- A BBC Newsnight investigation has uncovered an immigration scam where pregnant migrant women pay British men up to £10,000 to pose as the father and put their name on the child's birth certificate.
The child can then automatically get UK citizenship and the mother has a route to residency.
Scammers are using Facebook to tout for business and claim to have helped thousands of women in this way. Facebook says such content is banned by its rules.
A researcher went undercover, posing as a pregnant woman who was in the UK illegally, and spoke to people offering these services.
Divya Talwar reports.

As a British Citizen with a wife and step daughter from a foreign country this really pisses me off. I have a genuine family, but it is virtually impossible for my wife and step daughter to be given a visa. We have been together for 7 years, lived together for 5 years and married for over a year, and even with all the evidence to prove that we are a genuine loving family, not a scam, it is so difficult for them to get a visa. It really makes me angry that maybe I will never be able to return to the UK to live because people take advantage and abuse the visa system

As a person who played by the rules, worked hard and contributed to British society to earn my citizenship, I do care about this issue only because laws are disrespected and system gamed by this, not because of "fairness". Whoever makes a mockery out of British laws should face justice. I wish they could follow paper trail and verify these "dads" somehow, then revoke their citizenship for literally prostituting it.

In the US if you bring someone in this way or through marriage, I believe you are financially on the hook for this person for at least 10 years. That would be a deterrent for British men looking to make $10,000. Also, adding the requirement of a paternity test, as others have stated, would also present an issue. It is strange that people in comments sections can come up with solutions, but governments can't. But in the US we've had issues with people coming here pregnant to give birth here in order to get birthright citizenship, which is also a problem. They do this so the baby then can claim US citizenship through birthright.
Let the baby stay and send the parents back 🤷🏻♂️. I don’t even agree with anchor babies, but maybe that will stop them.
The couple has to be legally married in the US and after that it takes years for spouse to get a visa in America. With his name on the birth certificate the father in financially responsible for them for 18 years or until they finish college. Child support is automatically deducted from their paycheck via legal means!

And of those that do get it, it's frequently not nearly enough. All the data points to that it's much easier to shirk your child support responsibilities than it is to receive help as a single parent.
The dad is going to lose more when the baby hits him up for child support and inheritance.
DNA test will prove otherwise
Passports should only be given for biological fathers and only after the baby is born and a DNA test done. A tenporary/revokable permit can be given until she delivers and the DNA test confirms the guy is the father.
What about adoption?

I think they should not only do a DNA test, they should also attach details to an identification like NI number of the dad using biometrics and should be verified each time a process like this is initiated.
They could do DNA testing on the fetus. If a scam is found, the mother needs to be deported prior to the birth or immediately afterward (with no British passport for the baby) and the fake dad needs to go to jail.

Imagine the UK immigration office actually doing their job properly. Honestly, getting into the UK and getting a British passport is as easy as getting a pizza.
I’m surprised that it is that easy. I’m American, and my wife isn’t. We live in France, and when our son was born we weren’t married yet. I had to provide a lot of documents and we had to be interviewed at the US embassy before they would issue my son’s passport. It would be pretty difficult to do that and convince them if you weren’t really a couple/it wasn’t really your child. I’m surprised that some similar process doesn’t exist in the UK.
Because in the UK, we have strict border controls already as well... and yes, babies application are checked. We control who enters to begin with... or rather, should. And when they apply for the passport for the child... Well... the parent's backgrounds are scrutinised and checked too. By getting the passport.... a British passport.. It means that, the child.. belongs to the King of Britain. People do not realise what a passport means.
These so called "immigration lawyers" are not formal lawyers, than they are actual administrators, trying to beg for forgiveness on behalf of the child... Only because we live in a democracy. If the King abolished the parliament tomorrow... Then the laws are a lot more clearer and explicit ? Those so called "lawyers" are not really lawyers in the sense that, they deal with the issue... What they are doing, is to "negotiate"... and the final say.. can be that, the State can indeed refuse.

They are here as well. This is obviously something they haven't thought about. The woman could easily contact CSA, and demand the father named on the birth certificate provide financial assistance. This means any money they made from breaking the law ,would be paid back in Child support payments. Karma does find a way 😂

Maybe the mother will get in big trouble too, because she got the visa by saying the baby has a British father... Just goes to show that if a person genuinely falls in love with someone from another, it's a painstaking process for the other person to get a visa in the UK. Then you have people like this that flout the broken system, just by paying someone money and saying that they are the father.

DNA proof should be a prerequisite. Prior to any visas being issued. People who have gained visas in the past should be asked to provide DNA proof and where proven false, the visa/passport revoked.

I find this very hard to believe giving the questioning by immigration officials. A friend translated yesterday for someone in a genuine case where she was the mother of a child and has been with the father for a number of years. She had to describe all sorts of things from different angles, answering the same question over and over again, such as how their flat was laid out, there are questions about the partner's body and preferences. This scam seems so full of holes. However the biggest one is this. A man might get GBP9k for 'fathering' a child which looks nothing like them but a DNA test would presumably show the truth. But what if that is not done, and some time down the road he gets hit with a patrimony claim and has to pay for the upkeep of 'his' child? He can scarcely then claim the child is not his!

At what point did they say they were reciving benefits. This people are here illegally so can't claim any. Most of them just want to work but need the papers to do so.

In the US the father's name on the birth certificate is LEGALLY & FINANCIALLY RESPONSIBLE FOR THE CHILD FOR 18 YEARS OR UNTIL THE CHILD FINISHES COLLEGE. The employer is legally obligated to cooperate with the court to supply paycheck information then the child support is automatically sent to the mother's account. The father also has to pay for their health and dental insurance. They are forced to go to court , if they deny that it is their child they have DNA testing.
In the UK the father would have to pay a percentage of his salary to the mother if she's the main care giver.

I was sitting here confused because I thought UK citizenship was like America where all you had to do was give birth on American soil no matter who the parents were. Sounds like you all had a better system, aside from the whole scammer thing. Personally, I think paternity tests should be mandatory for all births (in which a father is stated).
The US is rather unique in regards to citizenship rights for anyone born on US soil.
It’s garenteed by the 14th amendment, and would require constitutional amendment to change the rule.

I'm an American expat in Europe. I once had a non-Muslim Iranian family offer me Euro 50K to marry a family relative on her visit to this country. NO WAY! The mother of the current Secretary of State for Business and Energy, Kemi Badenoch, herself travelled to the UK in order to give birth. The law at the time meant that Kemi was "British" by birth.

This is happening in Germany too. I personally know an individual who is in the process of paying for a German dad for her baby. She’s barely 3 months pregnant

I'd take a guess and assume that most of these desperate migrants come from the poorest regions of their home countries. This isn't the only way. Some risk their lives being smuggled from truck to truck. Some enter marriages in foreign countries in exchange for allowances to be sent to their families. Folks are so quick to demonize migrants but probably couldn't last a week in their situations back home.

DNA tests should be mandatory at birth for all children in the UK.
Paternity fraud is not just about immigrants. It also happens to average men. A woman can put any man's name on a birth certificate. If she's willing to lie, that fellow can end up paying child support for the child of a woman he's never met if he doesn't fight in court. And she'll get legal aid, he won't.
Except, can't trust the government to maintain a DNA database. You know that would be misused or broken into.

That $50 buys the father 100% knowledge that he is the father, saves thousands in potential legal fees and child support.

One way to discourage this is if caught, deport the participants or if unable, jail them for a long, long time.
10K seems to be a going rate when getting a citizenship. It's the same in the US as well. Women or men paying a man or woman to marry them to obtain citizenship. The crazy thing is some are doing this by getting to the US via Canada. It's much easier for Canadian residency than US.

That wouldn't make much sense on the mother's part. The "father" can easily ask for a DNA test and not pay one cent in child support.
I am Vietnamese living in Canada. 10 years ago I was asked to look for a single woman who agrees to a fake marriage bringing a Vietnamese police captain to Canada. The price the man is willing to pay is $80,000 plus a promise of a big bonus if he gets a sponsor visa.

Not so. In the UK if a child was born in here regardless of the parents being born outside the UK the child got automatic rights and were classed as British at birth.

10k is not a lot of money for a British passport and all that comes with it.

This is just the sympton of a larger problem. The real problem is that we let everyone in so easily and then hand out largesse to them. We hand out money to everyone.

No, what you described is just another symptom of the problem. The large problem is the lack of developing poor countries into thriving ones and being able to trade equally. It's fuelled by greed and capitalism, by paying them dirt cheap for their labour in the Far East and other poor regions, whilst making massive profits selling products in the West. The exception is China, where they have poured a huge amount into developing their country and developed way quicker, pushing out the competition of other poor countries in the region with their size and ability, meaning less business and jobs for countries like Vietnam. And countries in Africa just don't even have the infrastructure like China. Plus, there's the instability caused by wars, the one by Russia obviously, but also many by Western powers like Iraq, Afghanistan, Arab Spring and etc. These are the reasons why people from improvised nations are making a mass exodus towards wealthy Western nations.

@@SA-ff9uc Which is why there are a lot of Chinese illegal immigrants too. Business is booming but the workers are paid dirt cheap. At the same time, they have the largest production and manufacturing capabilities in the Far East, and they get way more business than other countries in the region. The workers don't get to share these profits. There's also a shift with China becoming less factory based and more developed. Reasons why the factory sector is declining but at a very slow rate.
By Western standards, Vietnam is less developed and has a much lower standard of life, which is why so many Vietnamese are trying to get into the UK.

Immigrants with a British passport should not automatically have the right to bring their families or others to the UK even if they are pregnant. Babies of foreigners born in the UK should not automatically be given UK citizenship. It's madness.

Uk border control and the Uk passport office need shutting down and starting again. The problem with both organisations is they have been completely overrun by recent migrants 1st or 2nd generation and thorough checks are not being carried out.

@@dewantoroo It's not equally spread out, main assets are in 3 big cities while life outside are generally poor. Also there're jobs like nail shop in UK and EU market considered easy with high income compare to theirs in original country, a lot better than working in the field under hot summer days in Vietnam
