  • Supreme Court Supercharges Gun Violence Epidemic
    A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.-The Second Amendment
    If you’re looking for someone to blame for the gun violence epidemic that has left our schools, streets and communities soaked in blood, don’t point just at the National Rifle Association and their lackeys in the Republican Party. Raise another finger, ideally your middle one, toward a Supreme Court that has enabled the unceasing rise of our gun violence epidemic in all its ever-more-obscene forms.
    The key fun violence decision came in 2008, when a 5-4 majority led by the late Justice Antonin Scalia ruled in District of Columbia v. Heller that the Second Amendment protects an individual right to own firearms. Prior to Heller, the combined weight of academic scholarship and legal precedent had construed the Second Amendment as protecting civilian gun ownership only in connection with long-antiquated state militias. This view was long seen as reflecting the spirit of the actual debates held during the Constitutional Convention of 1787.
    Scalia and the other members of the conservative Heller majority purported to base their radical reinterpretation of the Second Amendment on their “originalist” understanding of the Founding Fathers’ intentions. But their novel conclusion essentially ignored the first 13 words of the Second Amendment regarding the necessity of preserving the militias.

    Thanks to Supreme Court rulings, gun ownership in America jumped from 300 million to 470 million in just a few years; 45K deaths annuallly, up from 30K; and a doubling of mass shootings to 633 a year.

      Now of those 45K deaths every year 30K are suicides. We know that banning guns has no effect on suicide, the 10 highest countries in the world for suicides all ban guns completely. Japan has a total ban on guns and a suicide rate higher than ours, so clearly there is no connect between suicide and guns.
      It is a bit disingenuous to put up a number like 45K and imply that these are all murders.
      You also imply that the remaining 15K deaths are murders, which again is not true. The actual number is around 7k a year, of which 6k are the inner city minority gang on gang violence. That is driven by the drug and gangster culture in the two key minority groups. These thugs are running around with machine guns, which are in effect banned in this country, proving that banning guns will not stop that violence.
      So in reality the US does not have a gun violence problem. The perhaps 1,000 or so deaths that can be classed as a non gang murder is on a par with most other countries, they just kill each other using other methods. Remember, the US has a population of 350,000,000 people, so at 1,000 that is around 1 for every 350,000 people. Not an issue, more parents kill their kids by feeding them some peanuts every year.
      In other words, get another issue, a real issue like the failed education system that leads to millions of deaths a year due to poor lifestyle choices.

      @Laprogressive it's wonderful how many people have taken up the responsibility to protect their families and communities with defensive weapons. Homicides and murders are on the decline because of it. It's a difficult burden to constantly train and deal with the consequences of defending your loved ones from criminals. I hope you can take the time to thank a local concealed carry permit holder in your community for the responsibility that they endure for your safety. Thousands of innocent people are saved every year and never receive any attention from the media.

      @@brentsrx7 10's to hundreds's of thousands of people to be more accurate, are saved every year by defensive firearm use.... most aren't even reported!
      Twice I've had to brandish a weapon to deter a would be evil doer, but didn't report since there wasn't a crime committed.

    The key driver for the increase in gun ownership in recent years wasn't the Supreme Court. It was the unwillingness of big city progressive politicians to protect the public from violent criminals. We spent two years locked down while "mostly peaceful" protesters burned and looted our cities. Meanwhile, these same politicians pushed insane policies such as "disarm the police". They followed that up with three and a half years of unchecked illegal immigration. Millions of ordinary people who prior to all of this would never consider owning guns took responsibility for their own defense.
    Self-defense is a basic human right. The right to keep and bear arms is simply an extension of that right.

    All of the nations framers carried personal weapons and used them with some regularity. There was a constant threat from wild animals while traveling, bandits, foreign armies, wild natives, and political rivals with deadly intent. The spark that ignited the American revolution was an attempt by the British to confiscate civilians weapons being stored in Concord Mass. This ended in the local militia taking up arms, which were military grade weapons stored within their own homes to defend against this tyrannical force. The shot was heard around the world at Lexington and Concord. Any government that disarms it's citizens is illegitimate and tyrannical.

      @tnh723 The federal government operates under a wonderful founding document, but its principles have been severely eroded. The Federal government operates numerous torture prisons like Guantanamo Bay and illegitimate FISA courts under the guise of law and order. The framers, even the Federalists among them, would be horrified by its size and abusive practices. We, the people, need to keep the balance of power and demand that our unalienable rights are respected now more than ever.

      The weapons used by colonists in the Revolutionary War and stored in people's homes were commonly used. That is, they were used for home defense and hunting prior to the war. Even rifles, which arguably allowed the colonists to defeat the British at the Battle of Saratoga, were owned by civilians at the time. Hence the AR-15's nomenclature as the "Modern Musket." It is the MOST OWNED rifle platform in the US, with over 44 million in private ownership.
      In fact, if there was an implement used in the war that would have been considered a military weapon, it would have been bayonets. Most colonists (particularly at the beginning of the war) did not have a bayonet. ALL British soldiers with muskets had them.

    The court did not super charge gun violence. You don't know nothing about guns. I own many guns and I am an Iraq veteran. The bumps to keep is impra tidal and more less a gimmick in the gun world

    Gun violence is a propaganda term for human/human violence. It’s not the guns it’s the people.
    The gun is simply a tool and as long as multiple national studies consistently find that defensive gun uses are significantly more numerous than offensive, suicidal or accidental uses I will believe in the individual right to keep and bear arms. Good luck in your frustrated endeavors.
    Also, we protect many politicians etc with guns. Stop holding our children hostages in gun free zones so you can wave their bloody shirts in your civilian disarmament campaign. You have our children’s blood on your hands!

    Poor deluded anti gun folks. You don't have to do mental calisthenics guessing what the authors of the Constitution meant by the second amendment. All you have to do is use your eyes and your brain and READ it. The framers were talking about citizens as being the gun owners and users, not the militia.... Or else they wound have used the term militia members or militiamen, not the people. By "people" they meant EVERYONE. Second, how many meanings does the word "infringed" have??? The second amendment doesn't say it's alright to infringe the people's right just a little. It says the right shall not be infringed. Period. This means no restrictions, no gun laws, no gun control. Sorry if this seems unsafe but apparently the framers had more faith in the people's ability to solve problems peacefully than you guys do. It's obvious the framers wanted to keep tyranny by government at bay. To do that you need as many people to own and carry firearms as possible. And they need to have the best and most powerful firearms available. Not just the "safer" ones. We need to have exactly the same types of weapons at our disposal as a tyrannical government would have. If this offends your sensibilities, too bad. The framers had a much more compelling objective in mind than making you feel all warm and fuzzy: Freedom.

      The lies and misinformation this clown was peddling were so egregious and the little hints of tyranny such as expanding the court it is always the same game with these people I did not get my way so we have to change the rules with zero concern for the how people feel about it. Last time I read the amendments abortion was not on the list,and to compare abortion to the second amendment is apples and oranges. Ending Roe put the abortion laws to the states and allowed the people to have a say on their abortion laws. However Democrats are tyrants and want to force the people to bow down to big government tyranny just like during the Covid lockdowns and their mas mandates that did virtually nothing to protect the wearer it was really a symbol of submission to Democrat tyranny and force the little people to comply.

    There is no gun show loop hole. Every gun sold at retail already requires a background check. Criminals get their guns through theft and straw purchasers. This guy seems to have no actual knowledge about how gun purchasing works and how crime works. Smoking is was not included in the Bill of Rights. Arms were, for good reason. Women weren't empowered at the founding of the country, but they were there for the Temperance Movement. Step 1) Constitutional Amendment outlawing alcohol; Step 2) Create large-scale organized criminal enterprise; Step 3) Realize what a mistake it all was, pass Constitutional Amendment dumping the 18th Amendment in the trash can. These people need a tutorial on how and why things work in society.

I assume you are pointing to the phrase "well-regulated militia". If, as George Mason said, the militia is "the whole of the people", and if Federal Law, 10USC246, DEFINES the militia as all able bodied males seventeen and older (plus a few other classes), what are our public schools doing to see to it that our young men are well-regulated--that is, well trained--by the time they are high school juniors? Is Congress funding our militia classes in accordance with the Constitution, Article I, section 8, clause 16?

    The first 13 words say that a well regulated (prepared/equipped) militia (armed civilians, not the organized military/national guard, not the police or any other agents of the government) is necessary to the security of the free state (as in running illegals back out of their country or conducting any further revolutions) and the rest says the RIGHT of the PEOPLE to keep and bear arms (all arms including military arms - because the militia fights wars) SHALL NOT BE INFRINGED. If we are going to ignore amendments I am all for ignoring the 13th and the 19th...maybe a few more...let's pick and choose.

    "We did not speculate as to the intent of the framers of the second amendment; we examined James Madison's drafts for it, his handwritten outlines of speeches upon the Bill of Rights, and discussions of the second amendment by early scholars who were personal friends of Madison, Jefferson, and Washington and wrote while these still lived. What the Subcommittee on the Constitution uncovered was clear-and long lost-proof that the second amendment to our Constitution was intended as an individual right of the American citizen to keep and carry arms in a peaceful manner, for protection of himself, his family, and his freedoms."
