    Thank you so much for this video and clear instructions. I followed the steps and my issue got resolved within 3 working days ! Timeline of events - I emailed AO and raised the grievances as you mentioned in the portal; within 2 days AO emailed me & asked me for details of my India stay for last 6 years (which I sent promptly). The very next day my issue was resolved. I am really grateful to you for helping me in this matter. A very Big Thank you !

      Why is the IT doing this? Whey did they make the NRI pan card inoperational all of a sudden?

      This was being signposted for several years and finally last July 2023 this was actioned. The bottom line by the Govt is - PAN must be linked with Aadhar. Why ? There are many people who have multiple PAN and they may game the tax systems. By linking with Aadhar, such ghost PAN card will become inoperative. While sorting this out, the NRI PAN got impacted as these PAN were tagged as Residents. If they were tagged as NRI, they won't have been impacted.

    Great video, as most of us - OCI holders are going thru this exact scenarios. I followed your video and done the same in the last week but with Diwali holidays, I was not expecting much. But My brother had updated on the website, emailed to his jurisdiction in September even raised the grievance and got some nonsensical response and the grievance was closed. I just happened to visit an old IT office to see if they could help and I found their new address. Visited the new address and viola, i had to get the reps to open my e-mails and ask them to change the status. For my brother, I had to find his jurisdiction and get them to update. This all happened yesterday afternoon.

      @@BanyanFA , Puneet Ji, After my last week's visit to te local IT jurisdiction, the message has changed from inoperative to "PAN is Active but details are not as per PAN." I am now wondering what am I supposed to do next ?

      This message comes when the name entered in the link is not same as per PAN. It often comes when PAN has Last Name & Then First Name, while you are entering your name as First Name & Then Last name. Try different combinations. Once you hit the right combination, you won't see an issue.

    Thank you and quite informative. Could you please help with this query? How does one change an existing active PAN status from Resident to NRI, especially when the PAN is already linked to the corresponding Resident Aadhaar?

      You can raise a Grievance via the exact same process and request the Assessing Officer to update your Resident status. Do upload your Overseas address proof for the Assessing Officer to confirm the data.

    This is a great video resource for NRIs. Thank you for making this step by step in detail.
    I’m stuck at the step of Submitting Grievances. After attaching a zip file (less than 10 MB), I click submit Grievance however it keeps loading for some time and then nothing happens. It does not give me a ticket no nor I can see my submissions in Submitted Grievances. Your kind help will be greatly appreciated as I can not move forward. Thank you so much.

      We are glad this is helpful. We also try to respond to any queries at the earliest.
      We have seen this challenge in the past. There could be an odd issue with one or more files in the zip. To identify, try uploading individual files and see if that file uploads. If it does, delete the file and try another one. Keep repeating till you find the odd one. For that odd file, instead of pdf / image, just take its screenshot and try uploading it. If it does, then zip all the files and upload it again. I think it should go through.

I received email confirmations few hours later about my grievance submissions going through so apparently even though it was showing loading, at the back end requests were submitted. Same thing happened with Rs. 1000 chalan payment from ITD website via bank acc/bank debit card/NEFT. Now waiting for their email responses.

    Yes I did all first raised grievance request then got Letter with fully relsoved letter then till it is inoperative

      Please keep raising Grievance. This is the only way to do it digitally. Else, you may need to visit your Assessing Officer as the last resort. You may see from the large number of comments that this worked for all of the viewers.

    Question: If an NRI has PAN and Aadhaar but only wants to change the status to NRI on PAN. Still wants to retain the Aadhaar and the linkage.
    Would an email to AO trigger a delinkage and deactivation of Aadhaar?

      As I understand, you can raise a Grievance to the AO requesting for tagging the PAN as NRI and post that you won't be required to mandatorily link Aadhar. Aadhar doesn't get deactivated post that.

    Thank you so much for the detailed video. I am an OCI holder and have been living outside India for 14 years. My PAN was issued even before that. I never had any account on e-filing before. The only bank account attached to my PAN has been closed long back so I cannot take the login via bank portal route.
    Please guide the best way ahead.

      You can try registering as a fresh user. If your account was never registered, the system will allow. The user id is PAN and follow the workflow.

    If I am not wrong changing residentails status to NRI in the profile section of ITR website changes the PAN card residentails status too ?

      We assumed that in the past but this doesn't work. This field is not used by Income Tax Dept to change NRI tag on your PAN. They have some other field outside the Profile which they manually update. We have learnt this through a hard way and hence please follow the steps in the Video to get this resolved for you.

    Very informative. Thanks for sharing. I live abroad. I have same issue, that my PAN has become inoperative. On website, for my AO office , it doesn't show AO's email, name or phone.
    I found only 2 of 3 options to submit my grievances 1. AO, 2. Systems issue. I files grievances as well sent an escalation email.
    If I send someone in person to IT office, will that help?

      After the PAN is active, the issue is now not of Income Tax Dept. There is a disconnect between the Tax Office and NSDL.
      You may raise another Grievance under an appropriate category and also followup with your Demat provider for a solution.

A couple of questions / clarifications 1) why do you suggest choosing "resident" under profile update, despite this being a process for NRIs who reside abroad? 2) I do not seem to find the NSDL department (Aadhar seeding) that you mention anymore - only DIT (systems), AO, CPC-ITR, CPC-TDS and e-filing. I have pursued grievance only with DIT and AO. Please let me know if I should be submitting grievance with any other departments as well. Once again, thank you for your help.

      @@BanyanFA the immediate first one. When we log in - the one you show is no longer there? And one does not seem to get the OTP in the US - as you predicted. So it is complicated to find the relevant AO.

      @@BanyanFA the problem seems to be the OTP is not received on a foreign (US) number. I succeeded with that finally - it was US day time - India night time. Maybe the load levels are lower?

    Puneet Can i use the HDFC NRO Account to do the login which you showed in the video , when I tried it gave me " other Error Click to Login to e-filing portal"

      You can use any bank account. Does not matter. The error could also be a bug in interface. You can try again later or with a different bank login if you have one.

      I think these days all banks have PAN linked to them. So you could use any bank

      @@BanyanFA I don't have PAN linked to any other NRI/NRE account in other banks and linked only with NRO in HDFC and that throws error and fails . Have to wait for my lazy AO to wake up and do the work its 15 months now and still waiting to hear from him.

      I think you can attempt to request for tagging your PAN to NRI and then it won't need a Adhaar linkage. Post that, you can work to get the name changed in PAN. There are clear instructions on income tax's website on how to update name in PAN

      NRI details are covered from 10:20 timeline onwards in this video. To get your KYC validated, you will need to submit Aadhaar card as address proof for India + Overseas address proof as mentioned in the video. These docs would need to be physically submitted in India.

      Thanks for your lovely feedback. You can follow the same grievance process and request your Assessing Officer to update resident status of your PAN. Please attach the same documents in your request.

    Great and helpful video. Only issue I am facing is uploading zip file which is under 1 mb and I get an error file not getting uploaded due to server error. It is usual to have server outage only for 2 servers back to back two days in a weekend or it is faced by everyone?

      I tried chrome and Safari on MAC and the upload continued to show server error. When I switched to work windows computer and tried with IE edge it worked file. Either it does not work from MAC or the file zipped from MAC but think I tested on PDF too on Mac. The error handling and the error messages are very generic. It does help to switch computer or browser - FYI

      The issue is an odd one. We got that a few times. Try avoiding zip and upload one file after another. You may spot one file would be creating an issue. Spot that one and try uploading it's screenshot or another pdf.

Reason of rejected my application is " according to itd data your citizenship is nonindian.But my citizenship is indian.I have adhaar also and i filed ITR last 12 years regularly.Now how can change my citizenship nonindian to indian in ITD Data.

      Best way is to follow the Grievance steps in the Video and log it. Attach your passport to show to the JAO that you are a Citizen of India.

      Thanks for following the steps in our video. If you will see the responses of other viewers, you will realise that for most this got resolved in a few weeks. I would say within a month, most of the cases get resolved.

    A NRI PAN has been made inoperative due to non-linkage of Aadhar. We have come to known regarding this matter on 21-07-2024. The due date of ITR is coming soon. Can we file the ITR even the PAN is inoperative and later send an application to the Income tax department or should we first make the PAN operative and later file the return. My concern is that even if i filed the application, the AO will take a lot of time to process the application and the return filing gets pending. What should i do now??

      You should ideally start the PAN conversion process right away.
      Try seeing if you can file the return. I would be surprised to see if the system would allow filing of tax return for inoperative PAN.

      It is not an automatic process. It is a workflow to submit your request. From here the request goes to your Assessing Officer for approval. It can take any where from one week to 6 weeks. Depends upon how responsive your Assessing Officer is.

      We have seen very rare situations like this as the AOs are mandated to resolve grievances raised through the portal. Your last bet is to visit in person or via a representative. In the mean time do consider to raise another one level grievance via the PMO office - CPGRAMs. Google it.

      While the PAN is not tagged as NRI, you will a ticker once you login to your tax website account stating that your PAN is inoperative. Once it is resolved, you will stop seeing the hover. You can also check the status by checking on this link

      Please do not leave your hope. They often take time. Even a month is at times possible. I am assuming that you have raised a Grievance ?If you still don't hear from then, please quote the grievance number and send an email to the escalation email id which I have provided in the video.

      Thanks for asking your Question. Your demat account has been inoperative perhaps because your PAN may be inoperative. Owing to an Inoperative PAN, they KYC gets on Hold. Please follow the steps in this Video to get your PAN operative and after that your Demat should become operative again.

      Unfortunately, I am not aware of any other way to login to the system. Last resort could be to apply for a Digital Signature Certificate and then try to reset. However, I haven't tried this option.

    I have one question. Will these work if NRI has a Aadhaar Card ? Since, In template it mentions that I do not possess Aadhaar Card. But, I being NRI, I also have an Aadhaar Card, but the issue is it's mobile no. is very old and not updated, which requires me to visit to India to get it done.

      I was reading the FAQs on Income Tax website and it doesn't say that if you are a NRI and if you have Aadhaar, then you must link them. I couldn't find a circular which states the same as well. All I could spot was - Mapping is optional for NRIs.
      In such a case you may want to modify the declaration to suit your background and then try. Once you are in India, you can fix your Aadhaar & then map it.

      If you are filing as NRI, it is likely that the PAN may be tagged as NRI. Active PAN does not always mean that it is tagged as NRI. If your Aadhaar is linked to PAN, it will be active.

      If your PAN is still active, it is likely that that it is linked to Aadhaar. I think you should be fine. But it is helpful to have same names in all your records.

      It is likely your PAN is now active. To check, you can click Verify Your PAN option. There are a few comments in this video where you will see this being discussed and answered.

      Point 1 - not really required. But Adhaar doesn't take that long. Pls track using the Adhaar enrollment document.
      Point 2 - It doesn't harm uploading your passport. But the key document is your Overseas Visa and address proof to give AO a comfort that you are a Non Resident.

    My issue is convert RI status to NR for PAN .ITO my profile tab is updated with Australian address. However, it does not send this info to NSDL who appear almighty custodian of PAN related information.
    I want to change my PAN card status from RI (PAN issued many years back) to NR in the NSDL database without changing the PAN card number.
    I visited TradeWorld A wing NSDL
    They sent me to TimesSquare Protean 10th floor for PAN related activity.
    Protean says I have to fill change reuest online
    I tried online form.
    if I say foreign citizen, it comes back with error - database status mismatch.
    if I say indian citizen, it wants adhar card detail.
    Being Australian citizen, I am not eligible to have Adhar card.
    in short, I am unable to progress this matter further.

      We have noted that OTP does come to overseas mobile numbers. We have tried in UAE, UK, US and Singapore. It may be an issue for that moment. Pls try after a few hours. Alternatively, if you can, you may use an Indian number.

      Thanks for your feedback. If you are back in India after a long time and are about to go back, it is likely you are still a Tax Non Resident. Irrespective, if you have an Aadhaar, you should link it to your PAN. If not, you may apply for one and link it.

      Hi, Yes definitely she can get her Aadhar linked to her PAN. For that first she would need to pay a fees of Rs. 1000. Then in a few hours, she can visit her income tax login page and link PAN with Aadhar. The process is same for NRI & Residents for linking of PAN & Aadhar.
      You can in parallel request her Jurisdiction Assessing officer to update NRI status on the PAN based upon the steps in this video.

But i am getting response from AO by closing the grievences with note saying that i need to furnish travel details of past 10 years and explain section 6 compliance. He already closed the grievances without me responding. How does this work back and forth on this queries? Open another greivances or directly respond to him. Any thoughts or experiences

      On your query - Yes, please raise another grievance uploading the required documents. It is strange that the AO is asking for that. For all our clients, this level of detail wasn't required. I don't see why he needs 10 years data when even just last one year data showing you as living abroad should be sufficient.
      Considering the effort, I would suggest to try once again raising a fresh Grievance & upload your overseas passport / address proof and see what the outcome is. Perhaps you may get a favourable outcome and could avoid the need to compile the 10 yr data.

    Thanks a lot for sharing such useful information. I have been struggling with Inoperative PAN for several months now. After following the steps mentioned in your video, I have now received an email from the AO in response to the Grievance stating that the citizenship status has been updated. However, looks like my PAN is still inoperative. In response to the DIT system's grievance, they are telling me to send the documents by post to an ITO ward for a change in citizenship! Is there usually a lead time between the change of citizenship and PAN becoming operative again? I am trying to understand if I just need to wait or take further action.

      Thank you for your feedback. I would suggest to reopen or raise the Grievance again to your AO asking them to change the residence of your PAN to Non Resident. It is critical to have the resident status changed. You can be a foreign citizen but still a Resident in India on your PAN.

    Hello Sir, My wife is US Citizen. She has got the Aadhar Card. We have applied for Instant E pan. By mistake her citizen got marked as Indian. When we received the pan card it was showing Red cross on the right dsc. When we checked the Residence category was filled in Indian. I have written an email to ITO for the Cancellation and Surrender of Pan Card.
    My question is what should i do:
    Should i follow the same process as u have mentioned in the video?
    Should Pan Card be surrender and to be made new?
    Or i can just change the Nationality by filling up the grievance?

      If you have applied for PAN as a resident, you would have already got your PAN Aadhaar Linked. You can validate if your PAN is active and valid by this link eportal.incometax.gov.in/iec/foservices/#/pre-login/verifyYourPAN
      The reason you may be seeing a red cross is perhaps DSC validation issue. Pls Google and you will find a way how to validate DSC. It is likely your PAN is active and operational.

    I filed grievance and AO replied there are no attachments !! I perfectly remember I DID attach one PDF file showing all proofs

      This happens at times. I would suggest to reapply. It should happen for you. You can see there are so many comments in this video where all got success.
      Do consider to share this video in your contact groups as there are many who aren't even aware of this issue.

    Thank you for this wonderful explanation for the process. Does this work even if the NRI is not having an OCI? Do all the NRIs have OCI?
    I’m not very clear about OCI.
    Will the copy of Visa work as an alternative?
    Can you please explain?

      Yes it should work. In that case you would need to provide their overseas Visa and a utility bill of their respective country to prove that the person is a Non Resident in India.

      I get your situation. I would suggest that instead of emailing the AO, now try just the grievance route via the portal. See for a few weeks and then report back here with your experience.

    Thanks for nicely explained process to re activate the pan. This IT officers are useing this as an opportunity to collect bribes to re activate it. They openly ask money stating if your refund need to be processed quickly they are asking 10-15% of the money you suppose to get back... such a shame on this IT department. They try to use every opportunity to make money...i don't know when we can see currupt free India

      It is sad to hear. Ideally you aren't required to visit them in person. If you are rightfully supposed to get refund, then any delay from your end is earning you interest.
      You should continue to raise grievance. If that is failing, your last resort should be raising a complaint on CPRAMS portal

      Here it gets a direct oversight from the PMO and a different team altogether.

      ​​@@BanyanFAthanks. Yes i am in the process of preparing for a complaints. Un believable they sent email saying your refund / assessment is completed. But since you have not linked your Aadharcard to Pan (i don't have Aadharcard as i am an OCI holder) we can't process your payment. Then my CA personally visited their office and give them official letter with all the required documents and get their stamp saying they received all documents.
      Next day they called my CA saying if this need to be processed you need to give me 1 lack bribe😮
      I just can not belive..😊. I told my CA nothing doing. Let us fight it out. So i am giving them 3 weeks time and then processing my complaints

    your suggesstions please, if the grievence has been resolved with this message "The resolution for your grievance application: Kindly file PANcorrection request along with passport at the Aaykar Seva Kendra Centre at Civic Centre, NewDelhi or send the documents through post at ITO Ward 72(1) New Delhi Room No.1207 E-2, BlockCivic Centre for further necessary action."

      Doesnt seem so. We have seen different Assessing Officers taking different route. Here the AOnis asking you to send the docs through post. I would suggest raise another grievance and in parallel submit the documents to The ITO Ward via registered post.

      You should definitely give it a shot to raise grievance again. If some one is coming to India, send the docs with them. Try what ever way it works. Not many AOs give you such a prescriptive response.

    If the govt gives the option to link your Pan card with your International phone number instead of Indian phone number then getting OTP very easily.

      Thats how it works. You can link your overseas mobile number and the OTP comes on overseas numbers.

      Once you login, you can go on your profile section (top right) and there you have an option to update your contact info. You will need to enter OTP to update your contacts.

    Why is India so backward technologically. They like to say they are a developedd country with highest growth and economic development but any online portal be it banking immigration or Income-tax is totally redundant and not at all user friendly.

      I appreciate the frustration. Isn't online banking in India one of the best considering the short tenure it has been vs Western counterparts. Also, most countries don't even offer online digital solutions for immigration & are even more painful. Re tax, I have seen massive positive change & yes more to go
