Actually it's a bit differenti: after 50 moves a player can call a draw. If neither player claims the draw after 50 moves without captures or pawn pushes the arbiter can intervene and declare the draw, but only after 75 moves played under those conditions
To be fair 39 is close to 40 which is close to 50 if you're desperate. Honestly it's like if you tried to perceive how many minutes pass without knowing you had to beforehand. Like idk maybe 7 maybe 10 but they aren't even close to each other.
