Lexington's Source of Income ordinance is set to take effect on March 1, 2024. But House Bill 18 is sitting on the governor's desk waiting for action. It will likely be vetoed, but the legislature will likely override the veto. HB 18 would become law immediately. Check the video for details.

    In my state, if they’re not paying rent, stop communicating, no longer living there for at least a certain amount of days, you send them the abandonment notice and 30 days to pick up their stuff in writing. If they don’t pick it up, then you dispose. Eviction process will cost you many months of rent and attorney fees anyway. And I’m betting tenants who don’t pay rent won’t actually get an attorney anyway. This is the path I would take and not legal advice.

    I'm being blocked by a liberal judge from evicting a menacing, aggressive tenant who's not paying rent and has broken every thing on the lease contract including on 1 months rent months rent and not paying utilities. Do you know how I would check the military status of these people? So I can document other than saying I don't know. They clearly are not military or ex-military but I have to write down a website or something for checking that

    Hispana is correct, especially when a landlord is privy to " renoviction " and also issues no notice of month to month leasing termination... Yupper ! Merely producing a different lease than the tenant has to a willing judge causes eviction. The landlord just wakes up " twazy ". In my case, the surrounding area is being renovated anyway since there were Mexicans burrowing and committing deadly felons under street level. Evicting blacks and lying cost the area over 7 million dollars in damages. * Be Blessed and Not Stressed

    Got a letter in the mail today to vacate with 0 warning or reason whatsoever won’t be able to ask til Monday. Can they just kick me out when I’ve never had an issue and my rent has always been paid on time

      What happened? Typically, the notice to vacate is the first step. Then, they go to court and file an eviction.

      @@katierose9641 they tried to kick me out because I pulled a gun on the pest control guy that entered without knocking or announcing himself. He said no problem not a big deal but the landlord thought it was a big deal. Anyway I thought I was being broken into so they let me stay

    Here is a mind bender. After the lease expired the landlord agreed to the judge’s request to “give tenant a few months to vacate until she can find housing” which the landlord wrote (regretfully) in the dismissal. Tenant is misconstruing this as stating she is entitled to stay there as long as she doesn’t find housing-which is absurd. The district court has somewhat agreed with the tenant. There probably isn’t a case out there as strange as this. Logically, if the landlord gives the proper notice for the Mon to Mon lease the. Afterwards it shouldn’t be an issue to get a judgment to vacate. Trail has not come up yet but this is something that might go either way. This tenant was a paralegal for a long time and is abusing the lease.

    Sometimes, tenants will disappear just to cause you harm and intentionally leave no way to contact them so that they can cost you a lot of money. In that case, I wouldn't go through the eviction process but instead document everything and and anticipate this in advance by putting it in the lease by stating what abandonment is. Why should landlords have to pay lawyers and go through lengthy and costly evictions just because the tenant is malicious. Put it in your lease, document everything with pictures and videos, and keep records of how they are malicious and spiteful throughout the relationship with them. It all depends on the judge. Some judges are pro landlords and some get elected by hating landlords.

    Thank you so much. I had a hard time getting this answer. We are living in Ohio and renting out a house in Kentucky. The original lease is month to month, but was never renewed, so is an implied month to month lease I guess We have rented way below fair market rents because the renters are friends and they have not been high maintenance. So for at least seven or more years we have paid a few hundred dollars more on the mortgage than received on rent. We have decided to sell the house and the renters are putting off the realtor coming to see the house. I think we may end up having trouble from them. We did verbally notify them of the upcoming sale of the home a year ago.

    My sister is going through something that's a very strange situation she moved into this Rental property and has a rental voucher she was told to move in and the property management company would turn her moving paper packet into so they could started getting paid they failed to fill out the paperwork and they wouldn't respond to any email or text messages for over 9 months and wouldn't give her the paperwork to move put are local tenants rights agency did everything to help her but was unable to get into with the property management company .they finally contacted her back and said she owed over 25k because she failed to pay her rent. Which she was on a government program that paid a portion of her rent now they are trying to fill an eviction so she could lose her housing and not be able to rent in the state of Nevada can she sue?

      A reasonable accommodation was requested in mid March and I've been verbally abuse, stonewalled and ignored the entire time. The 120 day lease expiration invites me to renew the lease, then they don't include the renewal application or ever submit the recertification paperwork and have just ignored the specialist and myself the entire time. Lease expired August 30 2023 and last week we are both only now being informed that after a year they put all voucher holders on a month to month lease, when I've found out that it isn't true. These property managers are becoming more and more shady and creating a lot of fear and problems for tenants with a voucher and who always pay their bills and cause no problems.

    Thanks for the lesson. But it took us much longer. The courts did not follow the Michigan Court Rules - MCR 4.201(M) & (N) - It seemed the Landlord WIN every milestone, but actually the courts helped the tenant to play this delay tactic game more than 40 days and live the premises free. This is a rental property in Michigan. The Lease ended 7/31/2022, Tenant did not move out and neither paid the rent since 8/1/2022. 30-day "Notice to Quit" served on 9/15/2022. Summons and complaint filed on 10/20/2022. 1. 11/30/2022: District Court Bench Trial- Conditional Dismissal - Conditions set by attorneys and Judge without asking the Landlord, Tenant to vacate premises on or before 12/16/2022 - Tenant is not reliable and not be trusted, sure will not move out by 12/16/2022. - This helped the tenant delayed 36 days till 1/5/2023! 2. 1/5/2023: District Court- Order of Eviction Signed by Judge - Should be executed by county sheriff or bailiff or court officer This Court assigned eviction to a Legal Service, and they did not receive order until 1/10/2023 - Legal Service posted 48-hour notice, but not execution of the eviction? - This helped the tenant delayed another 8 days since 1/5/2023! 3. 1/13/2023: District Court- Tenant filed Motion to Stay without escrow deposit? - MCR 4.201(M) - Motion denied on 1/17/2023 (M) Postjudgment Motions. Except as provided in MCR 2.612, any postjudgment motion must be filed no later than 10 days after judgment enters. (1) If the motion challenges a judgment for possession, the court may not grant a stay unless (a) the motion is accompanied by an escrow deposit of 1 month's rent 4. 1/17/2023: District Court- Tenant filed Motion for reconsideration without escrow deposit again? - This is not part a rule of MCR!!! - MCR 4.201(M) - Motion Denied for reconsideration on 1/25/2023 - This helps the tenant delayed another 20 days since 1/5/2023! 5. 1/27/2023: Circuit Court- Tenant filed Claims to Appeal after 20 days and Without bond & escrow deposit? - MCR 4.201(N) - Appeal DISMISSED on 1/31/2023 (N) Appeals From Possessory Judgments. (1) Rules Applicable. Except as provided by this rule, appeals must comply with MCR 7.101 through 7.115. (2) Time. An appeal of right must be filed within 10 days after the entry of judgment. (3) Stay of Order of Eviction. (a) Unless a stay is ordered by the trial court, an order of eviction must issue as provided in subrule (L). (b) The filing of a claim of appeal together with a bond or escrow order of the court stays all proceedings, including an order of eviction issued but not executed. (4) Appeal Bond; Escrow. (b) A defendant who appeals must file a bond providing that if the defendant loses, he or she will pay (i) the appeal costs, (ii) the amount due stated in the judgment, and (iii) damages from the time of forcible entry, the detainer, the notice to quit, or the demand for possession. This helped the tenant delayed another 26 days since 1/5/2023! There is no reason and ground for this appeal accepted by the court, 10 days after the entry of judgment and without bond and escrow!!! 6. 1/31/2023: Circuit Court- Appeal DISMISSED but “shall become effective 14 days”? This helped the tenant delayed additional 14 days! The eviction is still pending and the landlord still not able to recover possession of his property. Any advice is very helpful!

      aint no one gonna read all that. The gist of it is this, if the judge is helping the tenant then were assuming its you who is doing something unjust. You're probably a slum lord. Why did you not renew the lease? to make upgrades and increase the rent by $1000? or selling it and the renters who've paid your mortgage off are supposed to go screw themselves after 20 years of paying off your home? what is it?

      THIS IS SO UNFAIR! I wish I had known this could have been done! I had a property manager refuse to take cera dollars ON MY BEHALF! Not on everyone’s just mine. Which was discriminatory. They cited 18 late payments in 2 years and it was against there policy. Well clearly you violated it before, because there’s only 12 months in a year. If you only accept 2 then again this is discrimination. It would be because of unemployment and not deposited until the next day. The fees were paid. She filed eviction for 105$ they locked me out of the portal to pay and wouldn’t accept my money! It was insane! I’m trying to pay and they are telling me no! Even when I had an order to pay it she refused it and filed again!

    My landlord just shut off my electric. My rent is 14 days late because I've given her 5 months to get rid of roaches and maggots but she hasn't and therefore it's unsanitary for me to live there with children and I refuse to pay that because I'm out triple that bug spraying a 30 man apt building.

      My last landlord wrote in the lease that you couldn't use the security deposit for last months rent . We always left with out paying the last month.

    This is so cool. I'm just a rent a room in a house tenant. The crazy old hoarding lady has been kicked out as abandonment. The landlord is waiting for her response. Her stuff is out. She went about 3 yrs rent free because of the coof. We'll see what happens.

    judges doing this kind of stupid stuff means some landlords will have their property magically accidentally burn up while tenant is away, and collect insurance instead.

    so appeals court took 2 ******* years just to screw landlord while scum tenants live rent free. Judge in this case better give a notice before going to bathroom, stupid 😒. There was no legit reason to overturn eviction, especially 2 years later. Thing to keep in mind if this was small time landlord they most likely homeless now thanks to scum judge.

    If everyone just gives 60 days written notice in every case, all of this should be moot. In the state of Delaware, 60 days written notice to quit is the minimum for all cases.

      I don't think it makes any difference. The 30 day notice problem simply moves to a 60 day notice problem. The "Rental Period" moves from 30 days to 60 days if that's the law reguardless of what the rental contract says. So if a landlord gives a tenant notice to terminate the tenancy on the 15th instead of the 1st as an example, if rent is due on the 1st., you CAN'T start the eviction process on the 15th, two months later. You have to basically act like the next 15 days doesn't count, in order to get you to the beginning of the following month. Then start counting from that point. So in this example, it would be 75 days from the day you gave the 60 day notice. That was my take away from this. It's all BS to be sure, but lawyers love this kind of stuff. They want landlords will stop doing their own evictions and hire a laywer. And even when they do, they still often get burned on this kind of stuff because the laywers can't keep up with it all either. Especially when tenants receive free legal aid via taxpayers. Which All laywers love as well. More billable hours as the two lawyers duke it out with each other at the landlords and taxpayers expense.

      @@davidsine4390 Giving 60 days notice of 30-day minimum will guarantee compliance with the law. It's much easier to give 60 days knowing that 30 days is the minimum. If 60 days was the minimum, it would have to be 90 days to ensure compliance. All of it is defense to eviction by the tenant, who can appeal the judgment and pay rent to the court registry regardless of any "reasons". Regardless of how the appeal goes, the tenant is going to stay in place for a long time paying rent and have a lot more notice. The American system is based on the plantation mentality, it is a feudal relic with "landlords". There's no reason in the modern age why tenant rights are anything less than completely secure, every lease indeterminate, and governed by local housing board at minimum.

      @@papi4253 And you have no idea why no one wants to be a landlord anymore, with rents skyrocketing, and limited availability. Because tenants have more rights to the property than the owner does now. What all this will amount to is government will begin providing their housing for them. Only government can afford to provide free housing with the owners having zero rights. Good luck with that system. Socialism, Communism, Totalitarianism, or whatever else you want to call it.

    Hi I'm not a landlord or anyting I'm here in Illinois and I have a question I'm in a family building I've been here for like 12 years and my family member is giving me 30 days to get out but I never signed a lease and the reason why he's kicking me out is because he doesn't want to rent it out no more and I was paying my rent is that legal?

    So my tenant is not in communication. ( one week ) door left unlocked, only rented furniture left. His Cell shut off. Employer has no idea, and the police are looking for him. An investigator said there is a warrent. I posted an abondoned notice , took out the food on the range and plan on taking possession soon.

    A landlord rents month to month. Which means both parties agreed in advance and in writing, that either party has the right to give the other party notice and terminate the tenancy with a 30 day notice. Sorry, I miss spoke, in California the law was changed years ago and modified the contract retroactively that now requires landlords to give tenants a 60 day notice if the tenant has resided there longer than a year. But of course that new law only favors tenants. It doesn't require tenants to provide a 60 day notice. They were still only required to give 30 days as previously agreed to by order of the government. But when a tenant gives a 30 day notice, no one seems to have any problem with that whatsoever. But when the landlord does it. Nope. Thats no longer allowed and the landlord is being an AH even with a 60 day notice. Why is that? Why is the entire rental business a complete one sided affair filled with hypocrisy and double standards applied to landlords but not tenants? Why is it when a tenant gives a 30 day notice, it's simply contract law and business as usual. But it's completely unacceptable for a landlord to give notice under any circumstances at all now. Even a 60 day notice is no longer acceptable now. And of course neither is breach of contract including but not limited to non payment of rent.

    Govt should waive all American debt due to covd. If not Corporate America will take the biggest hit in history. Have you seen Amazon pinterest facebook etc. on the market today. That is just a warning for what could come.

    In California they eliminated incentives, in 1979, to own and operate rental properties and the Supply dwindled over time. The rent control passed in 1979 did that in the largest cities. The Supply shortage became so acute that in 2019 - 40 years later - they passed statewide rent control. I feel sorry for renters. We rented for a couple years after college. With no Supply, California rents were shockingly high (this was in the 1990s) and now they're unaffordable for most people. Thought should be given to this question: **"Where does our supply of rentals come from?"** That question has not been asked. Politicians act like apartments appear out of nowhere - no incentives required to put all that investment at risk by an owner/operator. Kentucky, by forcing a 2-week or longer automatic stay at the eviction hearing, is incrementally taking away incentives to provide Supply of rentals. IF THE INCENTIVES TO PROVIDE A SUPPLY OF RENTALS is removed.... The SUPPLY of landlords and rentals will vanish over time. And rents will increase as the Supply vanishes. Like I said, I feel sorry for renters. . .

    It is mind blowing that these laws are being passed to actually encourage consumers (ie: tenants) to steal from a business, because lets call a spade a spade - living in someone else's property without paying rent is stealing plain and simple. Pay your bills people, pay your bills. The government should be encouraging people to be financially responsible in the first place, not steal. Absolutely outrageous.

    So glad I’m finished with my trash tenants. I got them out 3 weeks ago. Almost have all the damage to the house repaired. I lost close to $10,000. But I believe all the back rent will be uncollectable. Just look at how the government has screwed landlords so far. Does anyone think the government isn’t going to protect the garbage that stole our houses the rest of the way. The government doesn’t care about property owners. If you to lazy to work, don’t care what you do to other people and want to live off working people’s taxes. This is the government for you.
