Trademarks in works of art are allowed? Can I use brand names?

    Many artists asked: How could Andy Warhol get away with using Campbell's logo without seeking permission? Well, it's hard to explain. He should have asked, but Campbell's doesn't mind (the free marketing worked great). If you want to use Chanel as a relatively young artist, you might get into legal trouble!

    Very good analogy. I would add that an artist can in fact use logos and brands in their work legally protected. There are a few instances of this. I remember the case of the photographer that used barbies to destroy them and take pictures of them for his art. Mattel sued him and he won leaving a precedent.

      I will search for this case! Thanks! From the brand side, they will see does this artwork add value to my brand? Would people buy this artwork for the name of the brand, or the fame of the artist? If the artist is more renowned, the brand is having a free ride (and of course they don’t mind). If there is a dispute, then they will leave it to the judges.

    It is wrong until we have done some defaming or accusations mentioned in our art ?
    And what about biography stuff like original IRL stories also can't feature their names and logos?
    The one question I always had.. looking forward to get an answer

      First of all, the fair use terms and conditions in your country could be very different from another country. For example, in France you could make 1 copy of visual expression using someone’s logo but you can not make more copies of prints. This is to protect painters’s freedom of expression, who use brand logos or other IPR for practice or personal purposes. So that’s fair use in France. It depends on your country and on the case (how many copies you produced, or if you used it to make money etc).
      Generally speaking you can make in real life drawings, but you must watch out for portrait right and IPR (trademark, design etc). You should get permission even in real life. Like, imagine you are in the beach one day, someone took a photo of you and painted you in an ads, without paying you or asking for permission. Would you be happy about it? Most likely, no. This is just a small example, maybe not remotely accurate, but hope it helps.
