New Florida law gives more parental rights to unmarried biological fathers

  • A bill that passed the Florida House and Senate unanimously, coined "The Good Dad Act" is now signed into law. The focus - father's rights.
    Last month, the ABC Action News I-Team shared the story of Ulysess Carwise, a Tampa father who has been fighting for custody of his now 5-year-old daughter, given up for adoption at birth by her mother without Carwise's knowledge or consent.
    His ongoing case highlights an often private battle unmarried fathers can face.

      Agree 100%, but this is not nearly enough. There are some changes in legislation that are URGENTLY needed:
      1. Upgrade adultery laws to punish the woman who cheats on her husband because she "felt lonely" or similar idiocies, specially if her husband is out working to provide for her.
      2. Change the DIVORCE laws that only favor women who seek to dissolve their marriage without a real cause.
      3. Severely punish SLANDER, LIBEL and DEFAMATION so that wives stop destroying a man's life and reputation without consequences.

    This is insane, she can just give the kid up for adoption or wipe her hands with it in some way and the courts will not go after her for child support oh but if a man does that there will be no mercy for him. Absolutely beyond evil and unfair.

    Took me 3 years to get my rights in the court system. This is a huge step forward for Fathers in Florida.

      its not enough. the govt has placed the burden of a welfare program on a certain type of citizen (higher income earning parents) and milks them for as much as they can, while judges get some of that money put in their retirement funds, attorney generals stop ex's from deciding they can live without child support help, all while they financially incentivize breaking up families. Child Support is not in the best interest of the child anymore, its money for the state

      It's not the woman who was heartless. She probably really thought that giving the child up for adoption was the best thing to do. But it isn't fair that the law did not allow for the father to have the right to get the child first or at least agree to the child being adopted away.

      If you see the growing army of fatherless thugs destroying this country I think this is an excellent law. We need to stop giving gays and blacks whole months to worship. Start giving fathers more praise and support. Particularly in the community shown in this video.

      Many of these laws were probably written in a time when most people were married before having children. Now most people are having children out of wedlock so the laws need to be updated for the new culture.

    They should extend it further: if the man is better off financially and fully capable of rearing the child, then he gets custody. The parent that is better equipped to raise the child (has a career, but also the main parent responsible for the child's well-being if not) gets the most custody. Basically, if the parent is more well-aware of the child's doctors and teachers and is the one who raises the child and spends the most time with the child, they get the kid. This has to be a long term thing, because the parent also gets more legal responsibility placed on them for this. Might want to find ways to prevent psychopaths and narcissists from getting the children. Also, get all sorts of legal complications and problems for people like that mother who threw her child into the orphanage when the kid clearly had a fully capable father.

      They already do that! However, 90% of custody cases are settled out of court and MOST fathers agree the mother should have primary custody

    I was literally in contact with the very liberal ACLU and other constitutional lawyers about this! I am on the Official BC and have been a part of my daughter's life since she was born. My Ex cheated and we broke up 2 years ago because of that. I maintained a civil relationship with her until she moved my daughter to Texas without telling me. Her claim.... I'm her mom and you don't have paternity rights. $8000 later I finally do and I'm fighting for my kid.

    So, maybe its different in Florida- up here on the east coast not needed. Some dads are smart and some are dumb- you go to family court, establish paternity and get custody and partial custody order as well as child support set up. Now if you don't do that yes, she could leave and go to another state, but with paternity and visitation set up she can't just leave. So why do you need another law if you already went to court and established your parental rights- or maybe stop acting like little boys and girls, stop sleeping with someone you are committed to marry. Children deserve a stable family, mother and father, married who act like adults instead of adults who live like teens sleeping with someone the don't intend to marry. that's why our youth are so screwed up, because of the parents. Act like adults, marry the person your sleeping with and you don't need laws like this, but since that will never happen we will always need a law like this because people are to lazy to marry first or atleast act like an adult and got to court and establish your parental rights.

      In Florida, you can have a couple together but not married for years, have a child and then they separate, dads on birth certificate, pays child support, but mom still has full parental custody. The father has to fork out attorney money to go before a judge to get visitation. Where the mom doesn’t have to. My husband of 10 years has a son before us that he’s never once been late on support and not once allowed to stay the night at our house. And he’s 13 now. Nuts.

    I’m not going to lie , this gives me so much hope. My sons mother took my son out of state and moved him into another household with another man whom I’ve never met with his kids. I have idea where my son is and the state is not helping at all. Hopefully I can find some justice to be able to be father to my son.

    Happened to me 3 years ago, we lived in Miami, and his mom took our son and moved to Orlando. 3 Years later, he just move in with me for majority of the time because he was begging mom that he wanted to live with me.

    Amazing how the system wants fathers to become private investigators but when the system wants child support they miraculously can use the Attorney General and all of the US agencies to locate a father. This demonstrates the government is more concerned about money and not a child's best interest.

    This is required in Florida regardless of birth certificate or acknowledgment of paternity!
    I'm going thru this now!!! He's is refering to a parenting plan, but first she must get served!!!
