      With lawyers like Andrew Flusche, Steve Lehto, Leonard French John Grisham, the Institute for Justice and the Innocence Project, in 50 years (maybe less, or even MUCH less), we won't have evil lawyer jokes, instead it will be evil cop jokes.

      @@Andrewflusche a girl lured a guy to rappe, she was underage.
      the prosecutor says the man acted recklessly so he will be charged, she will testify with immunity. I can't find lenity in the rape law that says recklessness is consent
      so maybe the prosecutor can choose to not prosecute the rappe but choose to prosecute the victim for statutory cause men can only be perpetrators, not victims. to give you an idea same DA said they wouldn't prosecute gays who assault other gays cause they don't agree with the lifestyle
      isn't this a human rights violation,
      i.e. it's not illegal to have sex while drunk in saudi arabia but it is illegal to get drunk cause it can put you in a bad situation. a woman tried to report it was not consensual cause she got drunk, so diplomats claimed this was a human rights violation cause it is considered rappe in our country and therefore she can't be prosecuted for drinking.
      what am i missing, except men can only be perpetrators but woman can be victims. will punishing victims of rappe prevent it from occurring, by protecting the person with intent.
      you can't force a prosecutor or cop to prosecute, putting their finger on the scale but we don't know what metrics they use to sway the process, and this can be used for sexism, racism, political, or religious discrimination.

      this came about after they removed the force requirement from the law, like sleeping with a drunk girl

    Every judge is different, and that's part of the problem. When guilt or innocence hangs on a judges mood or opinion or personality, there's something wrong with the system.

      The only way to stop it or slow it down is to get rid of qualified immunity and internal affairs.

      as my law professor said albeit it was for another class. If there was such thing as an actual justice system there would be no need for lawyers.
      (A good lawyer can convince you a red pen is blue. Think about that. They are not there for the truth either.)

      True, every judge is different. When I filed for divorce, it dragged on between my wife and me and after years, it was assigned to a judge. I researched that judge and found he rules strongly in favor of women, but my wife didn't know that. So much time had passed, she finally agreed to a fair settlement before it ever went in front of that judge, and I dodged a bullet.

    We had a case here in New Jersey a person was pulled over by the state troopers gave troopers all the paperwork they asked for but never said a word she was arrested for resisting one of the first words out of the state troopers mouth was you have the right to remain silent cost the state of New Jersey $30,000 there is a video or two of it on TH-cam

      Yes, she could have saved herself the hassle and invoked the 5th amendment right to silence so the officers knew why she was silent. They claim she was going way over the speed limit and were trying to rule out intoxication. Saying absolutely nothing got her arrested and as she was an attorney she didn't need the aggravation regardless of the payout.

    Good outcome. But the problem is that the client had to pay an attorney to get the case dismissed. The dirty cop got his regular pay while on the witness stand - he didn't lose a dime. THAT IS A CRIME.

    I was pulled over in Virginia with a Maine temporary registration paper tag and was told I could be arrested unless I paid the fine in cash, to him, right there on the spot. This was several years ago and I was legitimately scared. True story…I was actually parked in a tour bus spot ( along with several other cars late at night) and I was pretty excited when I was the only one who did not get a parking ticket. But as soon as I drove away I was pulled over so he was waiting for me.

    Important note that you did not mention: An officer DOES have to have “reasonable articulable suspicion” to detain a suspect, HOWEVER, they are NOT required to TELL the suspect what that RAS is, although most do.

      @@JustABill02 True, but he opens himself up to be challenged in court. Just as a person does by not giving the cop a reasonable response for your presence if asked. For example, if a cop says they got a call of a "suspicious" person taking pictures, and he asks you why you are there or what you are doing. You can plead the 5th and not answer, but then he can detain you longer.
      However, if you say you're an urban photographer photographing the city. You've answered his question, and no further delay is necessary. You don't have to then give him all the details of the who, what, when or why, you do what you do.
      If you don't answer him at all, the judge will want to know why, and may side with the cop if you say, "because I didn't have to."
      Remember, judges don't see cops the way the rest of us do as corrupt. They think they're all legit. Or at least they pretend that they are in order to protect the system.

      @@krane15 The problem is that the cop may know more or be able to find more than you do at the time. Couple that with the fact that they can lie to you legally on the street, and can (illegally) lie in court makes it very hard to prove after the fact that he didn't have RAS.
      Let's say there is a report of someone matching your description committing a crime. The officer has RAS, but you have no idea he has RAS. At that point, its really easy for you to catch a resisting/obstruction charge that you will probably lose in court. The officer doesn't have to tell you about the report. He only has to tell the court.
      Lets say there is no report. The cop insists on ID and arrests when you refuse. The cop is potentially in trouble if you sue. However, if the cop were to say he recognized you from a wanted poster or similar file, then he might be able to say he has RAS in court and it would hold up. So said officer, could after the fact go thru whatever database of people with warrants and find someone who looks similar. In court he could say he could say that he thought you were the person on the warrant. He might even admit that he didn't remember the name, but the face/other details were familiar. Thus he has RAS.
      Either way, I would rather ask the officer if he was "Ordering" me to produce ID, then produce it. That way in court(if/when you sue) its the officer that will be in jeopardy if the court decides against him, and not you (for a resisting/obstructing charge) if the court believes the lying cop.

      @@JustABill02 Well you said a few things wrong but I'll concentrate on this. Never ask an officer about anything you need to do. Remember, cops can lie, so if you ASK him do you have to do something, he will say yes, even if that's a lie.
      He can tell you anything or makeup laws if he wants to get you to comply. Know your right, and be willing to stand by them. Sure they can arrest you, but the chances are, if they do, they were going to arrest you regardless of if you cooperated or not.
      And just so you know, not giving them your I.D. is NOT resisting or obstruction -- obstruction is a physical act. That's your 4th amendment constitutional right. If the cop is in the right, he doesn't need to ask for your I.D. They will arrest you, and once you're under arrest, they simply take it. If you don't carry I.D., you must then identify yourself or NOW you will face additional charges. BTW, there is always a report.

    U.S. Supreme Court has ruled in Delaware v prouse. Clearly states a officer CANNOT restrict one's freedom of movement without reasonable suspicion or probable cause of a CRIMES. And in People v Battle traffic infractions are not CRIME'S.

    Okay.....good job on getting the case thrown out. Now the Important Questions: Did your Client follow up with charges against the LEO that violated said 4th Amendment Rights??? Wouldn't that be next to assure this LEO doesn't keep violating Rights, making False Reports, and clogging the Court System with his illegal behavior??? Yes, I understand easier said than done......am just curious if there might be more???

      Aa you said, (much) easier said than done. Lawsuits are always difficult to pursue, and lawsuits against government officials and agencies are especially difficult. For something like this -- a routine traffic stop that didn't result in an arrest or injuries -- it just isn't worth the effort. Getting the case thrown out is victory enough. (And in addition to providing some welcome relief to the defendant, it undoubtedly pissed off the cop. They _hate_ to lose in court. So I would chalk this up as a win and call it a day. 🙂)

      It’s the concept of fighting crime and corruption by being a criminal and corrupt lawyer. I think it’s been like that since the Middle Ages. Only so,union is to be able to represent yourself. But then, you’d need to be smarter and wittier in court than any regular lawyer. Best thing…… just fucking avoid the cops and if you cannot… you say “as per the constitution of the United States I am invoking my right to remain silent”.

      How many attorneys have you questioned or dealt with?
      Now finding a physician that doesn't lie at least ten times a day is almost impossible. At least 8 of those they will call noble lies (medical ethics class 101). Often we, by gut reaction, reverse the honest and dishonest groups in our opinions.

      @ThunderAppeal paper tags can be run the same way as a standard license plate. If the officer is able to run the plate without initiating a traffic stop to do so, it’s fair game. Although I don’t understand how randomly running license plates is not a violation of the Fourth Amendment. If the officer runs the plate because the vehicle matches the description of a stolen vehicle report, or it matches the description of a vehicle used in a crime (to include fleeing the scene of an accident), then I see that as completely reasonable

    How much does the judge charge the person for court costs when he finds him/her NOT GUILTY or excludes the evidence presented by the stupid cop. And how much does a lawyer like you charge his client to have the evidence thrown out by the judge in order to get a NOT GUILTY judgement. Just curious as to how much "JUSTICE" costs when cops are ignorant or otherwise motivated to harass a law-abiding citizen due to his ego. Will you answer?

      If the case is dismissed there are no costs passed on to the defendant, the state eats the Court Costs.
      An attorney could charge anywhere from a couple hundred dollars to over a thousand to go Court on your behalf.
      If the case is dismissed and the reason is fairly egregious one "could" sue in small claims court to recover their attorney fees, however this is very rare.

      Locally , these small village traffic courts on Long Island purposely make people wait , especially on a not guilty plea . I have had tickets written for expired registration where the DMV temporary was CLEARLY displayed and told " you will have to see the judge " . Hours wasted for cop incompetence - or - he puts it in to make quota ! At taxpayer expense for court operation and personal time wasted . They don't care !

      My question as well. Here as in many of these cases the officer is the only one to have committed an actual violation. If they are going around committing violations why aren't they with in the courts? It's not enough to have your life threatened and disrupted to just have some one essentially just say oops my bad! The truly sad part is just like this lawyer said there is most likely other exact cases in the same court on that day and the judge will still hear the case and decide against the citizen knowing the cop is crooked! This means the system is cooked!

      Regardless of the outcome the citizen will always pay court costs! I had it happen to me on a ticket I argued in court as a layman and the judge said 'not guilty, pay the court costs with no fine'. The judge then told me that I would be on 'probation' for 6 months and if I got another ticket in that time then this ticket would come back and I would have to pay the fine for it also. The system IS corrupt. Even if you 'win' you still lose!

    As I remember it, the police can't pull you over without probable cause that you have committed an offence as in seeing you commit a traffic violation and if there was no probable cause, for sure for an arrest, then anything from that point on is fruits of the poisonous tree and inadmissible. The best way to protect yourself is know your rights when the cop walks up at the very beginning. Most people screw themselves at the point of the first encounter and calling a lawyer after the fact doesn't mean much if your lawyer has nothing to work with. Never consent to a search and never answer questions. Don't resist and if the cop says get out of the car you can't refuse. Knowing what to do has saved my ass over and over.

      Reasonable suspicion is all that is needed to detain. Once you've reached the threshold of probable cause that's enough to make an arrest, conduct a search, seize property, or receive a warrant.

    Question.
    An officer threatens to arrest you for fail to ID 38.02. If you do not ID for a report like criminal trespass or suspicious activity.
    He states he will arrest you and transport you to the magistrates to be fingerprinted if you do not ID.
    You are not on the property he wants to write a report for so he can not arrest you for criminal trespass but is willing to seize and transport you. Isn't that a 4th ammendment violation just by threatening to do it?
    Let's say you say ok cuff me and then choose to ID. Isn't that still an unlawful arrest because he threatened to transport you?
    Can the police transport you while you are only detained?
    Example drive you to the scene of a crime they suspect you were involved in to have a witness ID you. Example san antonio black jogger two years ago.

      I believe you need to cover yourself with recording and verbally trap the cop.
      I saw many examples of auditors do.
      Record.
      Get official name badge number.
      Now the hard part stand your ground and ask am I free to go?
      This is important because when they say no u r detained u must ask for what crime?
      Trespassing is not ID worthy because if you are asked to leave and you do it’s over your done unless you return then your getting arrested.
      So if trespassing is not a crime if you go then you have established a false detainment.
      Ask for supervisor immediately because it shows you are trying to be reasonable.
      Swallow your adrenaline and speak calm even though they want you upset so you can’t think. Explain suspicious is not a crime or trespassing so am I free to leave?
      At this point it’s recording and the officer has admitted to just wanting to ID you without cause and maybe warn him that his certified immunity is in jeopardy because and this is super important…it’s a violation of my 4th amendment rights and your not having a reasonable articulate proof of a crime or a crime about to be committed means are you positive you want my lawyer to see this video?
      Then see what happens…get arrested =200,000 k settlement maybe or he stalls the clock babbling about how your being difficult and do you understand what I’m saying crap and then 10 minutes later walk back to his car after taking a picture unless you wear a mask and hat with glasses then oh well to bad so sad for cop because no touching you at all.
      Unless it’s a terry stop.

      In Georgia there is a metallic seal from the special printer real dealers and auction companies must have. They also charge you $7 for that paper which is good for about a month.
      However in Dukes of Hazzard land i see hundreds of no tag, "lost tag", hand printed "temporary", and 3rd tier dealer paper ads in the licence frame.
      Odd they still drive... For years. If i tried it, ticket on day 1. Probably because my car isn't a 1985 POS brand with missing parts. They know I'm good for a little extra county revenue that week.
      However if you bought a car, the purchasing paperwork should be in the glove box the whole time until plate registered, especially when out of state.

We will be getting the confidentiality documents from social services along with a HIPAA printout to present along with her affidavit to the judge before we file complaints with DHHS and the state bar since the lawyer she operates under does not oversee her work per law.

      @@codemiesterbeats I think you mean 'resepctfully' and no they don't. They show a complete disrespect for the office and anyone feeling violated an uncomfortable. They avoid abuse or threatening language as then they'd immediately be in violation but they absolutely are disrespecting from the get go - even when someone enquires what they're doing, instead of allaying fears/worries/suspicions and saying "I'm just testing to see if I'm allowed to record" they say "no thanks. I don't have to answer" which is provocative and suspicious.

    This is great advice……but should we really have to worry about the people we train and hire to enforce the law are willing to violate our rights? Or judges to do the same if we don’t make the correct argument after our rights have been violated by said law enforcement?

    What type of interaction do you have with attorneys in the prosecutor's office? Do you know how your attorney reacted to your success regarding the 4th Amendment violation? Didn't he learn before trial that about why the cop conducted the traffic stop? Or did he know but thought that he could get away with it?

    I hired an attorney to fight for me. A cop from Hanging Rock pulled me over 4.7 miles out of his jurisdiction. He literally pulled me over in another county. Stupid cop. I'm dying to get the dash cam footage.

    My son and I love your channel in that order, he stated you have a calm and understanding voice, I agree and for that reason, we are new subscribers to your channel well that and the fact your information is clear and makes logical sense.
    I have been listening to lawyers on TH-cam for years telling me to not speak to the police unless I have no other option, there is a great video of a professor and a detective, in the end, both agreed you should not speak to authority because they can lie and will twist your words making you sound guilty of nearly anything. Memories are flawed and everyone sees events differently making for misunderstandings and being flat out wrong for this reason firsthand accounts are not taken as 100% fact. When looking at a photo lineup people can be 100% sure but still be 100% wrong, this can and will lead to innocent people being in jail more often than we would like to think.
    With all this said why would you want to help an officer put you in jail?
    Detectives have a hard job and though we are human meaning we want to help the police find the guilty this does not mean we are on the same side as the police, a person should always be careful when speaking to people who can destroy your life or at very least put your life on hold for a long time even if at the end you are found innocent. Remember the court can find you not guilty but the court of populate opinion can think you got away with it thus imprisoning you in your town or city making moving a requirement to live your life in peace. Worse the police who fought the case can still tell everyone you are guilty because I have never heard an officer say they are sorry for anything nor have I seen the court system apologize even if you sue them and win.
    You are your own worst enemy when it comes to the law, remember there is a reason why lawyers do not represent themselves this is what you are doing when you speak to authority and because emotion is strong you will surely misspeak, this can and will look like you are lying.

      My point here is simple, it is in your best interest to have an attorney speak for you because emotion can and will get a person in trouble every time this is why lawyers hire lawyers, and why talking to the police without talking to a lawyer first is ill-advised. My statement has nothing to do with race or class just protecting yourself both in court and outside of court. When I say you are your own worst enemy I mean a person is their own worst enemy with having no target in mind. The law is only as perfect as the people working to enforce it meaning every case is different and to be careful.

    I bought a car in PA with a transit tag since I live in NC. I had it parked on the street where I own a house in PA. The police red tagged it to tow it. When I called them about it they told me it is illegal to use a transit tag for more than 10 days. The tag is a 30 day tag. They also reg tagged another car that I have licensed and insured with a regular tag. They told me it was abandoned since I do not drive it regularly. Basically harassment and that is what I told them. I work and have a business in PA so I am here from time to time and left the one car here to use when I need it instead of renting a car.

    I live about an hour away from you. I couldn't figure out how va I.D. laws work if cops don't suspect you of a crime. Somewhere I read it depends on what town/ city/ county you are in but that doesn't sound right that they can do that. Can you make a video about that or maybe give me a link to a correct resource? By the way you have a new client if I get a ticket. The last time I got pulled over the cop ticketed me for several things that were lies on top of the 2 that I was guilty of and then called a wrecker that is used for semi trucks for my pickup truck. All together I paid $1600 and lost $3k from not being able to finish plowing in the last blizzard we had he leftmeonthesideoftheroad at 3am in 8" of snow and I'mdisabled witha very bad limp that is almost locked up completely in the cold and a paralyzed arm that can't heat itself properly because of almost no circulation and 40 miles from home 3 hrs in the deep snow for 82 year old grand mother to get to me. More important to me is the feeling of being treated like a peasant who must just take it and if I die on the side of the road that is what I get for driving with farm use tags more than 20 miles from the farm.

    It's true that fake buyer tags from states like Texas have become a huge problem BUT, just like with a normal plate, the number is still linked to the vehicle. All the cop had to do was run the number and if it comes up for a different make/model vehicle (or invalid), he/she has a legit reason to stop the person.

    I live in KY. I see idiots driving around with signs that say “TAG APPLIED FOR” affixed to their vehicles where a tag would normally go. If I was still a cop, I would be pulling every single one of these cars over and checking to see if it was really “applied for”, or they’ve been driving around for the last three years with that stupid tag on their vehicle and no insurance. I don’t know from what state these stupid tags come from but whoever thought of it needs a major beat down. There needs to be a standardized temporary tag throughout the country but for each individual state that way issues like this can be avoided!

    The sad part is that even when the case is tossed, the client is still responsible to pay attorney's fees, (which were well very well deserved). If the State were forced to compensate people for illigitimate traffic stops, it might make an officer think twice before denying our 4th Amendment rights solely based upon unsubstantiated speculation. Police officers KNOW that in most cases, the average citizen can't afford an attorney to represent them for misdemeanor traffic infractions.

    As soon as you appear in Court with an attorney YOU pay to defend you, you send unwritten messages to the Court. The first one being the most important: "I can afford to pay for my own counsel. I have financial standing in the community. I deserve to be treated with more RESPECT by the court because of my financial standing."
    There are other subliminal messages you send the court when you pay for your own attorney, but the first one is the most important.
    Attorneys wrote the laws and the game. It is worth borrowing money from your relatives to pay for your own attorney. I am not an attorney so you can trust me: "It is the best possible use of your money."

    I enjoy my Sui Juris standing way too much to claim my self as an infant unable to handle my affairs.
    When you plea you give jurisdiction to the court.
    When you hire an attorney you sign your rights over to an officer of the court (yes every b.a.r. member is just that)
    I do suggest you hire legal counsel, not representation.
    Did you know anyone may counsel you legally? As long as not paid. This is called a public attorney general.

    There have been a lot of videos showing up with excessive force on minorities over missing or poorly visible paper buyers tags. Do you agree that these paper tags should be replaced with metal ones that can be recycled back to the dealerships when you trade it in at the DMV for your permanent tag?

      i am not picking on you so please hear this with that in mind.
      1. metal tags will cost far to much even if it seems like a viable option
      2. recycling the "number" is a really bad idea, i mean its not like there isnt enough confusion in governmental agency
      so i dont like bringing a problem to the table without offering a solution , here is mine.
      building on some of your idea, and expanding it
      1. the issuer can charge $5 for a cheap plastic backed sticky tag cover that has an official seal / water mark impeded in it that you get with the paper tag
      2. return the tag cover for a refund
      P.S. there are a multitude of way the cover can be marked for authenticity.
      now you have irrefutable legal prof of a legit tag.

    OK my question is... If you are in court because you are suspected of and accused of committing a violation, what action should the officer suffer when in fact he/she is found to be the only one to have committed any kind of violation? Thier violation is in fact much greater than the violation the accused is suspected of. This is a major contributing factor of why everyday normal people have a deep seeded haterd of cops even if they don't display it. The cop can disrupt your life and cost you life changing amounts of time and money with no consequences on thier part. They get paid, have no out if pocket expense and all these false arrests are a big part of thier job. I am considering an arrest to include an illegal stop to he a defacto temporary arrest.

      If the police what to talk you want a lawyer. Innocent or not, end of story. The public perception of "lawyering up" does citizens zero good. Police actually coined the expression "lawyering up". It is derogatory on purpose. Innocence or guilt... both are afforded legal protections and assurances.

      It's worse than that. Nothing of consequence happens to a cop who shoots you in most cases. It's always found to be justified by internal affairs. Policing is a closed loop equal or superior to any mafia organization. I may feel sorry for the family of a cop who is killed in the line of duty, but in many cases the cop initiated the incident by pulling his weapon and gets as good as he sends - only quicker. Cops are taught to shoot to kill only, not to wound or incapacitate. If a cop pulls his weapon he intends to kill you regardless of his "reason" (excuse) for doing so.

I was pulled over for an equipment violation (wheel lights) when VA laws states No law-enforcement officer shall stop a motor vehicle for a violation of this section. No evidence discovered or obtained as a result of a stop in violation of this subsection, including evidence discovered or obtained with the operator’s consent, shall be admissible in any trial, hearing, or other proceeding.”

    what about false information in the state computer database system? the use of an auto tag reader? like suspension of driver's license? on a roadside stop or ask for ID. once the cop asks for the driver's license, then the person handed the license to the cop, the encounter should be stopped? why? the driver's license just shows that person never had a court hearing for the restriction of driving privileges? in the hearing, they will take the driver's license away in that hearing (on the spot) . if you have your driver's license you are legal. I won a motion hearing about this argument, etc.

    Today I learned that _voir dire_ isn't limited to prospective jurors. I'm reading that it can apply to questioning the background or fitness of a witness to give testimony, but I remain surprised that would apply to an unjustified traffic stop by a legitimate officer (a generally qualified witness). Is that a quirk of Virginia law or, as far as you know, is voir dire of an officer witness that broad in many states?
    Could the same dismissal have been accomplished had you waited for cross-examination?

    I was stopped in my Toyota Sequoia because the officer said I have to replace my rear window. I rolled it up and asked if he is going to write me tickets for the other 4 windows that roll down too? He pinned me up for a good hour and a half but I ended up driving off no ticket just annoyed.

    I don't trust CarFax. My uncles on my mother's side tried it for the elder of the two's truck and it didn't match the manufacturer's report. Said my uncle was the second owner and it was totaled. Wasn't totalled and he bought it from the dealership. It's been years so I don't recall where they said, but chances are, bought at the dealership the younger one worked at.

    How is facial recognition legal? Especially in the case where somebody is doing something where somebody expect it to be illegal. For example the so-called auditors. How is it that police officers can take that person's picture find out that person's identification through their facial recognition software to get their name. Or they follow them back to their car and run their license plate number?

    Paper Tags are a bit messed up in Virginia. The law says that commercial vehicle sales have 30 days to submit the paperwork to the DMV for those Paper Tags after a sale... they can literally sit on their hands and not do a darn thing for 30 days. And that means that for those three days you're driving your vehicle illegally. A cop can pull you over and run your tag and it won't be in the system... I had seen several cases where the judge ruled against the person saying that it was their responsibility to make sure they're driving the vehicle legally and not the company they bought it from. The company was completely within the law and just hadn't gotten around to filing the paperwork for the temporary tags and therefore they were not responsible for him driving an unregistered vehicle.

    Now for some reason, there is a pandemic of fake Texas buyer's tags in Texas. Being in Texas, I see them ALL . . . THE . . . TIME!!!! I drive Uber and I once dropped someone off at their house in the Houston area. He had five cars in and around his house, all with paper tags on them!
    I don't know why people do this, and I don't know why it's such a big deal in Texas in particular, but it most certainly is a problem.

      Yeah, and beyond that it's just all made up arbitrary numbers on a plate designed to bring in bribes/taxes to make something magically "legal". I think they just like harassing people from out of state though. That's a huge thing, like where I'm at it's illegal to bear arms or even have your pistol even if it's unloaded, and it's legally impossible for anyone out of this tiny state to get a permit for your rights, so if they can find anyone with out of state tags and it shows they were stupid enough to register their rights under a license scheme, well they're likely to pull you over illegally and detain you for searches to see if they can throw you in jail. Texas would be number 1 hitlist since in Texas everyone has a truck gun (and if you don't, drive back over to Texas and buy one or manufacture one if you hate 4473 infringement/confiscation forms). Also note that nearby it's illegal to even own airsoft toys or toy guns even if they are non-firing or just water guns (and yes, that applies to anyone traveling through, hence another thing they can throw you in jail for that out of state people would be unsuspecting of).

    Couldn't the RAS could be that you were driving more than a mph under the limit and that you could have been impaired in some way? Most states gives cops lots and lots of lienency.

    I have a question for you about traffic law. I lent my car to a friend (not anymore) and while he was in possession of my vehicle he turned right on a red light camera and of course I was mailed a ticket. My question is, how is it that the government can fine me the owner of the car. I thought a person was innocent until proven guilty? No face is recognizable in the car. Just because I am the owner how can I be responsible for the actions of another human being? Unless I pay the fine I cannot renew my registration. So now I am being held hostage for the money! I guess my question is why hasn't redlight and speed cameras been made illegal? The Constitution states that I am innocent until proven guilty and considering that I wasn't even the driver of the car at the time I am also being held hostage for the money. Oh yeah my so called friend has since moved to another state and can't be located. I really hope that a group of good lawyers take up the challenge of defeating this unconstitutional robbery and holding people hostage by not allowing them to renew their registration. It's just a cash grab and everyone knows it. Please let me what you think about it! Thanks and keep up the great advice. I for one appreciate it. 👍
