  • It's called dying intestate- meaning the person did not leave a will. It happens all the time. There are procedures available to transfer property and assign someone to be the administrator which is the person in charge- not always the best thing and this video tells you why.

    Thank for your assistance. I'm in a very complicated situation. My stand dad passed recently . he was a very prominent Dr in California and I'm stuck in Hawaii. His sister's side are all NYPD and no one will talk to me. My his ex wife is still alive. According to his cop nephew in NY. He has no will and they do not want to have anything to do with his assets. The corner has Ben holding his body for nearly a month and will not release it . This is way over my head and capabilities.

      Hi @Marc sorry for your difficulties. If you are a child of this person you can apply to become the personal representative. You have priority as a direct heir over any cousins etc. Contact the coroner about the body - then get someone you trust in California to help you if you are unable to travel and handle it yourself. Contact a probate attorney in the location where he lived when he died.

    My brother pass away. Our mother ask that everything to be divided among her four children one died. My mother said if one of her children pass it is to be given to her surviving children , our our half brother entitled to the dead brother share ?

    Hello ma'am. Thank you. Ma'am please I wanna ask something. My husband passed away 2 weeks ago. And he's daughter arranged the funeral and they gave a wrong information about their Father the deceased thier mother a longtime divorced woman listed my husband obituary as he's wife and me a the deceased current and legal wife listed as a friend! I'm living in a foreign country now and I am not sure if husband left a will, please tell what should I do please?

      HI @Ellecher I am sorry for your loss. You should contact an attorney who works in the area where your husband was when he died. You will need to assert your interest.

    Hello mam, My father passed away recently he had no will. He was married according to the law but he was no longer together with my stepmother it's over 8 years now.
    He owned a house and a car.
    When my stepmother married my father he already had the house with his previous wife my mother but they were married traditionally not according to the law.
    Basically I would like to know how could his properties be under my name as his only child or maybe his brother or mother.

      Hi @Lundit You should go to an attorney in your area as they will know the laws that apply here. Who receives the property will depend upon how it is titled or shown as owned and then the relationship of the people to the person who died. We will do a video on intestate succession- those are the rules on how property passes in the US when there is not a will.

    What about when someone dies without a will and a car title was forged and illegally transferred to a person who had no right to?

      Yikes MFF! When someone dies without a will an heir can still open a probate case to determine disposition/transfer of assets. Instead of being called an 'executor' the person who the court appoints is called a 'personal representative' or 'administrator' and they have rights to fix these types of problems. The family should find a probate attorney in the state where the person lived at the time of their death.

      FinelyRevealed it all happened a year ago and it was just a truck that would have been ours but the title was forged as I said. Is it worth the probate or can we go another route getting it back? We don’t have much money and we were told it might cost more then value. (I’m in Florida)

      A Florida probate attorney is the person you need to consult. Gather all of your information- create a timeline showing dates when everything occurred-list out the witnesses with information-documents-proof re the forgery-etc. The more thorough your information the quicker you will have your answer at an affordable cost. You could also pursue filing a police report.
