European Court of Human Rights rules 'gay cake' case inadmissible

  • The European Court of Human Rights has ruled the case of a man suing a Belfast bakery for not writing the words “support gay marriage” on a case is inadmissible and has dismissed it.
    Institute of Civil Society Executive Director Mark Sneddon says the verdict, which came seven years after the suit was launched, came when Gareth Lee tried to claim it was an issue of human rights.
    “You can’t now raise issues of human rights under the European Convention of Human Rights when you’ve never raised them before at any of the three levels of courts in the UK which have dealt with this,” he told Sky News host Cory Bernardi.
    Mr Sneddon said the European Court of Human Rights “let the decision of the UK supreme court stand”.

    This is so simple. If gays want a cake and a bakery does not believe in what it stands for; go elsewhere.       I agree. You should have to ask around for a specific thing if you can't find it readily available. Isn't it best to find a provider that's interested and capable of producing that fringe lulnatic product you're after? At some point, we're all going to be begging for food and water. You can now pay $3 for a coffee, but no sugar. However, it's not too much to ask for basic servvices like clean tables, condiments, and the products companies specialize in which is now becoming a disappointing problem. It's better to just stay home with a computer and not have to deal with a great big open lunatic asylum.

      Mocking the institution of traditional marriage with these lawsuits is no coincidence, and for the record, Masterpiece Cakeshop, the Colorado baker was perfectly willing to make them a blank cake just not decorate it. Also for the record, the attorney is related to the customers who filed suit. These are targeted attacks on society. Of course, the fake news doesn't tell you that.

      Mr. Lee has no authority and cannot compel anyone to disregard and act contrary to their Morals
      and principles of behavior.

When asked why he was doing/did he gave a straight ( no pun intended) answer. " I went into my field to help people who needed help. Over time I got more and more gay men come in who needed their rectum tightened back up due to all the sodomy. I kept telling them the rectum is designed as a one way exit and not as a 2 way street."

      If they wanted the cake so badly they could've just tried to make it at home by following an online recipe for it, but now they had to start a court case because people wouldn't make the cake. The bakers in that bakery had every right to refuse to make the cake if it went against their own beliefs or whatnot. This goes to show that there will always be people in the world who think: "If I can't get my way, I'll do it my own way" or "If I can't have this, nobody else can have it."

      I’m gĀ, and would disagree. People don’t have to love you or even like you. I would stop trying to liked or loved. I would work and earn one’s respect. It goes miles longer in life. I would never put upon a Bakery to make a cake that’s unseemly, or out of line with their catalogue of prescribed cakes. Why not become a Baker yourself, and just see how hard it is from 3:am to 10:pm. I dare you. Also, I would make my own cake and perhaps do a jolly good job.

    the problem that a lot of people have here in Northern Ireland is that this was financed with government money, a government-run equal opportunity and discrimination commission who took up this case on this guy's beheath. so the guy had little to lose taking this case so far

      Yes, that sounds to me like misuse of public funds. That's unfair for the business owners. Not sure if it's possible but if the commission wants to have a test case, they can fund both sides. I'm Christian and I hear many Christians are so worried about discussion Christianity or standing up for our values... I'm not sure why. May be I'm a bit thick, I don't actually care about what the others think.
      At a meeting with the principal and other parents, it was mentioned some people wanted religious studies taken off our school time table. I objected to that right away. Some parents thanked me after saying they wanted to support me but they didn't know how to voice it... luckily a few parents got together and spoke to the principal later.
      We already had 2 instances like this in 2021. The school had an optional religious studies ( one being Christianity values studies) for decades but it's always on the agenda to take it off now.
      We need to fight for what we believe in. Otherwise the minority few who makes the loudest noise and most complaints wins.

    I believe that any privately owned business should be allowed to discriminate as the owner or staff see fit.
    I say this not to promote or advocate hate etc but rather to support the notion that we should all be free to act as we see fit in business.
    Whatever happened to the idea of "the management reserve the right to refuse admission" ?
    A business might expect to lose custom and money if this happened but let the business run itself as the owners see fit.
    I expect no interference in my private life as to whom I spend time with or befriend etc. My businesses is indeed my business.
    Different rules should apply for public services etc, obviously.

      The counterpoint to this argument is the situation that happened during the US civil rights era. Black people had legal equality (kinda) but certain geographical areas were able to drive them out and make travel difficult by denying all sorts of services (privately held ones like hotels, fuel, hardware stores, etc) on a town-wide basis. The courts made it illegal to refuse service to someone of a protected class _because_ of said class. And this kind of law exists in basically all Western countries.
      The difference, in this case, is the message on the cake. Forcing a business to put a specific message on a cake is not the same thing as refusing service. Selling a generic wedding cake for gay marriage would likely be protected, though.

      If someone suspected you of denying customers based on something that is legally a protected class, they could rather easily prove (demonstrate beyond reasonable doubt) if you are doing that. Simply send a dozen customers, with half of them being of that class and record who you denied (or something along those lines). The fact that you weren't explicit in your reason for denying them would make little difference to the courts. At best, it's minor obfuscation that might let you hide your policy for a while.

      The argument then becomes that if your business is open to the public, it is a public service. The problem with this case is that both sides are discriminating against the other in different ways, so whose rights do you protect? In this particular case, the problem with siding with the gay guy is that you wouldn't just be encroaching on the business owner's beliefs, but you would be setting new precedent (the goal of these suits, really) that other businesses would be expected to adhere to. You would be encroaching on many people's rights, not just the customer's.

      I have no problem even with businesses refusing business based on the appearance of a customer. No shirt no shoes no services.
      Approach it from an econ perspective. Every customer a business doesn't serve is a customer lost and places a financial cost on the business through lost profit and takes the business one step closer to their business closing. I want truly discriminatory businesses to end up where they belong, bankrupt failures. People that require them to bake the cake are protecting a discriminatory business.

      Northern Ireland’s Equality Commission paid Lee’s £250,000 legal fees using public funds. The Christian Institute paid Ashers Bakery’s £200,000 legal fees. So the total cost of the case is almost half a million pounds. Their solicitors must be laughing all the way to the bank.

      I'm glad that the court decided to not take on the case. But they declined it on the basis that the complainant hadn't pursued his case properly, not that he would not have had a valid case if he'd handled it differently. In other words, in different circumstances, the court might well have found in his favour.

      It was the British court that threw it out. The European Court rightly said it was inadmissible and couldn’t be ruled on because it wasn’t appealed and pursued domestically first.

    For a start, they are homosexual, not gay, that word means bright, cheerful, happy. Next, in my opinion there is no such thing as homosexual marriage, it is something decreed by govt, therefore it is a civil union. I'm not religious, I certainly do not believe in some mysterious all powerful being, well, maybe Jimmy Page, given his otherworldly talent. But I do believe that marriage is between a man and a woman, and that is sacrosanct. As to the self absorbed arsewipe that caused this, he should have to pay all the bakers costs, punitive costs, and then be charged and put in gaol for creating a nuisance. Although given his bent he might welcome gaol! My opinions, I am completely within my rights to express them, and no person or platform has the right to deny this.       Gay used to be joy, but in the 1920's, homesexual men used the word, 'gay,' as their secret word to hook up with men in cruising scenes which probably were city streets, work places, and parks. This word stuck through the 20th century to mean men who have sex with men so it was strange for all of us kids even in the 1980's school music class to always be singing about being gay when we also knew we weren't happy and joyful either for lots of boys had anger and developmental issues going on due to diet lacking nutrion, funky family life, and fake propaganda narratives. The USA was way over branded and incredibly over stated for what it is, but we did have great power projection going on since WW2 that is now a thing of the past.

    The reason for the ruling is they hadn't refused the customer, they refused to make the cake with that message. If they had refused to server the customer based on his sexual preference that would not be legal.
    It is a simple concept which is you can't force anyone to publish something they don't wish to. It has little to do with refusing to serve someone, since they never did so.

    I'm from Northern Ireland and Mr Lee got his cake from another bakery in Belfast in 2014 but continued with the case anyway. Northern Ireland was the first Country in the UK to have Civil Partnerships which gave Gay people to same legal rights as Married people. It was Westminster (UK Conservative Government) brought in SSM against our NI Assembly in 2019 along with Abortions. By the way, Mr Lee walked past me in the street in Belfast about 4 years ago and I recognised his face from the Media.

    Here in the United States we had the same exact thing happened. This is probably where the people wanting the cake got the idea. Time frame is about right here in the states this was about seven or eight years ago and it took four or five years to get a decision.
    First the state what is taking the business license away and then the gay people had won a large lawsuit against the bakery. Of course everything was appealed and I cannot remember if it was Colorado supreme Court or the supreme Court of the United States that said the baker had the right to refuse service on religious beliefs.
    While all this was going on the baker and their family was receiving death threats had the windows at their shop broken out. When the religious right found out what was happening support for the Baker and his family turned everything around for them until the court made their ruling.

The couple could have literally gone anywhere else and got the cake they wanted!     Mocking the institution of traditional marriage with these lawsuits is no coincidence, and for the record, Masterpiece Cakeshop, the Colorado baker was perfectly willing to make them a blank cake just not decorate it. Also for the record, the attorney has a close relationship to the customers who filed suit in that case. These are targeted attacks on society. Of course, the fake news doesn't tell you that.

      Indeed, if my memory serves me right, one US state had a very long legal battle over the same type of situation? Which I believe included the local school showing discontent for the bakery that did it, the bakery won in the end also, but not until after a length legal battle.

    The crux of the matter is simply the verdict that it is the church's right to principles of their faith. It has been a long standing Christian "statute" for thousands of years (in fact "#institutionalized" for thousands of years) that they don't condone the statement that is to be on the cake. Just the statement but not the individual, he's fine! #faithbeliefstolerancepliz!!!

    There is nothing wrong with ‘discrimination’ per se. A job interview is about discriminating between the merit of the candidates and this is a just and proper thing. The issue is discriminating on an UNJUST basis. That is unjust discrimination. Screening people on vaccine status in a bar or restaurant during a global pandemic is just discrimination in the service of the common good. Disadvantaging someone on the basis of characteristics they have not chosen is unjust discrimination. It should be obvious.

    If I went into Muslim baker, and asked them to bake me a cake and then put bacon on it, they would have a religious reason as to not be able to do it. Quote rightly so based on their religious views. I am a born again Christian and would not bake a cake with anything against my beliefs.
