Sometimes, tenants will disappear just to cause you harm and intentionally leave no way to contact them so that they can cost you a lot of money. In that case, I wouldn't go through the eviction process but instead document everything and and anticipate this in advance by putting it in the lease by stating what abandonment is. Why should landlords have to pay lawyers and go through lengthy and costly evictions just because the tenant is malicious. Put it in your lease, document everything with pictures and videos, and keep records of how they are malicious and spiteful throughout the relationship with them. It all depends on the judge. Some judges are pro landlords and some get elected by hating landlords.
In my state, if they’re not paying rent, stop communicating, no longer living there for at least a certain amount of days, you send them the abandonment notice and 30 days to pick up their stuff in writing. If they don’t pick it up, then you dispose. Eviction process will cost you many months of rent and attorney fees anyway. And I’m betting tenants who don’t pay rent won’t actually get an attorney anyway. This is the path I would take and not legal advice.
This is so cool. I'm just a rent a room in a house tenant. The crazy old hoarding lady has been kicked out as abandonment. The landlord is waiting for her response. Her stuff is out. She went about 3 yrs rent free because of the coof. We'll see what happens.
My cousin 86 Elderly man had two tenants living in a shed in the backyard. This is already against code for Duncanville, TX. 1) started out as a caregiver (non-paying, no lease), they surrendered and left property in the shed. Local Police said the shed is the owner and on the owners property and I am allowed to drill the dead bolt. She left no forwarding address, been gone for at least 6 weeks. Was told by 3 different people verbally to come get the dogs and belongings, while they came and got the dogs, they left some stuff in the shed and SHE (tenant) has the keys. I am taking inventory and cleaning up the sheds. Tenant also has a warrant, that is probably why she didn't give a forwarding address.
So my tenant is not in communication. ( one week ) door left unlocked, only rented furniture left. His Cell shut off. Employer has no idea, and the police are looking for him. An investigator said there is a warrent. I posted an abondoned notice , took out the food on the range and plan on taking possession soon.
I know this is an old video, but if anyone would know. What about an apartment that has no furniture, the utilities are turned on and the rent is paid in full. Is that apartment abandoned?
Hi Austin. I charge a fee to answer questions like this. Don't get into the habit of asking non-attorneys to answer legal questions. It will bite you. If you're a landlord, protect your investment by making a small investment in getting an attorney to answer your legal questions.
My rental is mostly empty with folded empty moving boxes and cleaning stuff. No furniture and there's a UHAUL truck parked on the drive way. No written notice, no keys, no forwarding address. Rent 6 month due. I think it's abandoned.

What about your tenant going to jail no contact for over 30 days
That probably is not an abandonment. They likely intend to return.
The trick is to have Steven Seagal stay there as the new tenant....
