The poet, Faiz Ahmed Faiz, wrote this while in prison. this time of isolation from his family inspired the longing nature of this song.

This is a ghazal a very high form of traditional song, maybe like a ballad in English equivalent. It tends to be based on an old poem with very high level of Urdu. Other examples are Dasht e tanhai and Ranjish no sahi

The punishment is literal in this sense because alcohol is forbidden, and the punishment is lashes (atleast it was practiced at the time of this poem and still is in many shariah based countries now) but like most poetry it is rebellious and challenges this silly notion of trying to control what one can and cannot do. The poet just wants to have a drink with this fine weather (which is raining in the subcontinent due to the persistent heat, which is quite opposite to what westerners like i,e the sun) and to hell with the consequences,
