@@marriagegreencardwhat will happen if you go through this process and get married. But when filling for adjustment you get rejected? Will spouse be forced to leave?
@@relaxedsoul8600 In many ways it's true, but they have been processing many of these in about a year. Although it might change again in the near future!!
Thank you so much for your comment! It really means a lot! If you still have any specific questions that haven't been answered here, please let us know, so we can address it. Good luck with your immigration journey 😊
Hi! can you help me please? I don’t understand something. So I came here with a legal entrance with a J1 visa, then I extend mine visa and change it to a B2 visa (that was accepted) and I married with my husband before the b2 visa expired, so what would be my visa status now in my green process (when the visa B2 already expired)? Thank you
Hi! Have you already applied for your AOS? Once the B2 visa expires, and you have not yet submitted an application for adjustment of status (Form I-485), you would technically be considered "out of status." But the answer would change if you've already submitted your application.
@marriagegreencard hi!!!! I didn’t submit nothing yet, I was planning to do send all my package next week. Thank you so much! So in the question “current immigration status” I should put “out of status” and leave the space or “expiration date” in blank?
How about this: My now wife has been here since 08-08-24 on her B2 tourist visa. We got married on 12-31-24. Her last day she can be here on her tourist visa is 02-07-25. Can she stay here past 02-07-25 without us having to file form I- 130 and I-485, or do we have to have those petitions submitted and pending for her to be able to stay here past 02-07-25?
Hello, So I got married after 45 days after entering USA that would not be an issue for Green-card right ? As you said 90days rule doesn’t apply anymore.
Hi there!! The timing of your marriage is just one factor that USCIS considers, but it’s not the sole determining factor. While the 90-day rule is no longer a policy, the USCIS doesn’t base decisions on arbitrary numbers of days. Instead, they look at the intent you had at the time of entry. It’s also important to note that with the new administration taking office soon, we don’t yet know how they’ll approach these scenarios. Policies and interpretations often change overnight, so preparing a strong case is key. If you have questions or need more specific guidance, feel free to reach out. Wishing you the best as you move forward with your green card process!
Did a permanent resident green card holder can also married a b1/b2 visa holder after 90days and be eligible to change the status of the spouse holding a b1/b2 visa to a green card?
Hi there! The USCIS mainly assesses the immigrant intent at the time of entry, so 90 days is irrelevant. Plus for spouses of permanent residents which is F2A category, the visa bulletin must be current to apply for adjustment of status. As of now, the F2A category is not current, meaning there is a waiting period before a visa becomes available.
So if I enter into USA with my b1b2 how long I have to wait to get married without getting into any trouble, So what's the timeline what do I do it's very confusing
It's all very fact specific and it's important to consider the preconceived intent. You might want to consult with an immigration attorney to ensure everything is aligned. You can also check other videos on our channel to learn more.

Can i ask some question i have a friend here in taiwan she is not yet divorced here in her husband, and she go to United States for a tourist Esta Visa, but before her tourist visa expired, she get marry on his boy friend in chicago they married on las vegas i think...how should she can do this legal or illegal?how can she process her green card if she is still marry in her home country?
@@rachaeltakeda4155 Hi there! She can't processed her Green Card because her current marriage is invalid. She needs to speak to an immigration attorney ASAP!
I had questions, however, this was the video that I needed to hear, thanks. Answers with some meat on the bones, it's scary to get married to someone that I have not lived with to prove that we are real, and to show all that paper work in. I come to the US on a regular and have my own home, what happens if he does not meet the the dollar amount?
Hi there! I'm so glad to hear you found this video helpful. It's a scary process for sure and so much goes into it. You got this!! Thank you for your comment and good luck with your immigration journey 😊
Im not an expert in immigration law, I believe its best to get K1 Fiance IMO - Its designated for marriage after entering the USA. Tourist visa is only visiting and doesnt have other intent. Certainly its a challenging journey - best of success to those who will take the opportunity
My daughter recently became engaged to the person she met online 8 years ago. They have been together ever since. She has been to visit him in London several times. He has come here to the US. Both families have even visited each other over the past several years. They want to be married in the US, but they want to live in London. They are thinking about getting married while he comes to the US on a tourist visa. After that, he plans to return to London and apply to bring her over there on a spousal visa. Is that going to be allowed?
Hi there! I don't see an issue with that. However, they must be careful about how they present their intentions upon entering the U.S. to ensure there is no appearance of intent to immigrate to the U.S. at that time. In other words, they just want to make sure they can safely enter the U.S. without any issues or additional questions. Plus they should speak to the UK immigration lawyer to see if it might make their immigration process easier if they do get married in London.
Hi there! You can't get a tourist visa with an intent of coming here and getting married since it's a visa fraud. Look into consular processing and fiance visa routes!

K1 is a waste of time. You will first wait for K1 and again wait for green card.

Please does the 90days rule still applies to F1 visa issuance from B1B2 visa holder? Thank you.

What about if you work seasonal jobs and the spouse is not material
Would it be an issue if I was pregnant when he was on a b2 and we decided to get married?

My spouse income 20000 but it real marriage, it can affect my AOS???
Sounds like you might need a joint a sponsor to ensure it goes through. Using assets might be another option!
