According to the section 33, the Court has power to grant compensation in favour of plaintiff along with decree of cancellation of instrument. Is it necessary that the plaintiff have to pray for compensation in his plaint??

For eg. A sells his property to B. A has no title to the property. C is the true owner of the property. So what is the apt remedy for C in this situation? A suit for cancellation of instrument under Section 31 or a declaratory suit under Section 34?

Here in sub sec 2 sec 33, plaintiff is incompetent and suing for the enforcement of specific performance of contract & defendant resists such by providing that contract is void or voidable
Then court requires te def to restore any benefit recieved by him u/ the contract

As 'his' in first line seems to be denoting defendant, and if defendant is minor/unsound(i.e.incompetent) , then as per your example of insurance. The insurer is defendant/unsound/minor/incompetent. And in last line thereby he or his denotes this defendant.

Minor is not competent to enter into valid contract but if he made contract by concealing his age and other party gave benifit to minor or to his estate then in this section if minor succeed to cancel his agreement then he has to returned so far as may be such benifit which were given him. Its my opinion brother.
