    Part of the criminal law is;1. To be afforded a chance to present your case. 2. Defend yourself. 3. Present evidence. Aright to an unbiased presiding officer. 4. Cross question witnesses. 5. A right to mitigate the sanction. 6. A right to appeal the outcome.

    Not a single person in this panel has said anything about Arthur Frazer. You would swear that President Jacob Zuma escaped prison and was later granted remission not to go back by Ramaphosa in order for JGZ to avoid finishing his sentence after the escape. President Zuma did not give himself medical parole. And parole does not mean "free from incarceration". All of this noise should be directed to Arthur Frazer and leave the old man alone!

    We cannot ignore the fact that former president Zuma was arrested *WITHOUT* *TRIAL* (simply put, he was sentenced to serve time in prison without being afforded an opportunity to legally defend himself)... Therefore his incarceration has always been unlawful.
    If as the citizens of this country, we do not take it upon ourselves to rectify this legal error, I am afraid it will soon come back to haunt us badly

Why he was convicted in the first place. 2. What processes were undertaken to grant him parole. 1.1. From now on,the order of the decorum in SA judiciary is for the presiding officer to completely decline to recuse themselves albeit such applications. It is fashionable currently. 2.2 Was he part of the body that granted him parole,and were correct proceedures and processes followed. If not,what are directives? This thing about Zuma being old and should be left to rest is all nonsensical because when he stole this country bankrupt he was also old and had to know that stealing many young children's future is also wrong and in fact treasonous. Zuma only cared about himself, family and friends. We need to see justice being done and all this B.S. about Zuma having served this country, served himself i would say.

    Manyi is being too stingy with the truth here. 1) Zuma submitted himself to a correctional facility of his choosing so he was not put into some cold part of KZN as punishment as he wants us to believe. 2) Parole is parole when legally obtained. So, Mr Zuma cannot be said to have served his term "on parole'' when that parole was illegal.

    • @mcminmpofu129
      @mcminmpofu129 ปีที่แล้ว +1

      He could have chosen any other prison of his liking, had they said they wanted him back.
      Secondly Why is it Zumas problem if the parole was illegal? Did he grant himself that parole? Is Parole not a form of punishment??
      I think it's you who is stingy with Facts

    • @buntumemela4261
      @buntumemela4261 ปีที่แล้ว

      You're still a child. This question of gaining/benefitting from an illegal act was answered by the constitutional court in the matter of Mr Nxasana who was illegally removed from office and in his place Mr Shaun Abrahams was appointed. This judgement was delivered on 13 August 2018.
      Mr Abrahams had nothing to do with the removal of Mr Nxasana from office but benefited from the creation of the vacancy he later filled. This is thae same as Mr Zuma having no hand in granting of the illegal parole but benefited in that it enabled him to move from prison to his home.
      In the Nxasana judgement, his removal was found to have been illegal and therefore the appointment of Abrahams illegal as a consequence. Abrahams was by operation of the law removed from office.
      This is no different then to the Zuma illegal parole. The parole was declared illegal by courts and therefore any time he spent on the said parole must never be counted as time served because of the illegality of the decision.
