All these ignorant people who don't understand immigration law makes me sad. The reason why she is stuck in Mexico is because she was denied her Visa after her waiver was approved. She failed to mention that she let her daca expire before filing again because she didn't think it would affect her.
Yup instead of focusing on this they make it seem like this can happen to all of us instead of mentioning why she triggered the bar and how we can avoid similar situations. You’re right
Well some have to do consular processing via work but I think what caused this was the unlawful status under INA code if it’s over 180 the person triggers the bar
Not unless you got DACA at a young age. I received my DACA when I was 15, I was brought here at the age of 3 so I don't need permission. I just need valid proof that my daca has never expired.
So trying to understand is the bar because it’s over 180 days of unlawful status? She said she forgot to renew a year making me think that was the cause. I’m asking since I have to do consular processing for work and have 20 days of unlawful status due to 160 plus days of processing time for my last DACA renewal this time I renewed a year early to be safe.
Oh I’m good I’m actually leaving next year and coming back in under a different kind of visa then doing AOS via employment based. Yeah I guess the update to this news is that the lawyer didn’t tell her the ULP triggers a bar
I don't trust lawyers sadly this happened to a lot of people when I went out to my interview in Cd juarez😥 I went to a notary and she did such a good job
I would no longer spend any money on an attorney when they are handing out free citizenship in the north eg Martha’s Vineyard. Lawyers in Texas are no good. They just want to be paid for doing nothing these days.
It’s more about not blindly trusting them and one doing their own research. If she had tan her FOIAS and reviewed the inadmissibilities then would have noticed that unlawful presence is the first thing they look at. If one is under 180 then fine and if over she would have needed an approved 601
Yeah 180+ days of ULP triggered the bar. Technically even gaps in renewals count this is something the lawyer failed to tell her but also why I recommend everyone runs FOIAS and knows their immigration history
Funny how greedy corporations and corrupt politicians especially republicans support less taxes on the rich more tax reductions for corporations that are anti union, and you think some immigrants that were brought here as kids affect you more you more

Again it falls back on not doing further research unfortunately this affected her but hopefully we can learn from this for the folk doing employment based that have not choice but to do consular processing.
Multiple lawyers told me gaps in renewals don’t count but that’s why we make sure to read into it ourselves that’s when I found a competent lawyer who confirmed the inadmissibilities and I ran my own FOIAS to know all my immigration history. This included CBP, USCIS, OBIM (tan my own prints) and checked for criminal records even though I shouldn’t have any.
