I doubt they even have a real trademark and not some generic tag along trademark fx “Green Stuff Chameleon” vs “Chameleon” She should sue them for loss of income for the time the video was down. She would win in two minutes since Green stuff has admitted fault. Also its a US court fineable offense for filing a copyright strike. Though ive never heard of it occurring.

You are 100% correct in leaving your video about the youtube strike up. As a community we can and should forgive mistakes, but never forget... Let it serve as a warning to all companies that would seek to bully and intimidate through youtube trademark claims that they are beholden to the community and we will not tolerate these abuses. GSW really did have a long time to think about what they were doing before they did it, the fact they manually filed the strike themselves proves that. I find their apology kind of stinky and just a measure to mitigate the damage they've done to their own reputation. Also 48 hours is not a few hours. That's two days.
I really don't know all of the details, but if they are seriously trying to make amends then at some point people need to get over it. Forgive others of their trespasses as you hope people would forgive each of us of ours.
TH-cam needs a policy where TH-cam will place a strike against any channel making an unsubstantiated copywrite claim or causing an unfounded strike against another TH-cam channel. Additionally, after 3 strikes are placed against a channel, that channel will no longer be able to place a copywrite claim or strike against another channel ever again. That would greatly reduce channels placing unsubstantiated copywrite claims through the TH-cam system.

I'm happy to hear Vallejo reached out to you and replaced all your paints. They've earned my trust. Companies should try to maintain positive relationships with all reviewers, especially ones that continue to market their products. I can't believe the actions of Greenstuff...they should be grateful for reviewers as yourself. You dedicate a lot of time into these videos and by sharing it with the community, you create more interest into the hobby. I love your work and want to say thank you for all that you do to allow this community to grow.
Very glad you left the explanation video up. The fact that GSW wanted it taken down is another indication they're not actually accepting responsibility as they're trying to sweep things under the rug. This stuff should stay up as a matter of public record as a warning to companies. Also, always liked Valejo, but I have to say I love them even more now. Great reaction there and well deserved good advertising for them.

It was clear from their reply to you that GSW knew you didn’t breach copyright that it was an issue with Vallejo. They were just trying to prevent you from talking about their competition. I am glad your community rallied around to support you, if there had been no backlash I am sure GSW wouldn’t have retracted anything.

Vallejo has proven themselves to be a consumer conscious company with the customer first and also a producer of great paint products. Yep. Some companies are just way to jumpy to file claims against the “little guys”. Instead they should just be happy for the free advertising, even if it’s a simple mistake of saying/typing of a product “name”. It’s not like TH-camrs are stealing their patents, TM’s, copyrights or anything. Just doesn’t make the company look very good. This isn’t the first, not good optics for GreenStuffWorld I’ve seen. They have made themselves to appear sue-happy. Makes me think twice about buying their stuff. Instead, I might find alternative sources or design, manufacture and sell my own similar products.

Found your channel through reviews of some of the new paint releases, so this situation is pretty new to me! It's a bit of a red flag that they asked you to take down the video about the copyright strike. I appreciate that there's probably some professional embarrassment on their end, but it definitely smacks of them trying to bury bad press instead of being accountable. Glad that you've been able to resolve the issue, your content is great!

not trying to beat a dead horse but. on a side note, firstly, yes you are 100% right to leave up your explanation videos as this affected YOU. secondly, trademarks are territorial. so unless they have registered them in ALL the countries, they have no right to go after you (and vallejo if not in the same country has the right to the name). and thirdly, yes, you are doing 'review' videos. so whatever the product was called at the time, they have no right to go after you for that either. not a lawyer but just my 2 cents. glad you got it sorted tho! :)
Chameleon paint was trademarked in the us like 20 years ago when it first came out, and i think it was called Chameleon color shift paint. The original was green to purple shift. I forgot the brand that owned it back then.

I'm so glad this was quickly resolved, and you have all smile faces again. Another channel MxRPlays was just helped by the troops of the internet at the same time. It's good to see people come together to help one another instead of tearing them down, gives me hope for a better future.
Basically, GSW F'ed up. Their beef is with Vallejo, but took it out on you. Their copyright is only valid in Spain, and their own "color change" paint has been out for over a year, yet they didn't file their copyright until October of 2019, just after Vallejo announced their paints. As a result, Vallejo already had boxes and such designed and were shipping out to distributors and retailers, before they had a chance to change the name to "shifters" Pretty shady on GSW's part, and this is going to hurt them in the long run. Alex is great to deal with. I am a Vallejo dealer on the east coast (Elm City Hobbies in NB), an Alex has never failed to be awesome in helping me out with anything I needed. I have met his brother Micheal as well as his wife. They were on vacation in the area and wanted to stop in and see my shop and introduce themselves. Was like meeting an idol almost. Their mother Eugenie is very nice as well as I have had the odd conversation on the phone with her! Top notch company run by a top notch family. So much so that I have been told if I am ever near Barcelona, that I am required to stop in and see them! LOL One day!!

While you have a copyright from he moment you make something, however, you do have to register it if you want to keep others from using it, or want to sue someone else for using it. "The Difference Between Copyright and Trademark While both offer intellectual property protection, they protect different types of assets. Copyright is geared toward literary and artistic works, such as books and videos. A trademark protects items that help define a company brand, such as its logo. For example, Acme Publishing Company can trademark its name and logo, but would copyright books and videos that it created." Furthermore, GSW's product has been out on the market for at least a year (if not more) yet they didn't decide to register it until October of 2019, just after Vallejo made the announcement that they were coming out with a similar product. Coincidence? Hardly. At the time that Vallejo decided to make a similar product, GSW hadn't had the name registered, and thus was fair game for Vallejo to use, which they did, as product was sent out, which is why Naomi has products marked with the old name, and why Vallejo is sending her the new products with the new name. Furthermore, the name "Color Shift" has been used for product in the automotive paint industry for many many years, long before GSW's product came out on the market. So not only are they playing fast and loose with product names, but the name of their company is a take on a product that Games Workshop makes. Shady practices going on at GSW.
@@viper29ca That's incorrect. You do not need to register a copyright in order to sue someone for violating it. Registering the copyright simply makes it easier to prove in court that the copyright is yours. The rest though is spot on. :)

@@viper29ca I find it a bit ironic that you keep referring to a site explaining the difference between trademark and copyright, yet fail to understand it yourself, harming your otherwise excellent point (in that GSW are being trolls). Copyright pertains to the chemical composition and/or the production process of the paints. Trademark pertains to the name of the paints (and only so on packaging and in other forms of marketing, not in general speech or "in-story"). Obviously GSW have zero claims to copyright anywhere in this whole situation (let alone on the video in question), and they only own the term "colorshift" in a highly limited capacity. Trademarks are cheap, so today's companies like to file them in every major market and for every conceivable type of product at the same time, only surgically cutting out countries/states and/or very precise definitions of products for which a genuine (small and/or local) actor has already established a presence using that term. GSW's bad faith behavior toward competition is contemptible, but Vallejo aren't "the little guy" here; they'll be able to take this small (petty) last-minute blow in stride. And GSW have publicly apologized for their actions against an actual "little guy", i.e. this channel, and unlike Blizzard they've a) explicitly referred to the whole ordeal in their apology and b) actually reversed those actions, too, so they deserve some leniency, meaning no boycotts. And thank goodness for that, as it's almost impossible to get Kneadatite or Procreate at a reasonable price over here otherwise. Well, some online stores sell GF9-branded green stuff and grey stuff (and TAP-branded green stuff), so I'd have a few other options, but the only other source of brown stuff I know of is P3-branded one, and I've never actually seen that being sold anywhere. Citadel-branded green stuff is widely available, of course, but they charge an arm and a leg for a tiny, gap-less ribbon. Bought once. Never again.

Companies and people should be judged not only by their public dealings, but also by what they do when they think the world isn't watching. The letters and your dealings with GSW in that video are a good insight into their behaviour BEFORE they realised it was going to be a PR problem. That's as important as how they dealt with the matter after the community blew up at them :)

Yeah, I am willing to believe it was just the top brass being out of touch. It's a shame it happened though, because internet hate is very unforgiving. I for one wish they can move past this, because more choices is always a good thing for consumers.
I'd also suspect that they didn't necessarily know the real difference between "copyright" and "trademarks". They are essentially a small, family-run business. I doubt they have legal experience, plus they are not native English speakers. Ultimately it's actually helped Naomi's channel, but the "haters are gonna hate" on GSW. Social media is an unforgiving world and the vitriol around at the moment is astounding. Then again, you only have to look at the current political climate to see that the World in general is going crazy!

Why does the apology from Vallejo seem so much more sincere than that from the responsible party, Green Stuff World? GSW did not proactively work to repair the damage done to S&S. While I can sympathize Green Stuff World, they certainly have a responsibility to understand their actions before taking them; not asking for forgiveness after the fact. Hopefully, if nothing else, this will increase traffic to your work and you are able to make a positive out of this extremely negative situation.

GSW is fighting with Vallejo in Spain over their "Color Shift" trademark. Vallejo may very well be in the wrong there, I don't know the first thing about trademark law in Spain. However I do know that in the US a trademark like "Color Shift" is the weakest kind of trademark and it likely wouldn't fly here at all (because it's just describing what the paint does). I'm hoping this was just an over-eager GSW employee who didn't understand that trademark is not copyright, and it is absolutely not appropriate to use the copyright mechanisms on TH-cam to deal with trademark issues. GSW is a small company, trademark and copyright are fairly complicated, so I can absolutely see this happening. At the very least it sounds like they've learned their lesson.
@@jeffwells641 GSW also runs risk of running afoul of much larger players like Plaid and other international corporations that use "color shift" paint, including makers of automotive paint. I don't know the particulars of Trademarks in Spain but often there is a right to first refusal for companies that have product that used the trademarked name prior to the trademark to challenge the trademark on that basis. If Vallejo had product produced prior to the trademark or even GSW's product (likely as Vallejo produces a lot of paint) they likely could challenge based on that. The laws are often written to prevent predatory Trademarking by rival corporations. As with all legal battles though, in the end it often is decided by who has the deeper pockets or larger legal budget. I really like GSW's products. They shipped fast and at reasonable prices, esp internationally. I was planning on ordering some more before this happened. But.... I am watching, waiting, observing. On the bright side this channel has gotten a ton more traffic thanks to this so, that's a plus.
I think there should be some recourse against parties that lodge frivolous copyright strikes on TH-cam. If a company like GSW knew that their own channel would face consequences for a claim that could not be defended, they might be a little less trigger-happy. In hockey when coaches challenge a call, they lose a time out if they fail. Maybe on YT, they should -get- a time-out if they report a claim they cannot successfully defend.

A trademark in Spain doesn't mean you can't talk about it on your channel. Second, your voice is so soothing, I used it to help me fall asleep last night. (I'm going to subscribe, just for your voice.) Third, I'm glad you didn't take down your video about the copyright strike. Just them asking you to makes that company look ever worse than they did for originally making the strike.

The law should be just enforced. This means, yes, unsubstantiated claims can be made, but they mean perjury.. only the first part is being enforced.

Very glad you left the explanation video up. The fact that GSW wanted it taken down is another indication they're not actually accepting responsibility as they're trying to sweep things under the rug. This stuff should stay up as a matter of public record as a warning to companies.

Yep. Some companies are just way to jumpy to file claims against the “little guys”. Instead they should just be happy for the free advertising, even if it’s a simple mistake of saying/typing of a product “name”. It’s not like TH-camrs are stealing their patents, TM’s, copyrights or anything. Just doesn’t make the company look very good. This isn’t the first, not good optics for GreenStuffWorld I’ve seen. They have made themselves to appear sue-happy. Makes me think twice about buying their stuff. Instead, I might find alternative sources or design, manufacture and sell my own similar products.

It's a bit of a red flag that they asked you to take down the video about the copyright strike. I appreciate that there's probably some professional embarrassment on their end, but it definitely smacks of them trying to bury bad press instead of being accountable. not trying to beat a dead horse but. on a side note, firstly, yes you are 100% right to leave up your explanation videos as this affected YOU. secondly, trademarks are territorial. so unless they have registered them in ALL the countries, they have no right to go after you (and vallejo if not in the same country has the right to the name). and thirdly, yes, you are doing 'review' videos. so whatever the product was called at the time, they have no right to go after you for that either. not a lawyer but just my 2 cents. glad you got it sorted tho! :)

Chameleon paint was trademarked in the us like 20 years ago when it first came out, and i think it was called Chameleon color shift paint. The original was green to purple shift. I forgot the brand that owned it back then.

Vallejo are good guys - I recall asking them some some of their guides and within a couple of days they linked me up with them all, solid and helpful.

I'm so glad this was quickly resolved, and you have all smile faces again. Another channel MxRPlays was just helped by the troops of the internet at the same time. It's good to see people come together to help one another instead of tearing them down, gives me hope for a better future.
Basically, GSW F'ed up. Their beef is with Vallejo, but took it out on you.
Their copyright is only valid in Spain, and their own "color change" paint has been out for over a year, yet they didn't file their copyright until October of 2019, just after Vallejo announced their paints. As a result, Vallejo already had boxes and such designed and were shipping out to distributors and retailers, before they had a chance to change the name to "shifters"
Pretty shady on GSW's part, and this is going to hurt them in the long run.
Alex is great to deal with. I am a Vallejo dealer on the east coast (Elm City Hobbies in NB), an Alex has never failed to be awesome in helping me out with anything I needed. I have met his brother Micheal as well as his wife. They were on vacation in the area and wanted to stop in and see my shop and introduce themselves. Was like meeting an idol almost. Their mother Eugenie is very nice as well as I have had the odd conversation on the phone with her! Top notch company run by a top notch family. So much so that I have been told if I am ever near Barcelona, that I am required to stop in and see them! LOL One day!!
Trademark and copyright are not the same thing. You have a copyright from the moment you make something and no registration is needed
@@Ozchuck You are partially right. While you have a copyright from he moment you make something, however, you do have to register it if you want to keep others from using it, or want to sue someone else for using it.

Furthermore, GSW's product has been out on the market for at least a year (if not more) yet they didn't decide to register it until October of 2019, just after Vallejo made the announcement that they were coming out with a similar product. Coincidence? Hardly. At the time that Vallejo decided to make a similar product, GSW hadn't had the name registered, and thus was fair game for Vallejo to use, which they did, as product was sent out, which is why Naomi has products marked with the old name, and why Vallejo is sending her the new products with the new name.
Furthermore, the name "Color Shift" has been used for product in the automotive paint industry for many many years, long before GSW's product came out on the market. So not only are they playing fast and loose with product names, but the name of their company is a take on a product that Games Workshop makes. Shady practices going on at GSW.

Which is why GSW never registered the copyright until this past October, despite having their product on the market for well over a year prior (if not more) when they found out that Vallejo, a competitor, was releasing a similar product using the same name. Copyright pertains to the chemical composition and/or the production process of the paints.
Trademark pertains to the name of the paints (and only so on packaging and in other forms of marketing, not in general speech or "in-story").
Obviously GSW have zero claims to copyright anywhere in this whole situation (let alone on the video in question), and they only own the term "colorshift" in a highly limited capacity.
Trademarks are cheap, so today's companies like to file them in every major market and for every conceivable type of product at the same time, only surgically cutting out countries/states and/or very precise definitions of products for which a genuine (small and/or local) actor has already established a presence using that term.
GSW's bad faith behavior toward competition is contemptible, but Vallejo aren't "the little guy" here; they'll be able to take this small (petty) last-minute blow in stride. And GSW have publicly apologized for their actions against an actual "little guy", i.e. this channel, and unlike Blizzard they've a) explicitly referred to the whole ordeal in their apology and b) actually reversed those actions, too, so they deserve some leniency, meaning no boycotts. And thank goodness for that, as it's almost impossible to get Kneadatite or Procreate at a reasonable price over here otherwise. Well, some online stores sell GF9-branded green stuff and grey stuff (and TAP-branded green stuff), so I'd have a few other options, but the only other source of brown stuff I know of is P3-branded one, and I've never actually seen that being sold anywhere. Citadel-branded green stuff is widely available, of course, but they charge an arm and a leg for a tiny, gap-less ribbon. Bought once. Never again.

I think most of us agree with & support your decision to leave all the videos up. Companies and people should be judged not only by their public dealings, but also by what they do when they think the world isn't watching.
The letters and your dealings with GSW in that video are a good insight into their behaviour BEFORE they realised it was going to be a PR problem. That's as important as how they dealt with the matter after the community blew up at them :)

Alex is a wonderful person and has supported the gaming community in many different ways, including sponsoring classes, paint and takes and other such activities at shows and conventions. I have been in the industry for a long time, and I have to say that it is absolutely wonderful to see a young woman getting involved not only as a gamer, but as an influencer as well! So glad this was resolved so quickly and that GSW fairly quickly realized their serious error (although I do think that initially they were unaware of just how serious this was for a TH-cam channel). I think their apology sounded sincere & they've done what they promised to rectify the mistake.
Yeah, I am willing to believe it was just the top brass being out of touch. It's a shame it happened though, because internet hate is very unforgiving. I for one wish they can move past this, because more choices is always a good thing for consumers.
Also, looking at their English, it seems as though they may also have had a communication barrier, which could explain some of it.
I'd also suspect that they didn't necessarily know the real difference between "copyright" and "trademarks". They are essentially a small, family-run business. I doubt they have legal experience, plus they are not native English speakers. Ultimately it's actually helped Naomi's channel, but the "haters are gonna hate" on GSW. Social media is an unforgiving world and the vitriol around at the moment is astounding. Then again, you only have to look at the current political climate to see that the World in general is going crazy!

Why does the apology from Vallejo seem so much more sincere than that from the responsible party, Green Stuff World? GSW did not proactively work to repair the damage done to S&S. While I can sympathize Green Stuff World, they certainly have a responsibility to understand their actions before taking them; not asking for forgiveness after the fact. GSW is fighting with Vallejo in Spain over their "Color Shift" trademark. Vallejo may very well be in the wrong there, I don't know the first thing about trademark law in Spain. However I do know that in the US a trademark like "Color Shift" is the weakest kind of trademark and it likely wouldn't fly here at all (because it's just describing what the paint does).
I'm hoping this was just an over-eager GSW employee who didn't understand that trademark is not copyright, and it is absolutely not appropriate to use the copyright mechanisms on TH-cam to deal with trademark issues. GSW is a small company, trademark and copyright are fairly complicated, so I can absolutely see this happening.
At the very least it sounds like they've learned their lesson.
@@jeffwells641 GSW also runs risk of running afoul of much larger players like Plaid and other international corporations that use "color shift" paint, including makers of automotive paint. I don't know the particulars of Trademarks in Spain but often there is a right to first refusal for companies that have product that used the trademarked name prior to the trademark to challenge the trademark on that basis. If Vallejo had product produced prior to the trademark or even GSW's product (likely as Vallejo produces a lot of paint) they likely could challenge based on that. The laws are often written to prevent predatory Trademarking by rival corporations. As with all legal battles though, in the end it often is decided by who has the deeper pockets or larger legal budget. I really like GSW's products. They shipped fast and at reasonable prices, esp internationally. I was planning on ordering some more before this happened. But.... I am watching, waiting, observing. On the bright side this channel has gotten a ton more traffic thanks to this so, that's a plus.
I think there should be some recourse against parties that lodge frivolous copyright strikes on TH-cam. If a company like GSW knew that their own channel would face consequences for a claim that could not be defended, they might be a little less trigger-happy.
In hockey when coaches challenge a call, they lose a time out if they fail. Maybe on YT, they should -get- a time-out if they report a claim they cannot successfully defend.

TH-cam decided to recommend your "copyright strike" video. I had no idea who you were, I don't paint, but I wanted to see what the video was about. First of all, the claim was total nonsense. A trademark in Spain doesn't mean you can't talk about it on your channel. Second, your voice is so soothing, I used it to help me fall asleep last night. (I'm going to subscribe, just for your voice.) Third, I'm glad you didn't take down your video about the copyright strike. Just them asking you to makes that company look ever worse than they did for originally making the strike.
