However, as a foreigner in China, it might seem that all odds are against you when you run into legal trouble. There is a huge "us vs. them" mentality in China, and in this video, I want to help you not be at the butt end of any legal situation you might run into.

    I applaud you for inviting the random guy staring at you to sit next to you. I’m not sure I would/could have done that. It’s clearly shows how different the social environment is there. Sorry to hear about your terrible massage experience. Thank you for sharing your story.

    here's my story !! I was speaking to the police in the subway asking for directions when this guy (it was obvious that he was trying to practice English) came up to me offering help and I told him very politely : " I can speak Chinese" but than he got upset and said that I should have thanked him cause that's the right way to behave !! I got offended and said : "what are you gone teach me manners now ?!" or smth like that and the guy started shouting telling everyone "this foreigner is unpolite, doesn't respect Chinese people and was not letting me get directions or anything just attracted a crowd and the police kind of surrounded us for protection ! I kept saying to him what the hell do you want from me go away but he would not let it go so since I was in a rush I got out of the subway and then came back after a while and asked for information again ! that was a scary situation imagine if no police around...! Now some might think that maybe I should have let it go from the start since I know the nationalism problem but the thing was that in 10 years in China never have I seen this kind of behavior towards foreigners and to say the truth that's when I felt the nationalism rise for the first time cause up til then this kind of situation was absurd to even think of so it caught me by surprise...

      I have had the same thing on a bus guy sits next to me when I'm totally knackered. Tell him I just want to rest and he starts getting all upset jumps in another seat and starts giving me the bad eye jumping and twitching like hes going to kill me. LoL I'm sure its PTSD from the way they are treated when younger causing a victim mentality. Even speaking German does not work. I now say I'm an English professor $1500 an hour when would you like a class. 4 years ago.

    Winston, your videos are just great. Informative and entertaining. I'm 72 years old and have seen about 15 western countries but your videos are way better than the travelogues of 1950s thru 2000 US TV. Thank-you so much.

    So true about making a Chinese girl angry. Very jealous indeed. Even sometimes when it's not warranted. Just be careful and take it seriously.

    Let me summarize the whole video:
    1. Foreign guy cheats on Chinese girlfriend, gets his property destroyed, his arm bitten, however has to pay her 40k yuan. She wants him in jail so to scare him and milk him. Moral of the story: DON'T CHEAT.
    2. Mexican girls gets stalked, Chinese authorities don't care, she insisted and got the police guys to call the stalker and stop him. Moral of the story: when dealing with local authorities, INSIST.
    3. Serpentza got a foot massage, his friend wanted sexual services but got any and leaves the place, however Serpentza had to pay 50 yuan for his foot massage + the 200 yuan non fuck of his friend. He confronts the staff, insult one of them, the whole China got offended, the mob beat the hell out of him, but police saved him and agreed he was right. Moral of the story: DON'T INSULT A CHINESE.
    4. Random Chinese guy appears in the video with nothing to say, but stays making the final minutes of the videos awkward-hilarious. Moral of the story: BE FRIENDLY.

      yes she bit a chunk out of his arm, destroyed his property AND he hurt her. All of that happened. just because you don't think something is justified doesn't mean the damage wasnt done. im sure her family was saying the same thing in reverse to the police, ya know? It's about perspective on facts and taking your personal emotions out.
      Those events happened and then he was extorted. What about that presented in video format was so hard to understand?

    I guess on of the golden rules of living in a foreign country is there are always certain groups of people you don't want to mess around. Apparently, in China, they include girls and dodgy massage.

      Girls in China know if they are dating foreign men then Chinese men are missing out. So maybe they expect some allegiance from the foreigner. Also that guy was stupid to hit that girl. She thrashed his place and he should have called it the cost of cheating on her and call it a day.

      Giving a black eye is very amateurish, choking out the aggressor is often a very good choice, and there are many other ways also to hurt someone bad without leaving any marks.

      I kinda agree...as a foreigner, you should date a Chinese girl ONLY IF you are serious about it. Chinese girls simply take themselves too seriously and they are very jealous and very demanding as well.

    I don´t know if you are reading this Winston, but I truly admire you, I really do. I admire the way you deal with such a calm state of mind and serenity all the legal and issues mess, as a foreigner, in a place like China and their narrow mentality. What I mean with is that they can´t even deal with constructive criticism, you can have an idea what Chinese deal with justice.

      Yes, but he has to get another chinese visa and most likely there would be notification from local authorities to the PSB where he would get a new visa stamp inputted into his passport, thus, causing same scenario.

    Honestly, there is something weird with the first story. While I agree with that the girl has the better home base, I usually find that the average Chinese has a very strong sense of 'fairness'. Of course she and the police think it is fair that he pays compensation. But if he and she agreed in front of the police (did they do that?) to a certain sum, then actually I would expect the police to side with him now.

    I Have been stalked seriously by 2 different women, I was laughed at by my Principal, Fellow males, Police and even counselors. Til I was either serious injured or, they had a first hand experience with them attacking me or being just completely insane(no way to calm them down or deal with them). I never laid my hands on a women, only blocked or held her wrist while she tried striking me. Ppl don't realize all around the world men have to deal with this and are expected to shut up and take it.

    At this point without any court testimony this is basically a he said she said story. In the U.S., during a domestic dispute, if a man gave the woman a black eye he would be handcuffed and taken to jail. Charges for domestic violence will definitely be filed. If the woman acted out of control he should call the police instead of resorting to physical violence, which under the law is a no-no. However, there will not be a meeting for private settlement with regards to financial compensation. This would be treated solely as a criminal case.
    Now, if you are a foreigner living in the U.S., then in certain instances you will find yourself in big trouble by mere accusation alone if an American citizen filed a police report against you even in the absence of physical evidence. The police will come and arrest you, bring you to the police department for fingerprinting and mugshot and then lock you up. Then you will have to appear in court where your fate is at the mercy of the judge. Then days later the immigration department will follow suit. You will be put in orange jump suit, handcuffed and chained like a most wanted violent criminal and taken to a solitary confinement unit of the prison. Then you will face the immigration judge in whom your fate will be determined.
    Should I be doing a TH-cam video on that based on what I had gone through? Nope. Because such anecdotal experience may not be the representation of what is happening in the culture of the whole system of the large nation. It will merely draw out the racial bigots who have no basis except generalized hatred into the comment section.

      I am fairly certain that US immigration doesnt even bother with criminals anymore. It used to be that way, after you finished your jail time, they would put an immigration hold on you and deport you. But no longer.

I watched a Report in the News just recently about German Citizens who are in Jail for various Crimes in Thailand. The Honorary Consul deals with that. Your Embassy should always be the first Stop if you got some serious Trouble. They getting payed for Stuff like that.

    when I was stationed in Korea it was the same way if it was a you versus them mentality they literally gang up on you and you'd be facing 20 30 or 40 Koreans that would beat you up and that's actually the only way that you never get in a fight if it was on the streets it would never be one-on-one they would never attack you when they get in a group they gain Courage

      it's because the US military has a really bad image in Korea. I've been to Korea and they told me a lot of horrible stuff about how our military behaves there.

      Asians have committed the worst crimes against their own people than whites have , look at the Japanese invasion of China , or china's own communist government . Anyway I have no anamosity towards them or there culture, just stating facts about how that act sometimes when they have felt slighted in some way . We should probably pull our military out of South Korea they are big enough to support themselves, plus just like China they have a habit of blaming the US as a way of distracting their own population from internal problems , a lot of countries do the same thing .

      Anthony oliver when did you exactly get beaten up by 20-30 koreans? where did it happen? as a korean myself, this kind of 'mob' behaviour resulting in physical violence is unheard of all my life, unless you encountered some kind of underground gangsters, then I am not too sure.
      were you drunk, fighting in night club in Seoul?
      another thing... don't spread rumours that koreans are hostile to America or American. there are tons of people who appreciate America's help during the war and current military Base in Korea and we feel responsible for so many losses of young soldiers, America did not have to help us but America and many countries did it for us.
      We don't blame America for anything, maybe other Asian countries obviously. quite opposite, we have so much influence in Korea from USA.
      I am sorry if you personally had bad experience in Korea, but I wanted you to know that young Americans sacrifice was not for nothing here in Korea.

      +ykuk glad we're not universally hated, sure seems that sometimes. From my experience, Koreans are the most honest and friendliest people I have ever met, and I am glad our countries are so close. If I may make a suggestion, I think Korea and Japan should bury the past and become friends too.

      ykuk don't have any problems with the Korean people I spent 4 years in Korea , and 20 years in and around their culture, the majority of the time we didn't have any problems, but their are always a few times we did .

      He'd probably be laughed at and dismissed. I think the point of his video is that the Chinese police and legal system are highly likely to side against the foreigner and would rarely go out of their way to help the foreigner in a situation like this.

    Winston is right. Casual relationships with local women are not the way to go in China. They're also not recommended with if you intend on dating a Chinese girl overseas. I'm living in Australia now, I interact with people of all races and religions, and I've taught at schools where students come from a variety of backgrounds.
    I get teased a lot for being single for so long but I don't see anything negative about it. I'm not a ladies' man, in fact I'm far from it. I have no charm. Maybe occasionally, a Chinese girl or two get(s) interested in my upbringing, family background and what not. As long as the questions aren't too personal, I answer them to the best of my knowledge. Now that I've watched two of Winston's videos that talked about the things to note when dating Chinese women, I believe the usual questions I get from Chinese girls could be alarm bells.

      horowizard No, of course not. Living a lie is bad too. Leading a girl on is dating her without the want or ever intending to be long term, but telling her otherwise or also avoid telling her your true intentions. Obviously, you can't tell how the future will be, but quite often you can tell if there is something genuine there besides physical or whatever drew you to her in the 1st place. Do you see where I'm coming from? I've been in that position 1st hand many times & it quite irritating but I've never gone psycho on men...lol I do the opposite & completely cut contact, avoiding them 100%.

Six months? Six weeks? Two years? Ten years? Until death? None of what you are saying is specific enough to really be useful and it's all irrelevant anyway. Human nature is complicated and today's world no longer fits in with the traditional model of introduction, courtship, marriage and family. Not everybody wants to go the distance either and that should not be a bad thing. Some people marry but never start a family. Some have children but never marry. Others keep multiple partners. Some cultures even permit multiple wives or husbands. Sometimes it's even encouraged or a desired status. It's a diverse world and the more we learn about it, ourselves, the considered norms and customs of civilizations, our preconceived notions begin to deteriorate and break down.

    People of China should watch, listen and try to understand Serpentza more, because they always want to assume he is judging Chinese people badly, when it is quite the opposite. Accusing someone for judging when they are doing the judging themselves; isn't that funny. They should watch this and some other videos and maybe they would understand his point of view, his experiences in China etc. What he explains in this video about those other peoples experiences and his own experiences is horrible; and there are much more. But some might say "but how do you know of it is true?" blah blah blah excuses excuses. Judge for yourselves. I know there are lots of people who have similar bad experiences, and I have MANY also!
    Yes he says about many bad things because... IT IS what has happened to him and to people he knows; or can see with his own eyes !!
    Keep up the good work and keep giving us your experiences, tips and advice :D

    This has nothing to do with him being a foreigner. This happens to Chinese people in China as well. For example in traffic accidents where you hurt someone else you're also "responsible" and have to pay the other person. Also if you hit somebody, or end up in a fight in China and hurt the other person, the police might also force you to pay the victim. This goes for both Chinese people and foreign people. It's very different from in the west where you have insurance companies and rights that basically will take care of anything that happens to you.

    few words on the 2nd and 3rd topic. (as a Canadian chinese who live/work here now)
    there are virtually no seriousness concept of "harassment" here in China. it's too new to me.
    staff make sexual jokes at work. i've heard many cases like your friend had... girls who got stalk/harass and dont know where to turn. (not just foreign girls.. chinese local girls too) which is scary. and to be honest, as a friend, i can only offer an outlet for them to rant about it. (unless something is getting very serious and have to use the "connection" card) so i am glad that was resolved.
    as for the 3rd story...
    i think you and your friend not just got scam, but got setup there.
    usually the "establishments"(the "good one") will just tell you up front there are no service during those time of the year.
    so letting your friend head upstair i think it's already beginning of the trap.
    but anyway... i agree about the them vs us. concept.
    so .. word of advice for the chinese who grew up in western country like myself... in any argument situation on the street... DO NOT claim "i am a XXXXXian".. you will get even worse treatment then what Winston got here... because in this case you are not just a foreigner.. you are a traitor to the hardcore local... that's my 2 cents.

    Actually this legal problem happens all the time to the ordinary Chinese people too . Lower class people can not afford the price of getting into trouble because there is no justice based on the current legal system, unless the level of your case gets to as severe as criminal penalty.
    If you know more about China, you will find currently the judicial system is still very preliminary. There are lots of cases happening without a final justice, which greatly frustrated ordinary Chinese people to trust the legal system. Actually, the more practical way is that the one, who speaks louder, wins. And of course, people with "backgrounds" (rich father, uncle, or even far relitives) are a group of people you could never get into affair with.
    There is still a long way for the judicial system to go. This explains why Chinese people, including overseas, tend not to get into ANY trouble. I mean, ordinary Chinese people.
    As an ordinary Chinese people I am, I only hope things will get better, but i cannot do anything but get me richer and more influencial. So you know why all Chinese people hate the ones with backgrounds but also envy him and wish to be one of them.

    believe it or not... these situations also happen to local Chinese...except for the crowd beating parts... the differences are that it will be harder for foreigners to deal with these situations because of the language barrier and without knowing a better way to deal with this in China

    Thanks for these great videos, Winston! As you know, many Chinese people carry in their minds two centuries of humiliation at the hands of the Japanese and the West, and this sense of victimhood is encouraged by the indoctrination they receive through school and society, which keeps the people's frustrations focused outwardly rather than at their own government. Now that China is becoming a world power, some of them feel entitled to behave as they imagine foreigners treated them in the past. They refuse to revert to what they believe was their previous state of abject groveling, but in the process have a hard time imagining a middle ground. Hopefully, these feelings will mellow as the "lost generation" of the cultural revolution fades into the past, and the up-and-coming generation becomes more cosmopolitan and worldly wise. Thanks again!

    A friend of mine was in shenzhen years ago. She is chinese but can't speak mandarin. She went to a barber shop in lo wu. They said her hair cost about 300rmb to be done and in the end they wanted 5000rmb for the additional product they put into my friend's hair without her knowing it. The ending wasn't pretty. My suggestion is always go to big shopping centre for a hair cut, avoid shady places.

      bert smith in China's case, I had a similar experience and they took my Hong Kong passport and I took my Chinese one to the US embassy. Not sure how that worked out, but it did, and so I always carry a passport to another country near the one I am in.

      The embassy is there to help you if things like this happen. If you lose your passport you can go to the embassy. They can search for you if you give them your name, address, dob etc.
