Hi Arun, as per new IT rules, NRIs have to limit their income other than other sources below 15 lks, if they want to take advantage of 183 days rule. As per the clarification from FM, these 15 lks can be business or rental income from India. Now, what if business/rental income doesn't cross 15 lks but capital gains from equity/debt MFs cross 15 lks? Will CGs be considered in Indian income which technically shouldn't be considered as they are taxed separately? If govt likes to tax CGs and then consider them to be Indian income too, then its bad for NRIs to invest in India and counterproductive for govt.
