    The comments below are spot on regarding Maryland AND including Florida: sailboats do not always have the right of way-- it depends if they are under sail or at motor PLUS other applications and situations where sailboats do not lead on the chain of command: such as meeting a vessel under distress

    A motoring sailboat is treated as a powerboat with regards to right of way. If they are under sail you should pass a sailboat to windward. It is usually easier for a sailboat to turn down wind rather than upwind to avoid a collision. Markers are red to starboard(not right) and green to port when returning from sea or if travelling clockwise in the intracoastal. Never heard about red markers being the inland marker in the intracoastal but that also works.

    I don't know in your state but here in Maryland sailboats do not automatically have the right away. The only time they automatically have it all the time is if their sail are up. If they are on their engine then they depending on the situation have to give you the right away if you meet the requirement and of course with the motor on if they meet the requirement they will still have they're right away.
    When I took a safety boating course through the state of Maryland due to my wife being too young to pilot a boat. So I decided to take the class with her and our oldest son who was 14. The biggest argument that came up during the class work was sailboats and power boaters. People started yelling and getting mad and leaving telling the DNR officer that they don't know the rules in Maryland. The following week they printed out in large print the rules regarding sailboats and the right away in the state of Maryland. Of course there were still people who disagreed and the DNR officers handled it pretty good. They simply told everyone if you want the law change go to Annapolis and try to have it changed.

      Maryland boating laws and rules of the road are the same as all the other 50 states. Sailboat has the right of way if it is under sail. Under power with no sails up, they use the same exact laws and rules power boats use. Rules of the road are common sense. What if a sailboat is under sail and on a collision course with an oil tanker? Or a freighter? If you are the Capt of the sailboat what are you going to do? Are you really going to hail the tanker and tell them to alter course so you don't have to tack? Trust me, the tanker wont budge. Some call it "might has right" or tonnage and size rules the day. Either way, you are the Capt of your craft and you are responsible for its safe operation and the safety of any passengers. If that requires you to change course, dance naked on the bridge or alter course because some other fool doesn't do the right thing, then you do it. If you don't, YOU will be held just as responsible as the other guy because you had time to make a decision to alter course for safety reasons and chose not to. Arguing over rules will get you killed, just make responsible decisions....at least that is what I learned getting my 100 ton license.

    What happens if you don’t stay between the red and green markers? Do you hit sandbar or land?

      not all do but they are reflective so you can see them

    There is no InTERcoastal Waterway in the USA; it's the InTRAcoastal Waterway. It runs along the coast, not between the coasts. (There is, though, and Interstate Highway System that runs between the states.)

    Sailboats do not always have the right of way. Vessels being overtaken always have the right of way. Just clarifying what you said, which is mostly correct.
