I don't think that's correct, or at least there's probably a ton of exceptions. If you get a check by accident is that a gift? That's like the idiots at ATMs that think they can keep the money that's accidentally given to them, or the rare money that's released from crashes involving an armored bank truck.

If you send somebody merchandise that they did not order, then charge them or demand payment, or simply harass them, you are fucked. Check fraud is entirely different laws and governing body. A check is not merchandise. Consumer goods, etc.
Apoarently they did not merely ship a second unit to those that ordered it. They shipped them to random people on their shipping list. What's much worse is people who paid for the item and never received it are getting these notices. Also the error occured 3 months ago and NECA is only just now addressing it. Conveniently right after the PayPal dispute period us up for those that never received what they paid for months ago. Oh and NECA's threat to charge the CC's of those that received the extra product violates us Federal Law big time!
I only have a very small Last Ronin collection, but this is the point where I stop collecting NECA. I've seen so many horror stories online from other collectors; from not shipping out items ordered on their site past the date where you can no longer dispute the charge with your bank, to ZERO customer service when dealing with damaged products. Just from that alone, I don't want to give this company any more of my money. NECA's incompetence shouldn't be on the customer. It's not their fault for getting an extra diorama, it's 100% ON NECA. Do they not have a single person employed inside their dingy and moldy warehouse that can at least double check that orders are correct before sending them out the door? Their threats are also hilarious. If they can't ship out products from their own store properly, what makes y'all think that they're going to correctly charge the cards back for the extras? 😂 This has Class-Action written all over it! This whole situation just put into perspective just how terrible this company is, and I truly feel bad for the folks who aren't going to be getting their preorders. Kudos to the collectors that send them back so that someone else can get theirs (even though they don't have to, by law).

You got something you didn't buy, return it. Amazon has gotten people too comfortable with "the customer is always right" approach and telling people to keep items and a refund. It's created a society of scammers and entitled people. Now to NECA, that second statement rubbed me the wrong way and I'm not even a customer of theirs. They should have incentivized people returning the extras with discounts or something else creative as a thank you. I'd also be fine with them charging people's cards for items not returned within an acceptable time frame.

It's unfortunate, they do make some great products (atleast their tmnt line).
NECA needs to seriously evaluate their shipping, & customer relations departments.

It's at minimum some terrible pr from neca. And the crazy part is this could get worse.

I don't have an issue with them asking for it back, but I do have an issue with the charging your cc & overall tone of their email.
