    I used to grade the STAR exam, it was a remote job. Not passing a state exam keeping you from graduating HS really sucks.

      In ny state, back in the day, we had to take & pass the standardized tests in 11th grade. If one fails, they stayed in the same grade (11th) until the student(s) could pass. We had a few in their 20's trying to graduate. 😮

      They should have been given a basic refresher for reading, writing, spelling and basic maths to give them the best possible chance of passing. Even if that Pass was the lowest acceptable score.
      Perhaps an eye test and a hearing test could have helped to find out if there were medical issues for their inability to learn. I have had hearing problems most of my life and had to sit at the front of the classroom if I wanted to hear the teacher properly. (Being naughty I didn't always do that though.)

      In Alabama we had to pass each subject before graduating even if you made all A’s throughout the 4 yrs it really sucks this was 2010 I don’t know if they still have this

    She also waited too long before she hired this woman. She was making a BIG RISK in doing this so late. Whatever the advocate could do at that point was going to be limited. She knew that.

    The 504 program gives special accomodations for everything, not just for tests. Where the child sits, special coaching and assistance in the classroom, how much time to finish quizzes, etc. If the defendant is claiming not enough accomodations, she's got a big hill to climb to win her case.

      You have to have a medical diagnosis to have a 504. It gives accommodations to kids with medical problems.

      You meant IEP defines special accommodations for student's education. A 504 plan is placed to accommodate children mainly with medical needs and make sure that their absence from school doesn't affect their parents in receiving truancy.

      @@mickeyyoung472my kid has a 504. It accommodates longer testing time, extra time for assignments, hall passes to leave early to class so she doesn’t get stuck in crowded hallways, access to water at all times, and seating arrangements favorable to the student. Plus some additional accommodations dependent on the diagnosis.

      This clip only tells me a portion of what is going on. I would like to hear exactly what service the plaintiff provided besides the time and a half on the test -- where there any materials that she supplied the defendant's nephew? Did she have a talk with the teachers? Did SHE work with the defendant's nephew in helping him to prepare for the test? If she did all that, she provided a service, meaning, she should be entitled to SOME payment. I'm not sure if I would give her the entire $500 for it, unless there is something within a contract that states that regardless whether the student passed or failed the exam, the guardian is responsible for paying the entire amount. If it doesn't state that in the contract, or there was no contract at all, then I think the plaintiff should be entitled to half because she DID provide a service.

    As someone with a learning disability, I can confirm that I was that student who got really good grades due to tutoring, IEP tools, and hard work, but my anxiety over testing and the way they would phrase things to trick you made doing standardized testing very difficult for me. Now because of that hard work in the class getting good grades I at least always got a passing grade enough to graduate so I think part of it might be motivation as well. If motivated enough and using the tools you should do well enough to pass but sometimes it's discouraging when you observe other students who do nothing pass with an A.

      @@Zzz2x if people follow your IEP the accommodations should be met as well. For example mine requirement was I get a extended time on the test. Now I hated pulling that card but I started to say no it's there for a reason and I'm not abusing it. If I genuinely need the extra time that my IEP requires I get then I will say something. Accommodations should be met and unfortunately you have to advocate for those accommodations a lot to the point of exhaustion that sometimes they don't happen.

    I made passing grades in school but for some reason I totally crashed when taking those tests where I had to shade in the answer with a pencil. I wasn't disabled nor did I have a learning deficiency, it was the weirdest thing that me and my supportive parents couldn't get a handle on, but this was way back before we had "specialists" for everything under the sun. To add insult to injury, I was also penalized on my SAT for being half Asian, needless to say, I never attended college, but turned out successful

      Standardized tests really don't demonstrate kids true knowledge or ability, and our school systems' focus on them has really derailed the importance of focusing on more than just English, Science, and Math. It has caused us to really neglect History and Social Studies, and it has caused many school systems to take funding away from the Arts, which are incredibly important for the development and well-rounding of our nation's kids.

    Some people are just bad at taking tests. I was an honor student and I used to get really bad anxiety when I had to take test. Especially if the test was timed because I didn't like to feel rushed. I would pass the test but I would be up all night worrying about it.

    People really need to look into the law in there district pertaining to the STAAR test. They're required to offer a STAAR alt test.

      Doesn’t qualify under 504. 504 are in regular classes. STAAR Alt is for self contained life skills Sped students

    I just want to start by saying thank you for uploading these wonderful episodes on this lovely Sunday. I cannot believe my eyes. AnyWho, the defendant is in a lot of trouble. Because she waited till after her nephew, failed, and then hired the lady, but then didn’t pay her. Hopefully the plaintiff did not intentionally make her nephew be exempt from being able to retake his test. We shall see carry-on! ❤

    Test taking anxiety sucks! I had straight A's but I had test taking anxiety that caused me to fail either the final for the class or the state test, which resulted in me having to take Algebra twice, and later on to be removed from a gifted high school. I couldn't graduate college as well. It really sucks y'all

    If he passed 3 of his tests, he would be able to graduate. 2 of the 5 tests the kid only needed to get 1 in 4 questions correct. Also, there is no time limit on those tests. Almost every kid graduates. There is a lot more to this story. He probably did not have enough credits to graduate.

      That's not true. The Aunt said that he had all passing grades. And they would've known well before the standardized testing if he wasn't going to have enough credits to graduate that year, either due to failing classes or excessive absences. They didn't mention how he did on his finals, or if they had even been taken at that point... But you are not allowed to graduate OR move on to the next grade level if you fail the standardized testing, SOMETIMES (in younger grades) they will look at other standardized tests scores, like the MAP test and combine that with the students EOG (end of grade testing) score and see if they can come up with a passing score, and generally they also factor their grades into the equation, because many of these students really do just need accommodations to help them, ESPECIALLY with testing.
      It's also not true that's there's "no time limit" for tests. Of course there is! It's more than enough time most kids, but for certain kids, kids who have been dealing these kind of learning difficulties for their entire lives, the testing anxiety just continuously gets worse and worse, and makes them less focused, more frustrated, and makes its take even longer.

      @@girlonfire8855 Excuse me? It is true. This is my literally my job in Texas. If he had all passing grades that is not the same as having all your credits. In Texas, the law is he has to pass 3 of 5 EOCs: English 1, English 2, Algebra 1, US History and Biology. If he can pass 3, they IGC him on the 2 he could not pass. Texas does not use MAP testing for graduation. The schools I work with follow testing accommodations to the letter. There is no time limit on the test. Again, my literal job to know that.

      In N.C., where I live, that is how things work, so that is obviously what I was going off of.
      But there are a few things that still don't exactly line up with your theory, imo... First of all, as I mentioned, they would have or should have known that the student wasn't going to have the credits needed to graduate prior to testing. Do you disagree? Or are you saying that he can pass English 1, English 2, Algebra 1, US History, and Biology, as classes BUT if he doesn't pass the EOC's, then he doesn't receive any credits for those classes?
      If all of that is the case and the kid didn't have enough credits to graduate, either by not taking the correct classes, which seems unlikely, or by failing the tests (which was obviously admitted), then why bother hiring a disability advocate to try to help appeal the decision and find a way in which to get her nephew to graduate on time? Why would the advocate take the case if there was NO CASE? Why offer to appeal the decision pro bono if she didn't find something, or believe that the kid's accommodations hadn't been met?
      You obviously work for the school system, so you have a bias towards the school being correct... I'm not sure if you've heard all of the teachers recently going viral lately bitching about kids with IEPs and 504s and what a pain in the ass they are... I'm the oldest of 5, and 2 of younger siblings had IEPs. I watched my mom go through it. Now one of my two kids has an IEP while the other is in the AIG program. It's really frustrating. Trying to communicate with my son's teachers every year, getting them to understand what exactly he needs to thrive, just getting them to actually READ the IEP itself! I can't tell you how many years in a row I've contacted a teacher a few weeks into the school year to find out how he's doing, and asked about something, and they responded back that they didn't realize that he even HAD an IEP! And now after many years of him an IEP, being held back a grade (which is when he finally got his IEP, even though I had voiced concerns well before), NOW they are considering taking away his IEP right before he enters middle school, and maybe IF he needs it, giving him a 504 plan, all because he has exceeded all expectations and done exceptionally well that they now want to put him in the AIG program as well! I'm really proud, but incredibly worried! Seems a bit too accelerated... Obviously I'm biased as well.

      @@girlonfire8855 I am not saying he doesn’t get course credit if he doesn’t pass the EOC. I am thinking he didn’t get credit probably for the last semester of courses. The aunt said he had passing grades, but he might not have taken the courses he needed to take to graduate. It sounds like aunt got custody after mom died, which would result in many teens not making good decisions at school. The advocate did not agree to do it pro bono. She wanted payment & would have continued to advocate if aunt had held up to her side of the contract. Aunt probably knew he wasn’t going to win an appeal on graduation, leading to her not paying. The advocate cannot say whether aunt’s narrative was the full story due to FERPA laws. I stand by the test was not his only reason for not graduating. I firmly believe there is more to the story. Also, attendance can deny a student credit. If the student misses more than 10% of the school days, the school cannot award credit for the course until the student makes up the hours. (Texas law.)
      I feel for your personal story. I have 2 children - 1 with a 504 the other with an IEP. Don’t let them exit your child from Special Ed services. The fact that he is doing well is proof that the accommodations are effective.

    This is where people need to be aware of the graduation requirements. No one is REQUIRED to take the STAAR to graduate. There are a ton of replacements like taking the SAT and such. My daughter doesnt take STAAR. I opt her out and she goes onto the next grade. STAAR is NOT a requirement. Neither is the "mandated" tutoring for kids who fail or didnt take STAAR. Schools are required to OFFER the STAAR and tutoring (I forget what its called) but they cant FORCE a kid to take it nor deny them entry into the next grade. For graduation its a little different because SOMETHING is required and there is a list of alternative apart from STAAR. And in reality, STAAR needs to be abolished completely.

    I guarantee you that this student got passing grades to move him along in school and likely didn't earn the grades.
    This is the problem because schools are not educating kids and fail them at every level

      I think more than likely there are several layers to the problem. Some school districts have teachers who aren’t qualified or who have too many students in their classroom due to understaffing. My cousin told me she had more than 30 students in her class which I had thought was illegal in most states. I attended a public elementary school that was K-6. We never had more than 28 students in our classrooms and always had an assistant teacher. I have taught ESL and Spanish to adults. When it’s just you and a classroom full of students, it’s difficult to find the time to give the students who need extra support the attention they require to succeed. I had to tell my boss that I couldn’t teach a gentleman as part of my ESL class because he was illiterate in his native language. I had to spend 20 minutes explaining basic grammatical concepts to him while the other students were waiting for us to move on with the lesson. I felt badly about it, but he needed one-on-one instruction. After that I started asking that my classes be capped at 15 students.

    If you can't pass a minimum skills state exam, then IMHO you shouldn't graduate. Employers expect to have students meet at least the minimum standards. Otherwise, a diploma is worthless. I don't know if it is the same today but a few decades ago in Maryland you were required to pass a basic skills English test and a basic skills math test to graduate high school. You should have been able to pass those to get out of elementary school not high school. The math test had no time limit, you didn't have to borrow from the left hand column and you didn't have to find common denominators for fractions. It was a joke of a test but a number of kids couldn't pass it - which to me meant that they shouldn't have been passed onto middle school years ago.

      I respectfully disagree. It's been a long time since I graduated high school but at that time, the state I lived in was one of the very few that required a graduation test. I knew several people, some friends, who got better grades than I did, who couldn't pass the graduation test. Granted, there were less accommodations towards those with learning disabilities, but one test should not be an absolute factor towards graduating. A good friend of mine had a learning disability. She did well in school and simply couldn't pass the test. She ended up moving to her grandparent's house in another state to finish high school.

    In other words, what she does is lower the test standards so that kids that can';t even read or write graduate the same as other kids, thus defeating the whole point of education and preparing them for the real world.

    Good Lord; as the low the bar for graduating high school has already sunk, there are people getting paid to demand "accommodations" for those who still can't reach it after multiple attempts. This is why the bachelor's degree is the new high school diploma. (And it defeats the purpose of a "standardized test" if some of the people taking it get to be exempt from the "standards" under which it is taken.)

      Standardized tests are not a good measure of competency and intelligence, they're designed to be graded easily en mass across a whole district and/or state. Definitely true in this case if the student has passing grades in every class, they just don't do well on the standardized test.

      Not all people are good test takers you can be on the honor roll and still can’t take a test and pass the first time Or maybe the second as well. I have a son that has a IEP ( 504 ) they call it something different in every state but every thing concerning this is FREE it’s no way she should have been charging a dime for her services due to it falling under a disability act! But the mom is crazy for even agreeing to pay her for her services.. they have all kinds of free help for students that’s in that program especially in Texas! So idk why this lady decided to go with the defendant to help her son then have to pay! That’s ludicrous…
