    All good. They are there doing their job for a good reason. And the USCG will be the guys pulling you out of a bad situation offshore should it ever happen. Enjoyed your video.

    Border Patrol and CBP are law enforcement agencies, and you may record them in the performance of their public duties in public places, so long as you do not interfere with the officers in any way. airport?
    TSA does not prohibit photographing, videotaping or filming at security checkpoints, as long as the screening process is not interfered with or sensitive information is not revealed.

      That's what we thought. But considering Adrian isn't a US citizen yet, and that we wanted to get home asap, we didn't want to risk it and play lawyer.

      4:00 Air & Marine Operations (AMO) wears navy blue uniforms as shown. The U.S Border Patrol (USBP) were not present. They mostly wear green unis but sometimes wear tan when engaged in marine ops. Both are divisions of U.S. Customs & Border Protection. Good video.

      I'm retired DEA and even though I retired thirteen years ago, even back then, we were told, there is really no legal basis to stop someone from filming you. Not that we didn't do sometimes, anyway, to be honest.

      And even a federal court said that CBP can be filmed, even if their “rules” say you can’t.

      @@jheg96 Yep, the 11th Circuit Court, which covers FL, GA, and AL, ruled that taking photos and video in public of public officials is protected by the first amendment. There are only two Circuit Courts left in the country that haven't ruled on the matter (issue hasn't come up in their circuit yet).

    Can they actually make you shut off the camera. I thought that sort of thing has gone to court many times and overwhelmingly the ruling has always been you absolutely have the right film these interactions.

    1985 we were in Newport RI on a large sailboat anchored within earshot of the Newport Jazz festival rafted up with some others, someone in the crowd knew one of the coasties on duty in the area out of Coast Guard Station Castle Hill they pulled alongside tied up went below and i will not say what went on next but an emergency call came, jumper on the Newport Bridge and they all flew up the companian way untied and were off in a flash,, very cool

    I was in the USCG 1986-1990 and was a qualified boarding officer. When I was in, we would do joint operations with US Customs and other law enforcement agencies. These would be scheduled ahead of time and would happen regardless of weather or other conditions. They were definitely trying to make a quota so they can use that data to ask for money from Congress. You did the right thing by answering their questions and being cooperative. When I was in there were not so many ways to video so it wasn’t an issue. Those boarding officers seemed professional and courteous so filming them wasn’t necessary.

      I was in the DEA. One of our funniest joint operations with the Coast Guard was doing surveillance on a ship that was carrying cocaine into Baltimore via an attached pod under the water. We had tracked the vessel all the way from Columbia and were doing surveillance, waiting for the cartel to try and remove it. We had an undercover 43 foot Wellcraft Portofino, and we set up pretending to fish while we did surveillance. One of the crew was always a USCG member. One day, while the USCG guy is down below making a sandwich, I see a Coast Guard patrol boat heading our direction. I figure they are just going to pass by, but the next hating I know they have their blue lights on, and I hear over the speaker, "Go to the front of the boat." And, I can't figure out what they are talking about, so I yell back, "Why do you want us to go to the front of the boat." Next, I hear, "We will not ask you again. Go the the bow of the boat." Next thing I know, the USCG comes out of the hatch with his sandwich and asks "What's going on?" I said a Coast Guard boat is here and they keep telling us to go to the front of the boat. So our Coast Guard guy walks out onto the cockpit with his sandwich, walks over to the side, looks at the boat, and then yells, "Hey, John, why you want us to go the front of the boat""

    Hey guys, 1st time getting a chance to see ur video,
    But really guys, they wanted to check that bitch out too...
    It's looks like the same exact boat I designed on my paper, too see it on youtube was such a..."eye opener to me"..
    Anywaz the boat has the same design as the older military boats, of course they want to come on boat to look it over.. obviously they don't want to cause you any harm you don't want to cause them harm so it was just checking over have a good one guys enjoy your trip

      If you want to go toe to toe with federal officers of two different federal agencies be my guest. This is not local law enforcement that you see on the TV or the internet. Second, you're entering a customs boarding which means they can do and tell you anything they want. They can search anything they want without a warrant. I know USCG can do because I was part of USCG tactical teams. Third CBP, AS STATED IN THE INTRO TO THIS VIDEO STATES THEY CANNOT FILM INSPECTIONS.
      These guys did the exact right thing. They cooperated, gave no problems to these officers, and were sent on their way. I guarantee that if they gave them problems the inspection would be way in depth.

      On the open water before secondary… you have an argument to public space and having a camera rolling…
      Once you tie up to the USCG dock… you are technically in a secure federal facility… it could be argued that you don’t have a right to film there.

    You have a right on public waters to film the encounter. Even though the USCG is working under Title 14 USC § 89 (Revenue & Service) which allows them to override parts of the Fourth Amendment, telling you to turn off your camera falls under a violation of your First Amendment rights. You can not deny a boarding, verbal resistance is a $500 fine, while physical resistance is a $10k fine and possibly 10 years in prison. However, the Coast Guard is required to uphold the Constitution and blatant violations against US citizens by the Coast Guard will result in charges brought against them under the UCMJ.

    Personally I always outrun these guys n pretend I dont see them. I've been chased and they have always broken off when they see me going back over same places...but I have a question, when they boarded, why not keep the camera rolling, for your protection and for theirs. ....let's say they place something on your boat, planting something in order to confiscate your boat? We keep cameras rolling during traffic stops, these people are public officers, or are they KGB?
    Ok I posted hastily, I see others had the same comment, I just certainly wouldn't have turned off the camera, they don't trust me, I don't trust them, and they are here to serve me, not the other way around.

    I’ve been boating the east coast ( Md. to Florida ) for 52 years so I’ve been boarded 100’s of times and would’ve been 1000’s but I always have my annual Coast Guard inspection sticker on the windshield.
    The reason they don’t like being filmed is that many times they’ve boarded drug boats the GoPro was on a live feed to the king pins. The cartels then take their mugshot and threatens their families and worse.
    So if you don’t like it, sell your boat, move to Mexico, Bahamas, DR or any other smuggling country.
    For those of us that do the 1000’s of miles of ICW annually, we love the Coast Guard and the incredibly noble and highly dangerous job they volunteer for.
    What have you done for your country besides whine like a child
