  • Hello everyone, welcome back to our channel. We have held on to this stuff (and more) for so long in hopes they would make this right. They can careless about this issue. They have drug us through the dirt even though everyone around them can see we were done wrong.
    Today, we're addressing the recent press statement from the City of Pigeon Forge about the Westside Connector project. We have some crucial information to share that reveals the corruption and disregard for property rights involved in this process.

    🛑 Our Response:
    1. Property Rights Violation:
    The city's decision to change the route infringes upon our fundamental property rights. Our homes and lands are at risk without proper consideration for the sacrifices and investments we've made.
    2. Lack of Transparency:
    The decision-making process lacked community involvement and transparency. Major changes like this require full disclosure and public input, which were blatantly ignored.
    3. Conflict of Interest:
    Mayor David Wear's ownership stake in the newly affected areas influenced the route change. This is a clear conflict of interest that undermines the integrity of the entire project.
    4. City's Victim Narrative:
    The city is attempting to play the victim while dehumanizing us, the affected residents. This tactic is not only unfair but also misleading to the public.
    5. Call to Action:
    We urge our fellow community members to join us in speaking out against this injustice. Attend the next city hall meeting and let your voice be heard. Together, we can demand accountability and fairness.

    A buddy of mine purchased a 70 acre ranch in Otter Creek Florida a few years ago. Same circus, different tent. Took him almost 4 years to oust the corrupt city council and mayor but he's finally making headway. Keep fighting and growing your youtube presence as it holds the city accountable.

      I know exactly who your talking about and I followed much of his fight with the previous mayor etc. Didn’t he post much of that on TH-cam? And he’s also from Ohio, am I thinking of the same guy? He seems like a great guy and I would not want to be on his bad side cause he does not give up!!

      Get minutes from every meeting you went to and find a good lawyer, when you look around Pigeon Forge and you don’t see any new homes being built and not many homes at all there’s a reason for it (Money)

      Probably because it was a conflict of interest this case has something to do with them owning the property next door and tearing their house is down to make a road probably to get to his Campground it's a conflict of interest he has no right to be on the bench that would be like if my mother was a judge and I broke the law and I went in front of her and of course she's just going to smack my hands and girls will be girls and send me out the door free of charge he should be removed from the council and removed from his seat as mayor he's clearly corrupt and obviously a tyrant

    I am a Native of Pigeon Forge, born & raised. The mayor's dad was my primary school principal, his older brother Mark my classmate and I remember David Wear from school. So I know this family somewhat and I'm so ashamed. I am so sorry you all are going through this. I hope that you all get $5 million dollars or more from the city of Pigeon Forge. THEY ARE WRONG AND OBVIOUSLY HAVE LIED!! It's always been about who you know and who you are in this city. My prayers are with your family and I'm believing God will work this out for you.

      If I purchase something after a decision has been made the fault falls on me... for example The city made a decision Jan 1 2000 to take property X. I then purchase property X January 2 2000 or any time after that it is not the governments fault i purchased that on Jan 2 (or after) In this case on 10/26/21 PF decided the road would go through 326 Ogle Dr and Approved on 11/22/2021. You then Purchased the property 8/17/22.Quit going after the government go after your realtor, the seller and the sellers realtor. VERY SIMPLE

    Again, this property should have NEVER been allowed to be sold. Why even vote on where the road should go if they do not adhere to how it was voted on?? Every resident of Pigeon Forge should be demanding answers because it sounds like they will be running other residents out in the near future to make room for their private tourism. There must be someone that wants to put a store/gas station on that property that they will be renting the property to. Therefore no sale of land and benefiting from the rent. There's so much more to this plan. Residents are going to hate how they change that area. All come together and fight! The waters are muddy and the truth needs to come out. Praying for you and others in this fight!🙏

      I'm sure that the county commision has voted and approved a Comprehensive Land Use Planning map. I'm not even going to ask if that was reviewed prior to your purchase because you won't answer any really important questions

    Here's my take on this if they did not vote to tear down your house that mean they didn't vote for eminent domain so they just tore your house down without the proper procedure of eminent domain I would get a really good attorney because I think you can see the mayor and the whole city council and the City

    We had an issue in SC where the city tried to take footage off property for everyone’s land that was along a city road to turn into 4 lanes. City did make a joke of an offer . All the owners & residents sued because they were going to condemn the footage they wanted. Daddy did get a better settlement but the roadway took land almost to the porch of my great grandfathers house. We lost the renters that were in the house over 25yrs. Took more losses from bad tenants. Daddy sold the house later. It was becoming a financial burden to us. Our loss was no where as much as yours. Everything sounds illegal as far as what happened to you. I hope you can find a way to reach a settlement if that’s what you want since they put the house back. Crazy part I saw was you’re still having to make payments. Pigeon Forge should have to pay

      As someone commented on another video, the campground will make a lot more $ renting lots along the river, that’s why the alignment changed. The city cares more about the campground owned by the mayor’s relatives than your commercially zoned property.

      I agree the AG should be informed, and complaints filed. Ignorance of the law ( on the part of the city council and any attorney that represents them) is no excsuse...no matter which side of the issue you are. Sorry but you do need an attorney....start a go fund me as there are lots of us who would support you. Also check with the local Law schools, especially if they have property and land use programs, and ask if they can help with your case.

    Contact the institute for justice. They will help you negotiate for better terms of compensation. You need to show up and campaign to recall all these local officials who voted for this route of the road. Get these greedy people out of office.

      Do they have an attorney? They have not said either way. I would expect the attorney to do the talking at city meetings and not them: if they have an attorney.

      Would love to hear from the family's attorney. I don't think the city has violated any of the steps to purchase the property through eminent domain. The city hired an appraiser, made a purchase offer to family based on the appraised value, offer then rejected, city filed lis pendens to initiate acquiring the property through eminent domain (court proceedings), the initial appraised value was deposited into the court registry for withdrawing by the family and mortgage company. We wait on the city scheduling a hearing for the family to request additional money.

    My wife and I which are Sevier County residents for 30 plus years have watched all your videos and want your thoughts on our comment. 1) The United States of America (our fore fathers) pretty much killed a whole race of Native Americans and stole their land. For your family and mine. 2) The federal government used eminent domain to remove families to form the GSM national park. For your family and mine. In the 1940's the TVA build Douglas Dam and flooded 30,000 acres so we could have power for Sevier County, For your family and mine.
    PLEASE tell us why your family is any different than the thousands before you.

    Me and my family have been coming to Pigeon Forge and spending money for more than 30 YEARS. On 2 occassions I even seriously considered buying property and moving there to live out the rest of my life. Thank Heaven that didnt work out.
    I dont make many promises, but mark my words. I will NEVER COME TO PIGEON FORGE TO SPEND ONE PENNY EVER AGAIN!!! And further, you didnt lose just my one family. I will spend a good effort to share this story with everyone I can to encourage them to stop coming to Pigeon Forge. You not only screwed over the Race family. You screwed everyone who comes there to support that community.
    Karma will bite this city government in the a$$.

      @@hydrostatic3g yes, the crowds are aweful and make it undesirable as well. I started going back in 1990 before many people even knew where PF and Gatlinburg even were located. It was really just a quaint village. But when I came back in 92 and even by about 97, it was totally ruined by then. They sold out to big tourism. But my family put up with going usually in the "off season" when not many tourists came through.
      But at this point, I'll just totally boycott and never spend ONE PENNY to support this kind of criminal nonsense. WHY??? Because I have all the money. Free market!!!

    In the state of TN, not sure about other states you are required to have title insurance. Eminent domain is not covered, however things not disclosed which cause financial stress are. Call your title company and get a copy of your policy. You’re not fighting eminent domain at this point you’re fighting property fraud.

    That's absurd that no protocol was on place. Even in our town of 7000 in southeast KY has protocols for eminent domain. Letters sent out about new changes and meeting times, meetings with community input, flyers handed out of the new design with an underlay of property lines and how it will take land and to what degree. This is atleast 2 yrs in advance. My mom got to attend a meeting for her property and eminent domain but didn't live to even have to sell her home. We did over a year after her passing. I believe it was atleast 6 years after the meeting that she passed away,maybe more. You'd think it is definitely in bigger cities. My point is someone knew there was a process.

    We WERE planning a trip to Pigeon Forge the last week of August but after watching all of these videos regarding this road and properties, we will NEVER return to Pigeon Forge for a vacation. We will be going to Cherokee instead. Already cancelled our reservations and rebooked for Cherokee.

    Sounds like the mayor might of had an interest in the rv park at one time. I don't know why the crazys are always on town councils or are our mayors. They're really tiring to steal your home and property. I believe they should be replaced after you sue the pants off them. Best of luck.

    Sometimes the Lord allows us to go through some experiences like this one so we’re used to expose the lies and deception being done. STAND your ground!!! This needs to go all the way to Congress or whatever high court in DC. I believe you’re going to end up helping thousands of people.

    My husband's grandparents had a city do eminent domain on their house. They fought them for 7 years. His uncle lived there while it was going on. They finally moved the house because they would pay them enough for it and the land. Its on the north side of the highway now. This was probably 50 years ago.

    Couple of questions, why would you bye a house which everyone knew was in the path of a new road? Secondly, why did you turn down an offer of 500k, which is a 200k profit? And yes everyone knew it was scheduled to be taken.

      Maybe watch the video you went out of your way to comment on before asking. It’s all there. The mayor himself saying the city didn’t tell the 55 people this. Why didn’t he file a lis pending on all property if the route was set in stone? Why didn’t the mayor/city buy the property when he mentioned interest in purchasing it? Why would he would he personally have interest in buying the house if the route was planned? Why should the government demand us to give up our property? It was unreasonable demand so the government got an unreasonable offer.

      if government agencies paid landowners what they want for their property all of our taxes would go sky high to cover it. Values of property should be determined by independent real estate appraisers.

    If your Attorney is brand new on your case, then disregard this statement…
    I WOULD LOOK INTO A MORE ASSERTIVE/AGGRESSIVE/ZEALOUS Attorney… A proper attorney would show up for their client, stand on side them at that city council meeting , at least once. They need to lay eyes on someone that AINT playing! An attorney knows how to make a lasting impression statement to their faces without giving away any strategy or practices or whatever.
    Don’t put your faith in a paper pusher, behind the desk, behind the scenes attorney!!

    If it was already planned for the road before you bought the house the the person you bought it from would have to pay your money back and the money you put into the renovation

    You don’t know the terms bc you didn’t ask your attorney. The county road commission is where the funds come from. They work to put the road in so they pull permits for building department to grant demolition etc. Title search and title insurance and warranty deed is the terms you may be looking for. Get an attorney and let him speak for you. What was the amount of your state licensed eminent domain appraisal? You keep avoiding these things. To your son who said you never knew. Don’t buy in a mixed use zone that has been established for decades. As the city grows that property in the zone will be used. But I am raised with the thinking that serious situations that affect the whole family it just seems that he would have a presence. I’m not trying to show any disrespect or lack of understanding. As a child growing up we camped every year in Pigeon Forge . I love visiting there but not so much anymore because of the magnitude of commercialization.

    A lis pendens does not get filed as soon as a new road alignment is announced as the Race family believes. It gets filed much later after the government's purchase offer is rejected. This then forces, in the case City of Pigeon Forge, to initiate a lawsuit to condemn the property. The lis pendens gets filed which is public notice that a lawsuit has been initiated by the city to acquire by the city. I don't blame the Race family for not knowing when a lis pendens should be filed. I mean, most people do not know this.

      Eminent Domain is a seriously difficult case to go up against in most areas and requires a very knowledgeable attorney. It simply doesn't make sense that they won't respond to the question if they currently have legal representation or not because I've not seen any sign of one. I know emotions are running high but unfortunately it won't have a ounce of how the courts rule on this.

This should be an open record request. We want to be completely transparent on these issues and encourage it. Also again addressed in the video. It’s not about the money. We want our property.

      Eminent domain is an unfortunate but necessary process. For eight months, the city of Pigeon Forge has been the subject of relentless accusations associated with a 1,047-square-foot commercial property, not a primary residence, located at 362 Ogle Dr. During this time, the City of Pigeon Forge has diligently attempted to reach a financial resolution with owners Doug and Mika Race by issue of just compensation.
      For more than 30 years, the City of Pigeon Forge has worked toward providing Pigeon Forge residents with a much- needed alternative route to bypass Parkway traffic. To meet this need, the City Commission approved the building of the Westside Connector. To help determine its path in relation to Ogle Drive, residents were invited (via public media notices and individual door hangers placed on approximately 50 tracts) to attend a public meeting on Oct. 26, 2021. Based on public comments and the recommendations of the city’s engineering firm, it was determined that in the best interest of Freedom Baptist Church and the Pigeon Forge Care and Rehabilitation Center nursing home, the Westside Connector’s final route would travel through 362 Ogle Dr. The route was presented and approved in a Pigeon Forge City Commission meeting on Nov. 22, 2021.
      On Aug. 17, 2022, the property at 362 Ogle Dr. was purchased by Doug and Mika Race of Chillicothe, Ohio, for $306,000 as an investment property, nine months after the Pigeon Forge City Commission approved the final Westside Connector route. Pigeon Forge city staff has been in ongoing discussions with the Races since March 2023 to negotiate the purchase of the property and provide compensation to the Races.
      As part of this process, the property was appraised, as a commercial property, not a residential property, at a value of $489,665.
      🎈To date, the Races have not submitted an alternate appraisal of the property. 🎈
      In an effort to provide compensation to the Races, in October 2023, the City offered $490,000, and the Races counter-offered with $3 million. The City countered with $539,000 (an offer that represents a value of $514 per square foot). The Races countered at $1.5 million. After 17 months, attempts to reach a financial resolution have proven unsuccessful and will be determined by court action. The City was sympathetic to the Races’ financial obligations to the property, and in the interim (before work would begin on the Westside Connector in the Ogle Drive area), the Races could have offered the property as an overnight rental, as was their original intent, to derive and collect income from the property. The Races declined.
      Since the Races elected not to utilize the property, the City elected to move forward with plans for the Westside Connector. On Jan. 12, 2024, the City of Pigeon Forge filed a petition for condemnation of the property at 362 Ogle Dr. At this time, the amount of damages, $490,000 (determined and equal to the appraised value), was deposited to the clerk of the court with this filing.
      On March 16, the city attorney filed a notice of hearing to take place on May 6 in which a request for possession of the property was submitted. Late on May 3, via their attorney, the Races agreed to vacate the property, allowing the city to take ownership. The Races requested and received 30 days to vacate the property. The order of possession (dated May 6) was recorded on June 6, 2024, with the register of deeds.
      On July 10, the city attorney received a motion to draw down funds on deposit for the court to pay off the Races’ mortgage. The city has maintained it would not oppose the court clerk paying off the mortgage once it is instructed to do so by the court.

    They reach the value based on FMV. You have to let emotion out when it comes to business. Your emotions aren't worth more than reality. You should be going after whoever sold you the house, for failure to disclose what was happening. I'm glad you're being transparent but don't go so heavy on the greed. We all see your social media accounts and related accounts, the greed runs deep. That's not Christian like and will catch up to you. Any lawyer would have told them to accept the offer but they decided they knew more than smart people. Once an SD offer is rejected they city can condemn and take the property with no compensation.     I almost had same thing happening to me years ago in Florida only thing that saved me was I was friends with a big wig in Sarasota County he told me in 5 years they were gonna add a turn lane in front of my house and that they would have to either tear home down or have zero driveway anymore .thank God it was my first home I sold it immediately and I checked it recently its gone just grass .

    Did you not go out and get your own C6 comps when all this was going on? This should have been done as soon as you found out the road was coming your way so that you had proof of what the price of your house should be. I understand being mad, this happened to my grandparents home, but we had our comps and when they began lowballing us we knew what the property was worth and they had to pay up, and they did. And, you will never get any sentimental value in real estate transactions.

      I don’t understand why in 17 months of negotiating they or their lawyer haven’t produce any documentation or alternate appraisals to support their $1.5 million valuation of the cabin.

      They paid 306k a year before it was seized and got 490k from the city. They allegedly renovated it but I seriously doubt they put 184k into it.
      Don't appraisals take in to account recent sales?

      @@wasidanatsali6374 I did not know what they were asking for the house, and I agree, it is bewildering they are not presenting any documentation to back up a price for the house. They will end up going in the hole on all of this by hiring the lawyer, and not negotiating a price. I hate this for them, but it sounds like they are just fighting to have kept the house, and that train has left the building. Now that the house is gone they are in an even worse negotiating position. If they feel the Mayor is corrupt, they should have found comps, negotiated a price, and then kept pursuing the mayor if they feel he is corrupt.

      @@damionag Yes, that is what comps are, recent sales. They could have used appraisals from the time they found out about the road or used appraisals from a more recent time period if the comps were higher, and they could have made good arguments for either time period for a price.

      Let’s just call a spade a spade in that they were trying to get 1.5m from the city on a property they paid 309k for and are hiding behind god and religion to try and make it seem like they are in the right. They thought they could reject the offer and force the city to pay their price and they were wrong. Any decent real estate attorney would have told them to take the state offer and move on because they risk getting nothing. They played chicken and lost and now they are trying to gain sympathy for people because they didn’t hire proper legal council and fake a fair offer.

    The mortgage company has a title company to research and clear the title. it's part of their underwriting. Title companies are also insured because they make mistakes, which is the case with you. They should never have given the lender a clear title go ahead. Sue the title company.

      It runs alongside the river, making those campsites fetch much higher rental rates. Otherwise based on what I've seen in their past videos the road was not as aesthetically pleasing until the re-routing was done.

    So with your story getting more wide spread. Wondering if you are going to clear up some of details you seem to leave out. There are other sources saying you mentioned early on that you knew of the latest direction of the road but you intended to fight that to get it changed back to the original router. But yet you went ahead and purchased the property in hopes if that didn't work then your land would become more valuable if you remodeled and could source of income form it being rental property.
    Second thing. Why are you avoiding sharing that you not only asked for 1.5 million for the "land Grab" as you refer to it. Plus 3 million for lost future income.
    Do you might also sharing how much your sells of Your book you have mentioned a few time have increased since posting these video.
    Do you also might sharing how much revenue you are generating from TH-cam from your channel you created for this.
    Yes I agree 200% it sucks you lost your commercial property you purchased. But as they say there is always more then one side of the story. There is actually at least 4 side to every story. The truthful fact from both side and the lies from both sides.
    I do truly hopes this gets resolved fairly for you and then over time you can get past this and life will bring you better luck in the future.

    It doesn’t make a difference if you were born with a silver spoon in your mouth! It shouldn’t make a difference if there were absolutely no emotional feelings tied to that property! They knew when you purchased it that the road was going to take it. It takes at least 5 years for studies, plans and engineering to take place for a new roadway. The only thing I wish you wouldn’t refer to them as the “government “! After watching a couple meetings I refer to them as “a board of poorly elected people “!
