Yes, I believe that HOAs do have too much power. Same for condo boards. My cousin was prohibited from planting a vegetable garden, but not prohibited from planting flowers or any other non-edible plants. My condo board mandated that my curtains be of a certain color within their "pallet" of colors. Even the color, or shade, of glazing in our windows were controlled by them.

The HOA are the management companies working for the landlord owners of the land who subdivided it so that they could rent the land. A double whammy - buy land - force the renter to pay for your building on your land that you then rent to them and control and can boot them off for Pennie’s on your mighty greedy dollar. have a relative who lives in HOA, and when she fell and broke her arm they tried to fine her for leaving trashcan out too long. She's elderly and it was winter in the Northern states, and she lives alone. She always helps her neighbors, some who are younger than 40, but no one was there for her and the HOA local board didnt even step up to help. They need to add a clause/rule that they assist a neighbor in time of need like that. it was ridiculous. It also says a lot about where we are as a society.
If you are on top of your mortgage or your house is paid off… no one should be able to move from your house, now you’ve been the government with property taxes… Because of that point do you actually own your land and your home if someone can take it from you? Especially HOAs… these associations should not be able to take your home just because you didn’t pay fees or special assessments and they definitely shouldn’t be able to fine you for not cutting your grass or leaving your trash cans out a day too late… seriously people… things happen and maybe we need to just chill out a bit… If someone doesn’t pay their dues, then they shouldn’t be allowed at the pool and other community-based and accommodations … but if you don’t have any of those, why the heck are you paying for this?
Unfortunately, I live in an HOA. They are hard to avoid where I live. My neighbor parked in front of my house for a few nights. I got a letter about it. Told HOA it wasn't our car or belonged to anyone associated with our house and asked violation removed from our account. HOA asked whose car it was. Told them I didn't know and asked again if violation had been removed? They said, "We do not have the plate run back yet but have resolved the violation." They can run plates?! Looking forward to moving.
What's wrong with that? It was a potentially abandoned car in front of your property which you were just ignoring. Somebody has to deal with it if you won't.
I can see these operations going by the wayside…nobody needs an HOA. Why live under the guise of those who may have a personal agenda that will do damage to your life? Doesn’t make sense at all. How much does it really cost to live in these conditions?

I lived in A non-HOA community in St Pete. Some of problems you talk about in terms of junk cars, parking on lawns, boats in the street were managed by city codes. The code enforcement in St Pete is pretty rigorous. No HOA mafia needed.

1) Property Taxes, HOA Fees, Condo Fees, Overpriced homes, are making hard working taxpayers lose their only property (Home, Condo). How can it be legal to suddenly raise Condo fees and HOA fees by 40+%. 2) How can these crooked tax assessors be allowed to overvalue someone's only home by hundreds of thousands of dollars, when they are not investors and those homes are their only child hood homes. Many areas are becoming like Detroit and Mississippi - desolate and empty as the working voting taxpayer is continuously fleeced. The vile municipality tax assessors are getting multi-year promotions using Tax Payer dollars because these tax assessors ARE Overvaluing people's properties to bring in money to the municipalities. They don't care that people end up homeless (many veterans and elderly affected) or their home comes into foreclosure because they had to borrow against equity and credit cards to try and pay their property taxes or HOA or Condo fees. Just shameful an HOA can put a lien on someone's home for as low as $100.00! Where are all the State representatives to put a stop to this madness?
Our neighborhood never had an HOA, but years ago people from strong HOA neighborhoods moved into our neighborhood, and have tried and tried to create a HOA. We all told them, “if you liked the HOA so much, why the heck didn’t you just stay where you were?” They replied, “We moved here for the bigger yards” 🙄

When I moved to Florida in 2014 I was told by people in the know to buy a home outside of an HOA community. Here they call it Deed Restricted. I can skip cutting my grass for a week without fear of losing my home
My first home was in an HOA-managed community. I bought the last unit available in that community, and I had no idea the problems I would have with the HOA. The woman ... one of my neighbors, had been in the position of president of that HOA and boy, was she ever a real PRIMADONNA! You could call her the "Central Scrutinizer". The problem wasn't the HOA rules, ... it was how she interpreted them and applied them. She ticked off a lot of people, but I couldn't understand how she kept on getting re-elected. Some of my neighbors suggested that I run for the position, so I did. I didn't get enough votes for the president's position, but I did for the Vice-president's position. Apparently, not many people got involved with electing people for the HOA, and didn't attend the meetings. They did however, find the time to complain. I was able to shackle this president somewhat and keep her within acceptable constraints. It was a very nice property and it was being kept up. I could only image how bad it would have been living in a community without an HOA. I think that the bottom line is homeowners in HOA communities MUST be involved with the HOA voting process and come to the HOA meetings where they can voice their opinions and disagreements. Some governmental oversight seems like plain common sense.
Same here. I live in an area with no HOA and I can paint my house pink with purple pokadots if I want to and no one can do anything about it. (Don't worry, it's actually a dark green with white trim and I've had neighbors tell me that they think is looks great, but you get the point.) When you pay so much for a house it's really galling when others tell you how they think it should be. It's none of their business; unless you live in an HOA, which is why I never want to live in one.
Judicial process should apply to all owners, not just the military. No HOA should be allowed to sell your house from under your feet without due legal process.

There's absolutely no need for them. I live in a very nice, quiet, and clean neighborhood with no HOA. Everyone takes care of their property and they don't need anyone bossing them around to do so. We enjoy our vegetable garden and if we go on vacation for 2 weeks and the grass gets overgrown it's not a problem because we get to it straight away when we return. That's how everyone is around here. Like minded people will find each other. Find neighborhoods where people take pride in ownership and their neighborhood and everyone governs themselves correctly. Maybe if a slob does move into the neighborhood the other neighbors can gather to see if there's anything they can do to help maintain their space, volunteer to mow or help fix the fence. Sometimes people fall on hard times and genuinely don't have the means whether it's money or manpower to get things done. They may be too ashamed to ask for help. If we took care of ourselves AND watch out for each other when needed HOAs would be deemed completely unnecessary. There are plenty of neighborhoods like mine that are well managed by the people themselves and not some board members. HOAs are for the paranoid...with extra money to blow.

It is illegal to file a UCC1 Lien against someone’s name and property unless there is an actual bonafide crime. Commercial infractions are not actual crimes. They are civil in nature not criminal. Sue the HOA. Also, if a HOA starts contracting you for a presumed debt, do NOT ignore them. Return a reply using certified mail within 21 days and dispute their claim and force them to prove their claim. If they fail to prove their claim in writing and in affidavit form under penalty of perjury. If they fail to prove their claim then there is no claim at all.
HOA’s should not exist. Home owners are not children that need to be monitored and kept in check. I don’t live in an HOA, but if a neighbor doesn’t cut their grass, or keep their property in shape, we just call the city. The city cleans up and adds that cleanup fee to their property tax. Of course warnings are given prior.

I live in a 55+ community HOA in PA and the new rules keep coming. Very discouraging !! My mom lived in one where you could put up white xmas lights only, and have white backed curtains only. Many other ridiculous rules to mention. HOA's shouldn't exist at all, that's why we have city ordinances.

Years ago, before indoor air conditioners my HOA didn’t allow window air conditioners! The air conditioning wasn’t strong enough to cool the bonus room over the garage. Even when proof of the high temperature was presented to the HOA, they didn’t allow the air conditioners. This made the rooms unusable in the summer. Eventually, I sold the house.
Homeowners Associations (HOA) were originally called Protective Covenants in the early part of the 20th century and their purpose was to enforce racist Jim Crow segregation laws. So if you had a housing development and you wanted to make sure that no blacks, no Jews, no Mexicans etc. moved into your area the Protective Covenants were there to keep specific groups out. Over time sensibilities changed (a little) but the power of these extra government organizations did not. They are governments within governments which you agree to when sign those papers to buy that house. No house is worth living under control of people like this; you're essentially renters with none of the protections of renters but with all the financial liability. That's who these people are, just don't do it.
I work for a company that does the accounting for HOA's. One case caught my eye. A homeowner with past dues totaling 9k+. They tagged on another 9k charge just from lawyers fees.
Why don't more people organize themselves and disband these HOAs or at least stop them from raising fees every year? I just saw a single family property with an HOA fee of $200 per month. What on earth is all that money for?

The breakdown is in the approved budget. Reserves, common area expenses like water, sewer electricity yard work, snow plows, legal fees, cleaning, etc.

I've lived in an HOA home for the past 13 years. Not one fine or warning in those years. What you spew are outliners exceptions, not the rule. I would guess that over 95% of the people living in an HOA community have never faced a fine. The ones that actually end up getting kicked out, if you look at what they did, you would more likely than not, side with the HOA.
I echo the poster above. We have lived in a detached condo for 18 years. No fees or warnings etc in that time. Most of our neighbors have been here for the same amount of time (or longer) and love it here. If any of us want to change a bylaw, we would vote to do so. We are the ones who agree to the bylaws and the management company (that we hire) enforces them. And 99% of HOA will not foreclose on your condo unless you were severely behind on dues and have not been in contact with them. One homeowner in our development was a year behind on their condo fee that was $350 a month at the time. The management company sent certified letters, emails, phone calls and eventually took him to court to place a lien on the property. They didn't foreclose on him. Instead, he would pay the lien when he eventually sold the house. I don't think that is unreasonable. Try not paying rent for a couple months and see what happens.
States should have never passed laws allowing HOAs to force a foreclosure on home owners over past due fees and fines. They should have allowed liens to be filed that would have to be paid off when a home is sold. HOAs also should not be allowed to charge excessive interest on past due amounts.
I would rather live next to a junk pile in the yard, than live in an HOA. The junk pile might be an eyesore, but it doesn't tell me what I can do with my own property, or fine me, or try and evict me.

Agree. People move into Hoa because it’s a beautiful neighborhood then decide they don’t want to follow the rules. Hoa is a choice, no one forced to live there. Go live next to the neighbor that doesn’t paint their house and parks in their yard.

My HOA didn't even follow their own rules when I forgot to pay, they supposed to inform me in writing, before taking legal action, they went straight to legal, as soon as the grace period was passed.
Its not the law, it's the Judges that's the problem and eventually there will be boycotting because no corporations should be allowed to own all of peoples places to live and have a monopoly on home ownership. Americans have a right to own their own homes.

What I realized is owning a home in America is a hoax. You can own the house and lose it for failure to pay property taxes, Squatter rights, and HOA fees and penalties. In the end after all the money you put into the home you don't actually own it.
Here in San Ramon, CA, HOA keeps sending notices to repaint the house or gate or fix the roof. But they ignore Redwood trees leaves visibly accumulating on our roof causing nest habitat for geese and also potential fire hazard. The trees belong to them and keeps on ignoring them because it’s their expense not mine.
If my home can be taken away from me if I don't pay my mortgage or property taxes if I fall on hard times then why would I want to add one more thing to my monthly liabilities giving them one more reason to take my home.

When I was looking to buy a house, I made sure never to look at anything with an HOA. I have known enough people who suffered through dealing with the condo commandos at their HOA that I never want that. If I want to pay for a bunch of crazy rules, I'll get a landlord. At least I can always move out at the end of the lease. And the high percentage of HOAs in Florida are one of the things I always disliked about that state. My thoughts, AVOID AT ALL COSTS.
I lived in High end Lake Community. We didn't have an HOA the Town Council ran everything smoothly. The community next to ours also was high end but they had a POA and I walked with 5 -6 of them every morning one was the POA president she carried a Note pad with her as we walked and took down infractions. I said to her I am Glad I don't live over here you are Ridiculous of course she wss offended but as I pointed out to her how petty and trival SHE was being it gave her neighbors the courage to talk to her about it. She remained her term and then quit. I understand the benefits but I would Never live in one simply because when you buy your house NO group of people who Aren't makkng your mortgage should have the Power to take your home.
Sadly it is people like her who are drawn to serve on HOA boards. Power is a disease and control needs can easily grow to mammoth proportions. We have twice gone to the mayor of our small town about HOA over reach. Unfortunately while he calls our neighborhood a black spot on an otherwise wonderful community, there is nothing he can do. I've tried to organize some neighbors to change things with our HOA but they each have a different pet peeve that has taken on the weight of a survival need.. Some are rabid about lawn statues, others hate to see a child's bike on the lawn or someone painting a book case as a weekend project. Bless you for speaking out.
No HOA for me ever. I will never live somewhere that already has one. They can pay me 500K a year to live in one. I am not paying someone to tell me what to do. That is called being an employee and they have to pay me to do so. No way will I ever need to worry about being evicted by some group that has not paid a dime to a house I am paying for. Also unless they are taking care of all the outside things like the lawn and pressure washing of the house they can stuff the monthly fees for absolutely no benefit to me.

I was in an HOA once. Never again. I hung a pool towel on my fence. Immediately some busy body HOA fined me. Then each home owner was assessed $2000 to settle law suit for an irresponsible parent who let their child drown in a lake. Only 5% of residence lived on the lake. Parent should have been arrested for child abuse. That child almost drown in someone’s pool earlier. Not sufficient insurance after all fees paid. Tennis courts were not taken care of and we never used other facilities. Can’t commit. We were military at the time. Call city for code enforcement. Condo’s have same rules and worse.

Sounds like the HOA had insufficient insurance for the common areas if they couldn't pay the judgment for the lawsuit. That is on the board members for not getting enough liability coverage. I would have used the board members for my money back. ( I used to own a property management company and worked for hoa's our job was to advise and make sure they got enough coverage to avoid this type of situation)
We made an offer on a house once not knowing it was in an HOA. The real estate agent was confused when we tried to lower our offer after we found out. We ended up just withdrawing the offer completely. HOA homes are worth far less to many people. Why would I pay extra money to lose the freedom to use my own property how I want? Most of the “benefits” of HOAs are already covered by city or township ordinances in many places, such as keeping grass cut, no abandoned vehicles, homes in disrepair. I love reading the stories of smart people that band together to take over the HOA board then dissolve it.

Unfortunately, this is what happens when government abdicates its responsibilities, privatizes them, and passes laws that allow house theft. I live in a sunbelt metro area where everything built since the mid-1970's has an HOA (which is so mrruch as to say that there is no real choice to avoid them). I have seen terrible abuses over the years. HOAs shouldn't be allowed, but there seems to be no way to get rid of them... even simply going forward with new construction. It's the price we pay for living in a non-free country where people hate government and government hates people.

Reason #75,000 why I would never get another HOA. My first house was pre-construction so it had an HOA. No major issues because I only lived there 5 years but I made sure when I relocated that my current and Lord willing forever house was/is NOT AN HOA. That would have been a clear deal-breaker! 👋🏼🤨✌🏼

have a relative who lives in HOA, and when she fell and broke her arm they tried to fine her for leaving trashcan out too long. She's elderly and it was winter in the Northern states, and she lives alone. She always helps her neighbors, some who are younger than 40, but no one was there for her and the HOA local board didnt even step up to help. They need to add a clause/rule that they assist a neighbor in time of need like that. it was ridiculous. It also says a lot about where we are as a society.

Unfortunately, I live in an HOA. They are hard to avoid where I live. My neighbor parked in front of my house for a few nights. I got a letter about it. Told HOA it wasn't our car or belonged to anyone associated with our house and asked violation removed from our account. HOA asked whose car it was. Told them I didn't know and asked again if violation had been removed? They said, "We do not have the plate run back yet but have resolved the violation." They can run plates?! Looking forward to moving.

I lived in A non-HOA community in St Pete. Some of problems you talk about in terms of junk cars, parking on lawns, boats in the street were managed by city codes. The code enforcement in St Pete is pretty rigorous. No HOA mafia needed.

How can it be legal to suddenly raise Condo fees and HOA fees by 40+%. 2) How can these crooked tax assessors be allowed to overvalue someone's only home by hundreds of thousands of dollars, when they are not investors and those homes are their only child hood homes. Many areas are becoming like Detroit and Mississippi - desolate and empty as the working voting taxpayer is continuously fleeced. The vile municipality tax assessors are getting multi-year promotions using Tax Payer dollars because these tax assessors ARE Overvaluing people's properties to bring in money to the municipalities. My first home was in an HOA-managed community. I bought the last unit available in that community, and I had no idea the problems I would have with the HOA. The woman ... one of my neighbors, had been in the position of president of that HOA and boy, was she ever a real PRIMADONNA! You could call her the "Central Scrutinizer". The problem wasn't the HOA rules, ... it was how she interpreted them and applied them. She ticked off a lot of people, but I couldn't understand how she kept on getting re-elected. Some of my neighbors suggested that I run for the position, so I did. I didn't get enough votes for the president's position, but I did for the Vice-president's position. Apparently, not many people got involved with electing people for the HOA, and didn't attend the meetings. They did however, find the time to complain. I was able to shackle this president somewhat and keep her within acceptable constraints. It was a very nice property and it was being kept up. I could only image how bad it would have been living in a community without an HOA. I think that the bottom line is homeowners in HOA communities MUST be involved with the HOA voting process and come to the HOA meetings where they can voice their opinions and disagreements. Some governmental oversight seems like plain common sense.
I will do my level best to NEVER participate in an HOA.

Same here. I live in an area with no HOA and I can paint my house pink with purple pokadots if I want to and no one can do anything about it. (Don't worry, it's actually a dark green with white trim and I've had neighbors tell me that they think is looks great, but you get the point.) When you pay so much for a house it's really galling when others tell you how they think it should be. It's none of their business; unless you live in an HOA, which is why I never want to live in one.

There's absolutely no need for them. I live in a very nice, quiet, and clean neighborhood with no HOA. Everyone takes care of their property and they don't need anyone bossing them around to do so. We enjoy our vegetable garden and if we go on vacation for 2 weeks and the grass gets overgrown it's not a problem because we get to it straight away when we return. That's how everyone is around here.
Like minded people will find each other. Find neighborhoods where people take pride in ownership and their neighborhood and everyone governs themselves correctly. Maybe if a slob does move into the neighborhood the other neighbors can gather to see if there's anything they can do to help maintain their space, volunteer to mow or help fix the fence. Sometimes people fall on hard times and genuinely don't have the means whether it's money or manpower to get things done. They may be too ashamed to ask for help. If we took care of ourselves AND watch out for each other when needed HOAs would be deemed completely unnecessary.
There are plenty of neighborhoods like mine that are well managed by the people themselves and not some board members. HOAs are for the paranoid...with extra money to blow.

It is illegal to file a UCC1 Lien against someone’s name and property unless there is an actual bonafide crime. Commercial infractions are not actual crimes. They are civil in nature not criminal.
Sue the HOA. Also, if a HOA starts contracting you for a presumed debt, do NOT ignore them. Return a reply using certified mail within 21 days and dispute their claim and force them to prove their claim. If they fail to prove their claim in writing and in affidavit form under penalty of perjury. If they fail to prove their claim then there is no claim at all.
HOA’s should not exist. Home owners are not children that need to be monitored and kept in check. I don’t live in an HOA, but if a neighbor doesn’t cut their grass, or keep their property in shape, we just call the city. The city cleans up and adds that cleanup fee to their property tax. Of course warnings are given prior.
You'd be surprised how unkept some people keep their property unless forced to clean it up.
Sadly, home owners often act like children and need to be monitored and kept in check.

I live in a 55+ community HOA in PA and the new rules keep coming. Very discouraging !! My mom lived in one where you could put up white xmas lights only, and have white backed curtains only. Many other ridiculous rules to mention. HOA's shouldn't exist at all, that's why we have city ordinances.

Years ago, before indoor air conditioners my HOA didn’t allow window air conditioners! The air conditioning wasn’t strong enough to cool the bonus room over the garage. Even when proof of the high temperature was presented to the HOA, they didn’t allow the air conditioners. This made the rooms unusable in the summer. Eventually, I sold the house.

Homeowners Associations (HOA) were originally called Protective Covenants in the early part of the 20th century and their purpose was to enforce racist Jim Crow segregation laws. So if you had a housing development and you wanted to make sure that no blacks, no Jews, no Mexicans etc. moved into your area the Protective Covenants were there to keep specific groups out. Over time sensibilities changed (a little) but the power of these extra government organizations did not. They are governments within governments which you agree to when sign those papers to buy that house. No house is worth living under control of people like this; you're essentially renters with none of the protections of renters but with all the financial liability. That's who these people are, just don't do it.

I work for a company that does the accounting for HOA's. One case caught my eye. A homeowner with past dues totaling 9k+. They tagged on another 9k charge just from lawyers fees.

I've lived in an HOA home for the past 13 years. Not one fine or warning in those years. What you spew are outliners exceptions, not the rule. I would guess that over 95% of the people living in an HOA community have never faced a fine. The ones that actually end up getting kicked out, if you look at what they did, you would more likely than not, side with the HOA.
I echo the poster above. We have lived in a detached condo for 18 years.
No fees or warnings etc in that time. Most of our neighbors have been here for the same amount of time (or longer) and love it here. If any of us want to change a bylaw, we would vote to do so. We are the ones who agree to the bylaws and the management company (that we hire) enforces them.
And 99% of HOA will not foreclose on your condo unless you were severely behind on dues and have not been in contact with them.
One homeowner in our development was a year behind on their condo fee that was $350 a month at the time.
The management company sent certified letters, emails, phone calls and eventually took him to court to place a lien on the property. They didn't foreclose on him. Instead, he would pay the lien when he eventually sold the house. I don't think that is unreasonable.
Try not paying rent for a couple months and see what happens.

As someone who lives in a country where HOA’s are stringently regulated by the government I find this absolutely horrifying.
States should have never passed laws allowing HOAs to force a foreclosure on home owners over past due fees and fines. They should have allowed liens to be filed that would have to be paid off when a home is sold. HOAs also should not be allowed to charge excessive interest on past due amounts.
Well, show them you won't live in an HOA, and when the houses don't sell, change will begin. Do not buy a house withing an HOA.

What I realized is owning a home in America is a hoax. You can own the house and lose it for failure to pay property taxes, Squatter rights, and HOA fees and penalties. In the end after all the money you put into the home you don't actually own it.
Here in San Ramon, CA, HOA keeps sending notices to repaint the house or gate or fix the roof. But they ignore Redwood trees leaves visibly accumulating on our roof causing nest habitat for geese and also potential fire hazard. The trees belong to them and keeps on ignoring them because it’s their expense not mine.

This is something making me look away from new construction, they all have hoa.
When I was looking to buy a house, I made sure never to look at anything with an HOA. I have known enough people who suffered through dealing with the condo commandos at their HOA that I never want that. If I want to pay for a bunch of crazy rules, I'll get a landlord. At least I can always move out at the end of the lease.
And the high percentage of HOAs in Florida are one of the things I always disliked about that state. My thoughts, AVOID AT ALL COSTS.

I lived in High end Lake Community. We didn't have an HOA the Town Council ran everything smoothly. The community next to ours also was high end but they had a POA and I walked with 5 -6 of them every morning one was the POA president she carried a Note pad with her as we walked and took down infractions. I said to her I am Glad I don't live over here you are Ridiculous of course she wss offended but as I pointed out to her how petty and trival SHE was being it gave her neighbors the courage to talk to her about it. She remained her term and then quit. I understand the benefits but I would Never live in one simply because when you buy your house NO group of people who Aren't makkng your mortgage should have the Power to take your home.
Sadly it is people like her who are drawn to serve on HOA boards. Power is a disease and control needs can easily grow to mammoth proportions. We have twice gone to the mayor of our small town about HOA over reach. Unfortunately while he calls our neighborhood a black spot on an otherwise wonderful community, there is nothing he can do. I've tried to organize some neighbors to change things with our HOA but they each have a different pet peeve that has taken on the weight of a survival need.. Some are rabid about lawn statues, others hate to see a child's bike on the lawn or someone painting a book case as a weekend project. Bless you for speaking out.
Thank our law makers for making this possible. No oversight. None! Or they too are 100% complicit.

Some HOAs start low, then with excuses balloon up.
No HOA for me ever. I will never live somewhere that already has one. They can pay me 500K a year to live in one. I am not paying someone to tell me what to do. That is called being an employee and they have to pay me to do so. No way will I ever need to worry about being evicted by some group that has not paid a dime to a house I am paying for. Also unless they are taking care of all the outside things like the lawn and pressure washing of the house they can stuff the monthly fees for absolutely no benefit to me.
One of my coworkers home was put on foreclosure because she didn’t replant a bush that dried. It’s insane

Nope - I went out of my way not to get into an HOA - Florida has crazy rules!!
Property taxes are bad enough. Never ever would I sign or enter into an agreement where another entity could seize my home 🙄

That’s the problems these days. So many people in the supposed “land of the free” are quite happy to prohibit someone from living within their means. It is so immoral. In order to be a freedom lover, you have to love someone else’s freedom. Americans hate freedom despite all the lip service to the contrary.

I was in an HOA once. Never again. I hung a pool towel on my fence. Immediately some busy body HOA fined me. Then each home owner was assessed $2000 to settle law suit for an irresponsible parent who let their child drown in a lake. Only 5% of residence lived on the lake. Parent should have been arrested for child abuse. That child almost drown in someone’s pool earlier. Not sufficient insurance after all fees paid. Tennis courts were not taken care of and we never used other facilities. Can’t commit. We were military at the time. Call city for code enforcement. Condo’s have same rules and worse.

Sounds like the HOA had insufficient insurance for the common areas if they couldn't pay the judgment for the lawsuit. That is on the board members for not getting enough liability coverage. I would have used the board members for my money back. ( I used to own a property management company and worked for hoa's our job was to advise and make sure they got enough coverage to avoid this type of situation)
We made an offer on a house once not knowing it was in an HOA. The real estate agent was confused when we tried to lower our offer after we found out. We ended up just withdrawing the offer completely. HOA homes are worth far less to many people. Why would I pay extra money to lose the freedom to use my own property how I want? Most of the “benefits” of HOAs are already covered by city or township ordinances in many places, such as keeping grass cut, no abandoned vehicles, homes in disrepair. I love reading the stories of smart people that band together to take over the HOA board then dissolve it.
What kind of trainwreck has the country come to, where a home owner's association can seize your home for unpaid, made up fines and fees? Why stop there? I am so surprised as to how they haven't come up with the tactic of seizing and liquidating bank assets, 401K retirement accounts, Stocks/bonds, pension/social security benefits!
Unfortunately, this is what happens when government abdicates its responsibilities, privatizes them, and passes laws that allow house theft. I live in a sunbelt metro area where everything built since the mid-1970's has an HOA (which is so mrruch as to say that there is no real choice to avoid them). I have seen terrible abuses over the years. HOAs shouldn't be allowed, but there seems to be no way to get rid of them... even simply going forward with new construction. It's the price we pay for living in a non-free country where people hate government and government hates people.
All new sub divisions should be one level homes without HOAs.

We are in FL and kinda going through something like this at the moment. They didn’t say anything to us until last week and we were trying to do everything we could before asking family for help. $1,200 turns into $8,000 pretty quick.

Reason #75,000 why I would never get another HOA. My first house was pre-construction so it had an HOA. No major issues because I only lived there 5 years but I made sure when I relocated that my current and Lord willing forever house was/is NOT AN HOA. That would have been a clear deal-breaker! 👋🏼🤨✌🏼
Houston Texas same thing they are cooking the books with fees. I have a story they are not interested in being paid they want my home they made it clear.
How about passing HOA must follow the constitution
