That's why the Western trade in black slaves started earlier than, was much larger than, and lasted much longer than, the Middle Eastern trade in the same. ...wait a sec... -------------- Sorry, sorry, so I put it in a funny (to me) way-but I think the point is valid. _Don't get me wrong!_ I'm a big fan of Dr. Qadhi and he has changed my view of Islam completely - I used to think "who could believe in that?", but after listening to so many of these lectures, I begin to think "who *wouldn't* believe in this?!" - _but..._ Well, what the historical societies of the Hijaz or Barbary Coast did isn't necessarily what Islam itself says to do; but *if* we're going by "what [society] _ought_ to have done", that almost-maybe-possibly lets America off the hook too. In other words, the slave trade is maybe a fraught example to choose; when the scale/temporal longevity/initiation "prizes" are all taken by the Afro-MidEast slave trade, it's hard to claim it as a unique ill of Enlightenment jurisprudence. -------------------------- A better example might be the modern West... unfortunately. When you let people make their own laws, it appears that they make laws like "we, the gov't, can take your child away + put you in jail if you don't let us brainwash them into claiming to be 'trans'-and then mutilate them permanently." *That* is sick... and nowhere under Islamic law has ever been so degenerate, as far as I know. That's aaaall us. Hooray.

Two points: Just to make sure that Imam Shatibi is quoted perfectly: what he said is the following المقصد الشرعي من وضع الشريعة إخراج المكلف عن داعية هواه ; حتى يكون عبدا لله اختيارا ، كما هو عبد لله اضطرارا . ( كتاب المقاصد » القسم الأول مقاصد الشارع » النوع الرابع في بيان قصد الشارع في دخول المكلف تحت أحكام الشريعة » المسألة الأولى المقصد الشرعي من وضع الشريعة إخراج المكلف عن داعية هواه) The primary legal objective1 of the promulgation of the shar#∏a is to free the subject from the exigencies of his own whims so that he may be the servant of All\h by choice, just as he is the servant of All\h by compulsion. (English translation: Volume II page 135). So, he did not talk about this life separated from the life to come as he said in another place. في العاجل والآجل . The second point: difference between Shariah & Fiqh: Fiqh is defined to خطاب الشارع المتعلق بأفعال المطلفين Fiqh is the address of the Law Giver related to acts of the ones who are commissioned by rules. Long discussion shows us that Shariah and Fiqh overlap. Shariah as Ibn Taymeyyah & others defined is what Allah ordained from Aqeedah & A'mal. It includes all things Allah told us and addressed us with. It is more than Fiqh and Fiqh is part of Shariah. Jazakum Allah Khyaran one more time Br Yasir
Dr. Qadhi is dangerous. Over and over again he makes things I thought were irrational and bad seem completely reasonable. Over and over again I catch myself thinking "this Islam thing is pretty smart actually." WHAT'S HAPPENING TO ME
