    Hi - I am planning to do a Fannie Mae or similar non-recourse loan but the lender is insisting on us signing a "bad boy carveout" to do the deal. Does that violate self-directed IRA rules?

    What if you purchased a property using funds from a self directed 401k plan for the down payment of the property and the property wasn’t put under the name of the trust rather it was put under your personal name. How would you go about correcting this?

    Does one need an IRA do get a non recourse loan?

      Well, that's an interesting question. No...anyone can get a non-recourse loan. Most non-recourse lenders don't care if it's an IRA or a person. They want a cash flow producing property, 40% down and a 10% reserve. Which isn't the worst thing either. It means you aren't over leveraged, and you get great cash flow. Some people like more leverage, but the "non-recourse" is pretty sweet too.
