She STILL thinks policy trumps law 🙄
Bye laws trump CAA laws however. Read NT website and educate yourself.
@@chrishall197 on airspace? Don't be silly
@@nikaveyard1176 Yes indeed. CAA on their own website state some bye laws can apply.
@@chrishall197 They same byelaws MAY apply, they make no specific reference and it seems it's just an easy get out of jail free card for the CAA.
In addition the National Trust website says:
In addition, any unauthorised use of a drone (either flown ‘over’ or ‘from’ relevant land) may constitute a trespass, nuisance or harassment depending on how it is flown and the impact of the use. These are civil claims which landowners, including the National Trust or other affected parties may bring, and which fall outside the CAA (Civil Aviation Authority) guidance.
I am not a solicitor but the wording of that seems to suggest that they are extremely ambiguous in that is MAY constitute a trespass, nuisance or harassment depending on how it is flown and the impact of the use. It doesn't specifically list any offence and suggests that its a civil matter like common trespass.
More interestingly, they quote
"In accordance with the UK CAA (Civil Aviation Authority) Drone Code 2024, which states that byelaws can restrict drone flight, the National Trust Byelaws, constituted by Acts of Parliament, clearly express that an unauthorised person shall not operate an airborne vehicle or machine over National Trust property."
The latest Byelaws they quote on the National Trust website were constituted in 1965, and only refers to means of conveyance when in reference to any flying machine, on the documents made available on the National Trust website, I can't find where they have quoted that from. Happy to be correct though, I only had a fairly quick look.
@@chrishall197 Do bye laws cover private and commercial aircraft too?

Katharine the castle supervisor could not see over the shortcomings of their policy. However, thanks to you and your drone, we got a wonderful view over the castle.
Mental how they think a DJI mini will damage a castle 🤦🏼♂️🤦🏼♂️🤦🏼♂️
Yeah. Castles built to withstand canon balls, fire arrows etc.😅

That’s the funniest thing I’ve ever heard. If Oliver Cromwell had a few mini drones he could have saved a fortune in cannon balls.
🤣I was just thinking that - it's clearly a very delicate castle, unlike other castles which aren't, because they're castles.
The DJI 249g Trebuchet shot in winter can cause great damage to those 8 foot think stone walls that have stood for 800 years..........
All these buildings are only 50 years old. Just in last 10 years there all crumbling because of the number of drones that have crashed into them

Amazing how all these businesses believe that they own the airspace as they always say no, also looking at your video you get to see the true beauty of the site other than just walking around it and it could well get more people wanting to visit having seen this.
I would say to them ok if you own the airspace over your property up to what height do you own it 🙂
They say it might hit the building, I think a 249g drone would come off worse
A bit like jet planes hitting the twin towers, they bought those down.................didn't they ?
They must think the building is only 200 grammes. The Science behind their logic. Private Education wasted again.

The two people behind reception are just blatant, open liars. I can't imagine ever remaining friends with people so open to lying directly to my face. No drones have damaged that castle. Obvious lie.
And that guy pretending that he went on the goverment website and found the site "blacked out" was such an egregous lie, I mean, no such site even exists! What an absurd thing to lie about.
Grown adults totally OK with blatantly lying on camera... It always shocks me.
Seems like once someone gives some power to the youth, their logic disappears. I was once a youth too and did the same thing but with no lies.

"No drones have damaged that castle." - when i heard this i thought to myself: What is the idea of building a castle? Ahh yes, to set a claim to a territory and defend this claim with the castle. Therefore, and you might be surprised to hear that, castles are build to withstand attacks. Things like arrows, pikes and stuff. So i guess, and it's a wild one, a drone would have quite some problems to "damage" such a structure :)
Oh, brilliant work DJE, thank you so much sir! .

Absolutely brilliant manager. Polite, professional and informed. A rare jewel of a person.
She was lovely.
You weren't applying pressure, but you were applying 'reason'! & in your usual informal & polite way!!😊
I wonder how the people who built these places would have reacted if someone had told them a little remotely controlled drone would one day be able to fly over it and take pictures of it all.
...and cause so much damage to it!
Where you took off from is owned by a farmer. We had the authority to film (not with a drone just on the ground) on his land. The representatives from the castle came over and said we can't get the castle in the background. Not sure who these people think they are and what power they have.
lol. Look at the tree in the background when she says it's too windy. Oh okaaaaay.
Inclement weather can do more damage than a 249g drone
imagine the total devastation to a ruined castle wall a sub 249 gm drone would cause if it fell out of flight.
Hi DJE I watch your channel all the time not only are they unfriendly to drone flyers as I am severely disabled they don’t look very disabled friendly
There are lifts and ramps where it is possible to place them, and they've actually just redeveloped pathways in and around the site to make it more accessible. However it is a 900 year old ruin, there is only so much they can do.
Another gaggle of pretentious know it alls, who are clueless. Looking forward to it 🤣🤣
Brilliant. I was born just down the road from there.

love the English Heritage visits. I am absolutely astounded by the arrogance of these people when they think that they are wright and you are wrong. just the smug looks on their faces. great when you knock it of. keep up the good work
Surprised to see so many negative comments here to be honest... They were trying to enforce their policy which is understandable, and when they realised their policy couldn't be legally enforced they backed down and tried to compromise. They weren't rude or aggressive and the manager handled the situation well... This was WAY better than the average National Trust site.
Fair point. Many people here like to vent their displaced anger on any perceived authority. Even DJE stated they'd been reasonable. But his audience is his audience.
The problem is they lose their mind because he stands firm 😂

Worse than the police
The absurdity that a little drone could possibly damage a medieval fortress that survived the English Civil War.
I remember learning at school about how Cromwell's army destroyed our castle with several hundred 249g drones in under 10 minutes.
Mate you need to do tintagel castle in Cornwall, that place is super hot on drones and English heritage too!
The previous drone caused a hell of a lot of damage by the Look of It.
A few points on this. 1) There's a point at which the air around land/property ownership becomes Airspace - clearly it can't be below roof height otherwise you would genuinely enter into enjoyment and utilisation of that land for your own activities 2) EH can have any policy they wish - even if it isn't legally enforceable 3) I'd love to see this tested in court. My suspicion is as long as you take off outside of their private land, maintain VLOS and fly above roof height at all times you're fine. You don't always do this though ;-)
I don't understand why people feel so confident in their convictions without ever seeing a shred of evidence to back their comments.
Because they are conditioned from birth to accept whatever somebody higher up says
She doesn't want to hear the buzzing noise. I guess when she hears a plane, she needs to inform the airport that planes need to fly higher.
Great stuff DJ I think it's much better seeing these places from the sky and it's always a bonus seeing the the fish take the bait 😂👍😆
I bet Henry VIII wished he had a DJI Mini when he attached Kenilworth Castle. All this chat about severe damage - would have been a conflict-defining weapon. Damn.
These entitled people actually think they have some sort of authority! It is hilarious!
Their management are clearly LYING to the staff that flying drones over their land or monuments is illegal .
They must be called out on this 😮
Well done is challenging them , these challenges will hopefully force them to be truthful and not lies to their staff and have their staff LIE to the public .
They need to take this up with the CAA and not make out flying is illegal when it's not , so if the CAA agree with them fair enough .
The staff were nice and polite if misinformed! The NT needs to urgently save its loyal staff from this continuing embarrassment.
It’s our policy!!!! Yeah right. The staff are very funny lol

Next NH, just tell them you're legally allowed to do it, and therefore you will: but that you're willing to negotiate how low you go provided they allow you to use it on their grounds.
If they refuse, fly it as low as you feel is safe.
Teach them a lesson please.
More hysteria prone neurotics who've found jobs they think will give them a satisfying combination of lack of stress and immense power.

this was fascinating because here in Australia we don't have castles like this.
