      Including the victim. I have been the victim in a DV case and I know it isn't easy; but still, you can't keep inviting them to attack you again.

      Actually, nobody, because that isn't a thing. They are meetings, not inpatient rehab. You don't "check in". You attend. I'm not sure the lawyer knows what an AA meeting is...

      @user-df7dc1gt5m The no contact probably ended when he was convicted at the request of the victim. They will often impose a no contact bond condition prior to conviction regardless of the victim's wishes in order to prevent witness intimidation, but that isn't an issue after conviction so if the victim wants to end the no contact they will usually respect that. The victim is an adult and is free to make their own bad decisions and who to have a relationship with.

    The defense attorney, "when he told me that he is going to be a father". He could have said, "when I knocked up the girl who I beat up". Our judicial system is a hot mess.

    That “good kid” is a balding adult man. First violation - revoke probation. I’m not impressed with: ‘this is his 4th violation - I COULD send him to jail for all 93 whole days’ - toothless threat. The number of chances are unending, and the punishment is insufficient. He beat his pregnant girlfriend. I hope he doesn’t beat the baby when he’s drunk and on drugs, because Lord knows “checking himself into an AA meeting” didn’t fix anything.

      @@Cheshyrgrin True enough, but there was nothing illegal about her disregarding Probation's recommendation and sending this criminal to jail for 90 days. Sounds like an excellent way to get clean to me.
      And as for the defense lawyer...bringing up his personal relationship with his client was out of line, and might have actually been a reason for recusing himself from defending him, IMHO.

      ​@Cheshyrgrin Was the prosecutor even there? In a lot of jurisdictions prosecutors don't attend these types of hearings, it between the Court, the defense, and probation. Regardless, nothing was stopping the Judge from giving the defendant the full time in jail other than her own feelings on the matter.

    I don't trust lawyers who try and make any argument for their clients on a personal level. It's unprofessional and, for me, unethical. His judgment is clouded. I also dislike the argument that someone 'comes from a good family'. Someone else's actions have absolutely nothing to do with anyone's own family members. Personal responsibility is extremely important. Not relying on the family name.

      Absolutely. His behaviour says far more about him than his family. The lawyer is ignoring the facts. He may have been a good kid, but he's not a good adult. Good adults don't beat their partners and then repeatedly violate their probation.

      @@RonaldRayGun0802 I'm not sure his advocacy made a lot of difference. I think the defendant having been to AA/NA meetings is what convinced her to throw him the very small bone of changing the 1 day in jail in the recommendation to 24 hours of community service.

    I shouldn't have looked at the comments first because now that I know she didn't send him to jail, I can't stomach to watch. Why act all tough and then not follow through? All it does is tell criminals that she doesn't really mean what she says. I usually like this judge, but this guy needed to go to jail.

    I think the defense attorney was too emotionally involved here. It sounds like he might have been doing the representation as a favor due to past connections potentially but the argument was charged and not in a good way. He needs to take a step back and make a controlled, restrained argument.

    What's really pathetic is they keep letting him out . Judges need to start being held accountable for the revolving door they created . No judge has to accept a plea deal that is the judges choice and only the judges choice .

      The problem is it costs the tax payer so much to house a criminal in jail. Judges prob only send the really bad criminals to prison bc there are limited "spots" and resources. TRUST I do not approve of this. I think the criminals should earn their keep by working. Chain gangs are a bit much but just shy of them, Im good with. We all should not be paying for "3 hots and a cot" free cable TV, work out and bulk up, socialize and their from their fellows cons how to be "better" criminals once they get out.

      Sorry, but there are a lot of problems with what you said. First, Judges are bound by the LAW and sentencing guidelines, that are instituted by the State legislature AND by voters, when they are put up as Ballot Measures, Referendums, etc.
      Yes, there are judges who use their discretion on sentencing, but to lump ALL judges in the same category, is irresponsible and irrelevant.
      You are right they don't have to accept plea deals, but when the offender(s) don't comply, like this guy, the judge's hands are tied when it comes to sentencing.

      Well he did go to NA and AA meetings and he has a sponsor so that's something.
      And the fact that he might lose his job was a factor that I think the Judge wisely took into account. BUT if he EVER touches his girlfriend, other than with love, EVER again, he should end up with a full load of a sentence.

      Judges know this. They also know the system is overflowing with cases and criminals and there is literally no room for more. If judges were stricter the system would collapse. Go to an arraignment day at court. It is chaos of case after case

    I think anyone who has a domestic abuse case/problem should have ZERO 2nd, 3, 4th chances especially if they were lucky enough in the 1st place to get probation….The victim doesn’t have a 2nd chance “NOT” to get abused. Where is the punishment?
    That’s why we have a huge domestic violence problem that’s not getting any better. And when did defense attorneys speak and support personally on clients behalf?

      @@purpleprose1315 yes. The National Coalition Against Domestic Violence's study says 1 in 3 women and 1 in 4 men have experienced DV. There numerous scholarly journals which contain data from national studies. Those tend to estimate 1 in 4 women are victims of DV. That is based on what actually gets reported. I'm not sure if you were really asking or not, but if so, those are good places to start.

      @@CapitalCityKate ty. Those numbers seem high to me. Did you watch the Kowalski vs JHACH trial where JHACH lost and has to pay over $200 million. My special needs 17 yr old son has prader-willi syndrome. Its one of the most complicated. Hes being tortured to death after 7 placements and countless admissions. All because two stupid social workers wanted to blame for things that exist do due a chromosomal abnormality. Prior to his kidnapping 18 months ago, he was never abused, didnt witness abuse, or no way was left alone with strangers. I do not trust the numbers.

    All this case showed me was that if you have really good representation that you can get probation and no jail time. This man beat a woman, violated his probation time and time again, and still did no jail time. The judge's rent seemed nice but resulted in nothing but yet another chance for this man child. So disappointing.

    That :"lawyer" needs to be sanctioned for obviously lying and supporting his client's criminal activity. He is trying to defend the undefendable.
    Counsel: "He only made *one mistake* and wants a second chance to do better."
    Court: "Absent, absent, absent, holiday, absent, absent, absent..."
    Sounds like he has had lots of second chances in a row to show he's penetent.

    Judge S is always personally invested in her cases which I usually find endearing. Not this time tho. Lawyer sounds like he's gonna cry which seems inappropriate. And he keeps calling the defendant a kid, as if to minimize his bad actions. Pretty screwy.

    The most telling thing is that the fella views the anger management and DV classes as punitive. If he was sincere about his epiphany he would understand they are there to help.

    One year of probation for a DV case? My abuser got three years initially, and a fourth tacked on when she broke a no-contact order and phoned me during the first three. And I still feel that's not enough, more than ten years later.
    Part of the problem is the initial sentence, not just his unwillingness to obey probation orders afterwards.

    The lawyer making the relationship with his client personal is an abysmal choice professionally, especially if the client repeatedly defies court orders.

    With all the court cases I've watched, all defendants facing jail time suddenly signs up for therapy and drug or alcohol meetings. 🤔I wonder why?

    Yet another judge that will not hold people accountable and lets people violate court orders over and over. She needs to be removed from the bench and sanctioned for her poor decisions. You do not want to hold people accountable to court orders, you do not deserve the priviledge of sitting on the bench. So sad for this county to have a judge like this. Victims should be discusted by this judge.

    He checked himself into NA & AA? They're meetings, not an inpatient program. This case is a prime example of why lawyers should never represent family and friends. The defense attorney is going to greatly regret representing and enabling his friend in future. The court, especially Judge Shackelford, will now see the DA as someone who supports abusers, who is completly biased, and who clearly cares more about his criminal friend and helping him get away with continual illegal behaviour, instead of upholding the law that he took an oath to uphold and protect.

      My Mum was also a teacher... Double the power behind THE look! The 'I'm disappointed' felt like it was double the power as well... Could be because I'm a softy, but yeah... Mum looked SUPER scary when in teacher mode! (Worked as a teacher for people who have learning needs and behaviour issues... during their teen years! So yeah, the look was powerful for a reason!).

    Sir, your childhood friend is a scofflaw, plain and simple... What is with all this leniency?? I don't get it when it's clear this poor excuse of a human being couldn't care less about the court's orders.🤦🏼‍♀ I still believe our judicial system needs to tighten it up. Make it sting - A LOT - the first time, especially if it involves any kind of violence, and maybe, just maybe, they'll think twice about doing something stupid again. This giving chance after chance after chance is ridiculous.

    I went to my 1st meeting in February of 1988. I have been homeless and penniless for over 12 years. I did not go to detox or rehab. I just acknowledged 36 years clean. I lived in a car and nearly starved to death. I have remained in recovery!!!

    I would hold his council responsible for ensuring he goes to his meetings. If he doesn't go, he goes to jail for the 93 days plus time served, and council gives up his bar license and gets 30 days in jail. Hold people accountable

    Definitely agree that lawyers shouldn’t defend friends or family. It provided room for bias and to be blinded by your friendship. It doesn’t do any good. You overlook what the person did and don’t see it as serious as it should be.

    I would offer the lawyer to endorse responsibility for his friend/client: Are you wiling to do the 93 days prison personally if he violates his probation again?

    "I know this kid personally." No, he's NOT a kid. The fact that you grew up with him and played football with him should tell you that. And to tell a judge that you expect them to "cut me off and scream at me" is the very definition of contempt of court. That old fool-for-a-lawyer line should extend to being represented by playground buddies as well as self representation.

    If I were the judge I would have dressed this lawyer down on the record for his ridiculous attempt at representing this clown. It's completely inappropriate if you ask me. Then I'd have revoked his probation and sent him straight to jail.

    That defence attorney’s use of emotional manipulation in his attempt to get his “childhood buddy… a great kid” (don’t think of him as a grown-ass man, your honour - I might be in my late-20s & already balding, but he’s just a likeable little fella who made a mistake! Look! His family LOVES him! 🤮) off the hook for his ongoing CRIMINAL behaviour, is exceptionally unprofessional. If that lawyer can’t manage to separate his emotions from his work, he doesn’t have any business in a courtroom. And let’s never have to hear about “women’s emotions” getting in the way of their work again - in my professional experience, they’re almost ALWAYS the most calm, collected, well-prepared people in any meeting room.
