Australia's Sex v Gender Case Could Change Women's Rights GLOBALLY

  • Australian media are ignoring a landmark fight to reclaim sex based rights and protections
    for all women and girls. This constitutional law case is not only relevant to Australia; it could potentially redefine women's rights around the world as it is based on a UN convention to which most countries are signatory.
    Our guest on this week's Whittle is Sall Grover, the Australian founder of an independent female-only social media, networking platform and app called ‘Giggle’.
    Giggle was created by Sall as a platform centred around women connecting with, and supporting, other women. The purpose was to provide an app that allowed women to safely connect; an important consideration when dealing with strangers. Giggle uses biometric technology to scan faces to ensure the app remains single-sex.
    Sall is being taken to court because she wants her Giggle app to remain female-only.
    This is a landmark case that is about to go to the Federal Court. If Sall Grover wins the case, it will be a big win for sex-based rights for women across Australia and potentially the world.

      Even though the whole argument is absurd. It feels that at its origin, Australia wanted to incorporate everyone into the non-discrimination. Maybe if trans-women had gone through the whole surgery and the whole deal, maybe this would have not been a huge issue. It started to become an issue when the bearded lady with a shlong walked into a women's bathroom, and when the entitlement to "be a woman" signified for men to play in women's sports.
      These type of people deny reality, avoid facts, simply because they feel insignificant, disgusted with the world. They have simply decided to "create" a world to suit their own disconnection.

      Weird how this person is the one speaking on this topic when she herself created a sexist app for sexist reasons acting as if men being present are a threat and create unsafe environments for women while being wrapped up in the sexist and destructive MeToo movement which has been proven to be mostly false accusations by hateful people trying to cancel men.
      Ironic. Sure doesnt like it when the exact same thing is done to her using the exact same idiotic way of thinking only with the target different.
      Now listening to the part where she shows he clear sexism towards men at 29:00 in. Wow. Toxic femininity at work and a clear narrow view of reality acting as if only men do the things she brings up after 2 straight decades of women continually invading male only things and in one of the biggest cases worldwide, the utter destruction of the Boy Scouts in America, by girls invading it via social pressures and then denying them funding.
      Toxic women are now getting a taste of their own tactics from trans people...and obviously, they dont think its fair. Welcome to being EQUAL to men as now you are getting what you have been giving.

    Protecting women's sex-based rights is not transphobic. No other group in history has ever claimed that their rights should supersede another group's rights. Females deserve the right to have safe spaces, shelters, sports, etc. Just because a male identifies as a woman, doesn't mean their feelings should be able to override a woman's sex-based rights.       Please enlighten me what is a Sex based Rights. Woman didn't even have tampons when my mother was having her first menstrual cycle. The 14th speaks to equal protection under the law. If a cis woman may get gender affirming breast implants equally a trans woman is entitled to access to the same gender affirming care.

      @@Preciouspink What are you even rambling about? I have no problem with transwomen having access to "gender-affirming care" (even though I think that term is a misnomer). They can do whatever they want with their own bodies. What I do have a problem with is women's single-sex spaces and laws being destroyed. Title IX for example is supposed to protect and segregate sports for females and now you have giant males like Lia Thomas destroying women's sports. You have female-only abuse shelters being invaded by males. You have males SAing women in women's prisons. Instead of destroying women's spaces, transwomen should be lobbying for their own spaces.

      @@Preciouspink Implant surgery is no more necessary for the physical health of a woman , born a woman, than trans. Anything that has to do with female born sexual anatomy, sexual organ health, pregnancyl, birth & post partum health, peri- & post menopause, etc., These are some of the obvious female, sex- based rights. Tampons are a modern convenience I personally would not like to be without, I don't even even understand you questioning or conflating convenience & unnecessary surgery, with born female right's to have her health care needs met. Gender affirming care is another matter altogether, whether for trans female or trans male.

      Equal access to procedures falls under equal protection under the law. As An example being.Legislators are crafting laws blocking gender surgeries for only the trans woman particularly if under age 25. This is the unconstitutionality I am talking about.Another example is that cis men may get breast reduction.A trans man cannot have his breasts removed under some of this legislation. The courts have already ruled on these laws are unconstitutional.

      @@Preciouspink Where did I say anything in my comment about "gender-affirming care"? I don't care if an adult chooses to take drugs or have cosmetic surgery. It is their body to do what they wish. However, taking cross-sex hormones and getting cosmetic surgery doesn't make you female. Females deserve single-sex spaces for safety reasons. That is what I mean by sex-based rights. The biological definition of woman/female needs to be codified so women can protect their safe spaces.

Bigots can easily avoid misgendering by avoiding pronouns and simply using people's names. Accidentally misgendering is never penalised. Fines are reserved by deliberately using misgendering to harm others, the same as we have fines for using racist names.
      Sport is a difficult area as someone who has gone through male puberty has an advantage over cis women in some sports. It has no relevance for any other aspect of life.
      What do you propose? A genital of medical certificate to use the bathroom. In the USA there have been many cases of others making incorrect assumptions. In one case, a cis woman was assaulted because she did not look womanly enough and was assumed to be a trans woman. In another, a trans man used the women's rest room because that is what legislation required and was assaulted and arrested because he was assumed to be a trans woman.

      Unfortunately too many of our countrymen are happy to follow any rule the government makes. So while I agree on principle, Australia is really governed under two basic concepts.
      1 the golden rule: that is who controls the gold makes the rules.
      2 enforcement by the willing. Those who enforce the rules are completely willing to follow orders of 1 without question.
      Until the people are willing to stand up for their basic human rights, and the enforcement is willing to refuse to obey improper orders, we're basically f---ed

      The judges in Australia should state that if the government want to change the constitution they should conduct a referendum. This happened in Eire. In Scotland the legal law should be challenged by using the constitutional law the Bill of Rights Act 1688. This gives the right to freedom of speech. It does not give anyone the right not to be offended.

    I’m Australian and I really hope you win this legal battle because I feel women are being forced out of every safe space. I won’t go to public toilets or public pools anymore because I don’t want to have a man in there with me. I am 67 and have mobility issues so would be incapable of running out. Women need to fight back or we will lose all of our safe spaces.

    About 15+ years ago I was in a women’s group “Lynx”. After accepting one transgender man in who said he was a lesbian, this person was very radical, wanted more transgendered (with or without surgery) in the group, wanted to control an on line profile and so “bossy” that arguments ended up, people walking out every meeting and this group that started years ago, CLOSED.

    We had a guy at work (not transitioning or anything like that, just a straight up cis man) come into our women’s shower block and stand there perving on one of my female colleagues whilst she was trying to dry herself and get dressed. She reported him. He then claimed he identifies as female. HR gave her “sensitivity training”. I got pulled into the office by my OH&S rep, who was extremely concerned about my safety, who told me what had happened. The OH&S and the union can’t do anything about it due to the current political climate. Now apparently we are expected to go and have our showers and put up with the men coming in and watching us and have no legal right to complain.
    This is what these trans extremists are causing. Putting biological women in massive danger. Taking away our rights and safe spaces.

    Our only female Prime Minister, Julia Gillard, flippantly gave away our women's rights when she was PM. Not one PM since, has had the guts to restore them. Sally is a dead set legend, representing women in Australia and the world. She has a lot of support from women here, but not from the media or in fact, our male dominated government. I am so glad she is in London, speaking up for ALL WOMEN, no matter where they live in this world. Love and support Sal, in your upcoming court case to bring back sense and sensabilty to what a woman is and that we wont be silenced or erased, by men in dresses.

    I am Australian and live in the state of Queensland. We have self ID laws in our State now so any man can stand outside a women's space, declare himself a woman and enter legally. Recently I was travelling through a rural area and stopped to use the public rest rooms at a large truck stop. This was a fairly lonely area so I was already feeling a little nervous about stopping there but what made me feel even worse was that when I walked up to the toilet block there were six toilets and five of them were marked Unisex. One was marked "Male'. One of the Unisex toilets was also marked 'Disabled & Parents". There was not one toilet designated for women only. I could understand if there was only one toilet. But six? Why could they not designate at least one toilet for women when they managed to designate one just for men? Surely it is women who are most vulnerable in this situation? As a woman who was attacked in a public toilet as a teenager, it is very confronting to see women only spaces disappearing and Sall is right; No decent man would enter a woman's space and all of the men I know who are solid, good men, would never dream of doing so. The only men you're going to see there are auto-gynophiles, predators, perverts and misogynists. Happily, I have solid martial arts fighting skills but even with the knowledge that I can competently defend myself and do some grievous damage to an attacker, I am still hyper-aware in public rest rooms knowing that I could find myself alone in an isolated space with a man. God help the women who do not have these skills but hey, as long as we are protecting the feelings of mentally ill perverts, then it's all ok. Too bad for the terror women and children experience when they have to risk their safety, privacy and even their lives by using one of these spaces.

      Sure @@Janna773 It is a large truck stop around Helidon Spa on the Warrego Highway on the way to Toowoomba. It only happened a few days ago. I am going to write to the Council about it. I think it is the Lockyer Valley Council but I have to confirm that. I was truly shocked. Why do men get a Male toilet and yet women get nothing?? We are being completely erased. Shame on them! Also, I have heard that Redcliffe Council have made all of their toilets Unisex but I have not confirmed this. I will be checking this next time I am in the area.

    as Spain has been used as an example I feel compelled to give context. from 2004 we have a pack of laws sinergyzing each other over gender violence:
    -it only applies when a man agredes his female partner (gay couples and female to male violence get excluded,it's an "author crime")
    -the "victim" can sue WITH NO OTHER PROOF THAN HER WORD and only phisical evidences can unprove it
    -the "victim" can claim a pack of benefits around a lot of areas in life that have zero relation to the crime (can get a monthly check,a free college tuition,even extra points as if she were disabled when applying for a public bureaucracy job)
    -he gets inmediately expelled from the home and can't see his children for years,while paying alemony
    -in case of a false accusation,the woman faces nothing,only if the man after years of courts still wants to continue with a countersue,and he has to prove beyond doubt that she was doing it on purpose if he wants her to face charges (in theory the district attorney has to prosecute her,but doesn't,cause she's a poor woman)
    -all of the above is paid by the taxpayer,the woman has the right of a free defense (even tho is a free attack)
    -women have quotas and advantages towards getting jobs and promotions
    -women and lgbtqt54aewi8+ have subsidies for professional projects
    and many more things,there are around 500 laws that benefit women,majority of them for no reason. spain is a reverse handmaids tale state.
    many of the men that changed gender with the new law made it to go full circle: getting their basic rights back. now they can have a fair trial,they are not guilty until proven inocent,they can have their kids back,they aren't denied a job they are qualified to instead of women who don't pass the phisical exams,and all of it legislated by the same parties that made the hell above a reality. OH THE IRONY

      What you described is the exact ground reality here
      - men can't claim to be victim since courts said only men can commit several crimes
      - men get arrested and convicted on mere words of women
      - men still have to pay despite being the victim
      - men get no compensation for false accusations
      - men aren't allowed to be a part of several quotas
      All while media claims how India is s patriarchal misogynistic country!
      Could care less if feminists are being affected by anything, they've made this world a living hell for men and are merely starting to receive the same favour
