    I feel badly for the pain that this mother is in, but the teachers aide who he was pummeling in the head while she laid unconscious on the floor damn near got a death sentence for telling him to stop playing with his Nintendo switch (she did not take it away from him) - she is very fortunate that they were multiple people to pull him off of her before he managed to kill her.
    Prison isn’t just about punishment, it’s also about the protection of the public. It is very clear that he cannot control his violent behavior - this was not the first time he was arrested, and he has since gotten into a fight in jail, because he attacked somebody who said he was going to prison.
    If anybody is really concerned about justice in this case, they might want to consider donating to the GoFundMe for the teachers aide who had been working two jobs to support her family, and now has a life altering brain injury due to his attack

    I recall when this attack occurred and it was horrifying to watch. He brutally attacked a female, small, petite teacher. She looked like a rag-doll; he continued to pummel and beat her, even when she was on the ground unconscious. That failure of a mother is trying to make her kid out to be the victim. If he was so bad off, e.g., extreme special needs, he ought to have been in a higher level facility who deals with his ilk. I had to stop watching this video. It is disgusting.

      I've worked in the schools my whole career and have seen this happen. Sometimes the schools, school psychologist have their hands tied by the state and the state board of education. They make the wacky rules up that sound great but have not a link of common sense in them.
      Mom probably didn't know she could fight their decision. She may have had to find different housing for him but I'm sure if she had pushed it by threatening to sue or take it to a higher court. It almost sounds like they were intimidating her. Whatever home district he or they reside in has to pay for his education. Whether it is bussing him to another school/district every day to one that was more appropriate.
      If I were Mom, I'd hire an attorney that specializes in special education rights.
      I feel bad for her, no one wants to believe their child is capable of this kind of act. Then again we weren't there, the para-educator could have been poking at him(not literally).

      I was a teacher before I was in a life altering accident at a summer camp where I worked. Trust me, things like this happen more that you’d think where parents hands are tied because a judge rules this or that based on “expert” advice. It’s really sad when parents lose rights over their own kids despite knowing what is best for them because the state decides to step in. And that’s wrong in cases like this where a parent isn’t a deadbeat and knows what the kid needs inside and out.
      So yeah, believe it. It happens to disabled adults and the elderly too. When the state steps in, families or the patient themselves (who may be fully able to speak for themselves) often lose the power to to what’s best. It’s horrible.

      This happens all the time. My mom had a student when she taught 3rd grade that was removed by the police in handcuffs. He was then admitted to a psych ward. He ripped the intercom off the wall that year, tore apart her classroom, threatened a pregnant special Ed teacher, threatened my mom, and so many other things. He was allowed in school for years and this kid's mom made excuses and claimed every year it was the teacher's fault. He was eventually put in a single room with a special teacher in a random building that wasn't even on campus because he was so dangerous. He was absolutely psychotic, but the school allowed him to attend because if not , parents can sue for discrimination. This particular kid was the way he was because his mom gave him zero consequences. My mom ended up retiring after that year because she had had enough of all the bullshit. It was the toughest year of teaching in almost 30 years.

      It’s worse… they didn’t take the game away from him (as news media is reporting)… they only warned him to change his behaviour or face the consequence of having the game taken away. So what does he do? He attacks Joan Naydich who had absolutely nothing to do with him being warned he could lose his Nintendo privileges (another teacher warned him). He beat the living shit out of a teachers aid who had nothing to do with the threat to remove his Nintendo. He was still in possession of his Nintendo when he tried to kill Mrs. Naydich.

      YES he can! It is sooooo irritating that his mother put out information about the school district - DAMNIG information, which makes it make sense why the school tried to hurry and change the woman’s job title….but the district put her on unpaid leave. Both teachers in that room TOTALLY disregarded the student’s IEP that was in writing. The question is WHY did they give him the electronic device knowing he had a written explosive disorder which warned never to give him a device in school? The city wouldn’t send him to a special school. He was placed in the general school population. He is autistic, has several mental health disorders AND is on 6 different medications for him to function. This is how flawed the education and mental health system is in America. The student should not go to jail, but he should be mandated to a facility where he can flourish he has NO understanding like people without autism coupled with mental health disorders.

    He doesn’t need to be out on the street. He’s too dangerous and he doesn’t even understand what he is doing. He needs to really be in a prison mental facility. He had probably issues before that the school didn’t kick him out. She had a black child in Florida. Schools can be accommodating until they become violent.

      Yeah it’s sad all around, but hey definitely needs separation from the general population seeing as how he’s almost a legal adult and he’s pretty much full grown. That guy has a problem dealing with authority, everyone gets their phone or mobile gaming device taken in school if you’re on it long enough, and especially during times that you aren’t really supposed to be on it. We’d play on em all the time for lunch n recess, but whip your phone or DS/Switch out too much during class don’t be surprised when it gets taken until the end of the day. A normal kid knows where he can and can’t push his luck with his devices at school, he should’ve just taken the L.
      But he couldn’t, and went full retard rage strength mode. I remember the video, it was honestly disgusting and hard to watch him just continue beating her after she was down knocked out. Those videos are always just the worst….makes me actually feel sick to my stomach. If this “kid” was given just a slap on the wrist for this he would’ve absolutely attacked someone again like this when crossed only slightly. Hell every man has the potential to act like he did, BUT there has to be a damn good life threatening reason, and even then no small woman deserves to be beat by a man like that, I don’t care if she murdered his entire family in front of em, once she’s knocked out the only proper moral sane thing to do is detain. He’s just a monster with a broken brain, the video showing him beat her after she’s unconscious proved that. It would’ve been one thing if he just hit her hard once knocking her out. That would’ve been bad enough, so I can see why the 30 year sentence is given out. I can also see why this mother who clearly adopted this kid and has been trying his whole adopted life to give him a normal life looks so distraught. She’ll wonder where it all went so wrong, I think it was allowing a large combative mentally handicapped full grown 17yo boy to be in a normal school with the general population. And what’s shocking is if they just put him in general population in prison, this kid should’ve been separated from everyone a long time ago. It’s why we have special needs teachers and classes in the first place.

There were absolutely signs that this was bound to happen with his prior history being very well known to those around em. When he got the size of a full grown man at 17 they should’ve made a choice to separate him, well a judge did it for em. Like I said, just sad all around. I feel like this could’ve been prevented if people cared enough prior to the attack.

I have a family member w/autism that broke a school toilet and when i went to pick him up he was calm. he was made to wear shorts by his mom on that hot summer day and didn't like shorts. the whole incident was a shock as this boy had never been destructive before or since. He should not have been in a public school, ever. This teen is a violent teen and will do this again and possibly kill someone next time. I guess we’ll see how he holds up in prison. 😒

    He is a big guy with physical strength of a big adult man, the teacher was a petite woman. She was thrown by his first assault and was laying down unresponsive, but he kept beating her in the HEAD repeatedly and then kicked, and he threat to k!Ll her when he was led away by the multiple adults. It was attempted murder even it was the result of super impulsive behavior came from his neuro divergence. If he was this impulsive and violent, it’s his parents responsibility to have some control over his behaviors, but they can’t and couldn’t, so what this mother wants? Does she knows what he did?

The mother says he "can't handle the school environment" and that she didn't think he should be in public school. Honestly, I'm 5' tall, 110 pounds, and if I were a special Ed teacher with kids who could overpower me, I'd keep a taser and/or meds that EMS can use. Perhaps they should just keep a big bodyguard on staff in those rooms.
      People, even teachers, have a right to not be assaulted at work. OSHA exists.

And if the school is not providing that for him you find other options. But she didn’t do that like she did in the past how she went from homeschooling him to him being in a full time care facility. And the only reason she took him out was because of Covid restrictions which I understand but the she needed to find something similar. Instead she’s blaming the hospital that he ended up in public school they probably stupidly recommended it but they did not force her to do that. Just as much as the school was neglecting his needs so was she because there’s no way this is the first they had issues with him not to this gravity but kids like this that need full time care always act out of control.

She can blame those places but she has to take blame as well. After all she’s a coach/therapist after I googled to see so that definitely changes my opinion but I also knew someone who had a kid young and they had Autism, not violet just learning difficulties and they tried years to get help and get into the right school and this isn’t even in America so I can’t imagine how harder it is over there. Unless you have money and unfortunately for kids like him. Nothing ever happens unless something like this happens and when it does it’s never in their best interest to help them mentally and get them help. But yeah she’ll definitely be wishing she did things differently now! If she couldn’t.

      @@Sarah-m17 I didn’t know about her being a coach/therapist which shows how even a person like her trained to develop skills to help people. she wasn’t even really helping her son. She says at some point in the interview about how the hospital he was at is the one that basically forced her somehow to put him public school. And when I heard that I was just shocked at how she was willing to blame everybody else for this to happen. I would be more understanding if she accepted the fact that she played a role as to why he was in that school in the first and that no one especially at the school probably could’ve prevented this from happening when they were just doing their job. But she makes it seem otherwise. I sympathize with parents who go above and beyond for their kids with any disability because I have no doubt that it’s endlessly difficult to find tools that will better their life. But because she and her son are facing the consequences for poor decision making from her end to the schools end she’s deflected to blame others and that not going to help her son. It’s just sad all around I feel sorry for him because he’s been neglected and I feel sorry for the teacher who was simply trying to do her job. I don’t think prison is the solution in specific situation because he doesn’t have the ability to understand what’s going on but he most definitely needs to be in facility that will take care of him.

    I was a teacher of special needs for about 20yrs. We had kids from one end of the spectrum to the other. We never had enough enough para-professional teachers in the class to begin with. The school always worried about the budget first. These classes are tough. And half the time the iep, never worked.

I feel bad for that child who hurt the teacher.I had broken my Achilles from trying to hold down a studentfrom running and destroying the room and hurting other kids in the class. It's a hard job. After my recovery, I came back on krutches and my foot with a boot. It came to the point I had to leave because our school principal was not helping me with the no other teachers. I had 12 students with 1 Para, wasn't enough. I quit and then sued my city.and won. The school system is awful.

    Here in the UK we have secure hospitals, they are prisons but function like a psychiatric hospital. This boy needs to be placed into somewhere like that. I think due to all his disabilities he should be given some diminished responsibility. He needs to learn that he did wrong yes but not in a mainstream prison setting. Nobody wins in a case like this.

    He needs a mental health facility. I read that his previous group home had to call in a crisis tram when taking away his switch. I would like to reiterate this is a teenager. Yes he has the build of a man but he is a teenager. 30 years in prison with autism is no place for a child with autism. He needs a specialty care facility for violent outburst. I hope thats what he gets instead of jail. Not saying he needs to get away with what he did , but jail is more harmful than helpful in this case.

    I seen the video and it’s shocking. How is there 8 or more teachers around and they just stand before doing anything? They just put there hands on his shoulder and let him still sit next to her while kicking her in the head. All of them and they let him get a few more punches and kicks in. No one seemed to be rushing. With the story and his disabilities I imagine no one wants to get in trouble or involved. Even she lost her job and she was the one attacked. I think Brendan needs to be put into a psychiatric hospital, it’s a prison one, we have them in the UK. I know America’s health care system is awful so I see no way this kid gets help. Prison wont help him at all. But as others said, it’s not a punishment it’s the safety of the public. He did this because she asked him to not play his Nintendo switch in class. She didn’t even take it! Even when she was unconscious after the first hit he was still hitting her and I do believe if no one came he wouldn’t have stopped, just kept going harder. He was enraged over that. So I definitely would not let him walk the streets. He needs professional help that he clearly never got throughout his life so it’s not on him completely. It’s the adults and the system. Sad case and there’s no win here.

      Schools are not required to have the facilities and services necessary, however they are not allowed to refuse to admit a child no matter the learning disability, even if the child could become violent (after they become violent is a different story). They can only suggest other schools to the parent that may be better equipped. So no, the school is not messed up, the responsibility falls direct on the parent and child.

    I worked a facility for the disable. We had twin brothers there that were 6’8 200+ lbs and severely autistic. One twin loved snacks, the other loved a point system. But you had to limit the snacks because he would just eat and not stop. We usually had guys watch over them because they could become dangerous if they got upset. However on this day I had to watch them and I am a very petite woman. Anyway I was trying to get them ready for therapy, and the one who liked snacks wanted one before he got on the bus. I told him I will give you one, once you get on the bus. He got mad and picked me up and threw me into the counter. I got back up, dusted myself off, he was crying because he had the mind of a two year old, so I had to redirect him. Eventually the twins were placed in an institution because of their angry outbursts. Even though they didn’t mean to hurt you, or didn’t understand what they were doing could lead to your death or serious bodily injury, it was best for them to be somewhere that could control them safely. That’s what he needs, I don’t think jail would be good for him, he needs to be in an institution for the rest of his life.

    What about a psychiatric facility. He can be detained, monitored and rehabilitated if possible. Regular prison seems cruel and unusal for someone lacking the mental and emotional capacity. Are there any other similar cases to draw precedent from? This will make a great law school debate.

    Oppositional Difiance Disorder is a polite way of saying a kid is a giant asshole.
    Reactive Explosive Disorder is a polite way of saying a kid zero ability to control themselves.
    And this "mother" is a huge reason why the kid acted like he did. How the hell can she not feel bad about the gameboy.
    She never said she felt sorry for the teacher.

    Oppositional Defiant “disorder” and Intermittent Explosive “disorder” is really someone who has sudden unwarranted, extreme anger control issues and is defiant towards authority figures. Calling that type of behavior a “disorder” to justify and excuse a person’s actions is ridiculous. Also there are many levels of Autism. I’m guessing the Mom has made excuses for his behavior his entire life, rarely holding him accountable (if at all) only adding fuel to the fire of his “disorders”

    I want to know why he was at a mainstream school and not in a special facility. I have great sympathy for special needs students and how hard the system is to navigate for families. But if they KNEW he had violent tendencies he needed to be with intense specialists who could handle him, not “regular” teachers at a “regular” school. The school absolutely has a major hand in letting it get this far.

    I feel for the mother....but this was not the first time he was violent...that teacher was almost beaten to death....there are a lot of people in prision ....their moms feel just as bad....but he is dangerous....i dont care what his diagnosis are....he shouldnt be on the street

You're clearly a genius when it comes to neurodevelopment and learning disabilities. How? Although I don't know why she didn't just take him out of the public school, screw the system.     I think what people aren’t realizing is authorities placed him into this public school against his mother’s wishes. He’s at level 6 autistic. I’m not blaming the teacher. At all. Whoever okayed the decision to take him out of homeschooling and put him into an environment unfit for his needs was wrong.
    He was diagnosed with Autism, ADHD, Oppositional Defiant Disorder (ODD), Intermittent Explosive Disorder, Mood Dysregulation Disorder, Post Traumatic Stress Disorder (PTSD), and Anxiety.
    The situation was a ticking time bomb. But putting someone with a 6yr old mental maturity into prison is not going to do them any good.
    🙏 well wishes to the teacher. What a horrifying experience.

    They have to call in a crisis team to remove a toy game from an older teenager? He’s a danger to society. He needs to be in a very controlled environment. Maybe he won’t take on the guys in prison like he did an innocent female teacher much smaller and older than he. Sad but it is what it is.

    I myself am on the autism spectrum. I thankfully fall under the high-functioning end of the spectrum and really only struggle with social cues and facial expressions since I was able to get the right therapy and medication regimen. I absolutely believe this young man must be punished. However, the prison environment is not the best. He needs a qualified criminal mental health facility where he can get the right drugs and treatment that he needs. All prison will do is lead him to kill other inmates or be killed by other inmates. Not every inmate is in jail for murder or assault. Some are there for things like tax evasion or financial crimes or something else nonviolent. He is a danger to them and to himself. I hope he gets the help he needs.

    I am sick of an IEP being used as an excuse for violent behavior. He almost killed the teacher's aide. I wonder if he had a record before this. Token economies don't work. It certainly would not have stopped what he did. And of course she blames the teacher! Typical. And why was she a "first year teacher?" Because teachers are fleeing the profession.

    My brother and all his mates are autistic and other spectrums, and not one of them has done this whenever there is an argument with their teachers.
    We treat my brother the same as anyone else and we do not use his autism as an excuse when he’s in the wrong.
