why is the example in 36:38 considered mistake and therefore voidable? couldnt it be argued that there is no mistake since the buyer knew the doubt, contingency or risk affecting the object of the contract pursuant to Art. 1333 and evidenced by the word "think"? imo thinking that the watch is genuine is drastically different from saying that it is genuine therefore there is some level of risk assumed by the buyer in this case.
I think he was talking about Art. 1343: misrepresentation made in good faith is not fraudulent but may constitute error or mistake. But base on the example, your arguement seems more correct to me. Thanks for pointing this out, i'm here studying for finals.
