events disability team they then send me there own parking area disabled badge
    So yes some people might not have a blue badge but still need disabled parking anf if on private land then it's not illegal
    Ted the ones who deliberately just park anywhere no disability at all are wrong, but they are not illegal and I feel on such land just shoeing someone some sort of disability proof shoukd be enough, trouble is no parking staff, it's all cameras automatically thst need to see a blue badge, so while not illegal to park the company will fine those nit showing badge in sone cases

    The term disabled parking bay also needs to be clarified, there are mandatory and voluntary parking bays, anyone can park in a voluntary parking bay on a public road without a blue badge.

    the law should change if you parked in a disabled bay not displaying a blue badge you should receive a fixed penalty notice you are parked on private land or not this well end the argument

    My problem with blue badge parking is when people park within 15 metres of any junction and creating an obstruction for other road users just so they can get a pint, paper or whatever.

      What Constitutes Valid Consideration? Consideration, has to have legally sufficient value to constitute 'valid consideration'. Consideration can include a practical benefit [ie the area of land on which to park, whether paid for it or not] you give the other person or a detriment to yourself.

      Not every disabled person has a blue badge. Those people are also legally entitled to use the disabled bay. If you'd have read the pinned comment, it's quite clear what my view is on people using disabled bays when they aren't disabled.

    If you can manoeuvre around a shopping mall for a hour doing your shopping then you can manoeuvre a hundred yards around a car park the real disability in this day and age is ptsd and no one cares about that

      Don't have a blue badge but registered with local, authority under disability care 2014,and have bus pass, for me shopping an hour wow, my shop is get bus nearest to the shop, sit in shop up to an hour, 10 minutes shopping on a good day, pay for goods 1 to 3 hours sitting down again, an hour actually Shopping is not anything I've ever been able yo do, adhd, autism, heart failure, kidney disease all play there part

      Get home leave trolley at bottom of stairs but bring some up in bag, toilet rest again hour or more, start putting stuff away, rest another hour after 10 minutes or less, then go down bring up trolley
      The yes another hours rest before putting final stuff away and resting again
      If someone does take me somewhere if private car park then legally we can park in disabled but don't because hassle involved, but my airshows at at a museum I insist on disabled parking and show my disabled registration or bus pass

      So unless you have ptsd you're not disabled? So having ptsd means that you cannot walk around a shopping mall for an hour? Anyone in a wheelchair doesn't need a blue badge? Anyone who has a hidden disability ie breathing problems, traumatic brain injury, epilepsy, partial sight, these people in your opinion shouldn't have a blue badge but you should! Right gotcha!

    So your (company) blue badge is illegal as it is not issued specifically to a disabled person. A disabled person would have presumably taken the standard driving test,so should not need further training! I think most people understand that disabled parking is provided for disabled drivers passenger. Most supermarket staff will enforce blue badge privilege but will not engage in arguement

      You say a disabled person would already have taken a driving test. How do you think disabled people learn to drive in the first place? And let's hope you never become disabled to the point where you find that you *do* need further training to allow you to keep your independence.
      Blue Badges for organisations
      An organisation may be eligible for a badge (or multiple badges), if they transport people who need a Blue Badge.
      The issuing local council will decide whether the organisation has a clear need for an organisational badge rather than using the individual badges of the people it is transporting. An organisational badge must only be displayed when someone who would be eligible for a Blue Badge in their own right is being transported
      I teach disabled learners, who of course havent yet taken a driving test. As there are only about 40 disability driving instructors in the UK, some people travel to lessons by train, and then need to be able to transfer from their wheelchair into my car.
      Others passed a driving test when they were able bodied but have since become disabled through illness or injury. They haven't yet received their own blue badge but *do* need further training to learn how to drive using adaptations eg after limb amputation or stroke.

    I've been parking in disabled spots for years, I'm not even disabled nor do I have a blue badge. Never once had a ticket. Gotten alot off funny looks tho from other drivers but I couldn't care less.
