    Quick question, on the acknowledgment form under the optional section can you explain the Title or type of document in detail? You wrote Name affidavit, does that mean since it was an acknowledgement we would write acknowledgment?

      are you referring to the optional section on the certificate? if so, you would put the title of the document you are notarizing so that the certificate can not be attached to any other document you aren't aware of. if you were notarizing a power of attorney that was titled "power of attorney", that would be what you write in the title section. i hope that answered your question ☺️

    Had a question. In California, For example its says "Jane Doe" on the document but on the ID its says " Jane Robert Doe" they did not include their middle name. Is that acceptable on the document and when notarizing should you put their full name or they name without the middle one.

      thank you for your question! it is ok to not have the middle name..it would be different if the document said "jane robert doe" and the ID says "jane doe". in that case you would ask for any other document they can provide that has a middle name just to verify. i usually just write the name provided on the document and in my journal i write their full name and in the notes i say document signed without middle name. i hope that helps.

    I also had another question. In California, for example they are three signers that need to be notarized. 2 are them are in front of me but one is out of state. The one out of state has given the Power of attorney to his family member that is one of the two in front of me. On the document it says that 1 of the 2 that are in front of me is his attorney in fact. Do i notarized the 2 only in front of me? sorry if I confused me.

      no problem! the attorney in fact is signing on behalf of the person out of state so technically you will only notarize the signature of the 2 signers that are present. dont forget to get the attorney in fact's thumbprint! ☺️

      @@kusa1403 no, you don't state it on the certificate because you can't certify representative capacity in california..and yes! you'll want to mention it in your journal. if anything is ever out of the norm..write it in your journal.

    Hello. Thank you so much for the great explanation on filling out the form. Question. Someone asked me to notorize a rental agreement. Would that be a simple acknowledgement? The person is in a nursing home and cannot sign the rental agreement at the leasing office for the apartment they want to rent. The apartment manager asked them to have it notarized?

      hello! they would need to ask the apartment manager what certificate they need ... you can only tell them the difference between the jurat and acknowledgment. overall the decision is their's. you can not make that decision for them. i hope this helps.

    For a jurat, the California notary left out the typed words "who appeared" as in .... on the basis of satisfactory evidence to be the persons(s)"who appeared" before me. All other wordings are correct. The affidavit of death and its jurat has been electronically submitted by the notary and recorded with an assigned document number. Will this be okay?

      Hi. I'm the signer. I'm one of four remaindermen (with my 3 other siblings) of a life estate in California. The document with the jurat in question is actually a Correction Affidavit of Death of Life Tenant (CADLT). It was used to correct the original Affidavit of Death of Life Tenant (ADLT), which has a wrong legal description. The CADLT is correct in all respects except for the jurat in my original question. Again, I'm a remainderman and I am the signer of the CADLT
      that was recorded on 12-15-23 with a document number assigned. The property of the life estate is located in the SF Bay Area, Calif. Thank you.

      this is how a California jurat looks according to the SOS website. I can only speak to the jurat but not the contents of your documents.
      you can always provide your own jurat form if you are unsure of the one provided by a notary.
      i hope this helps... and i apologize that i couldn't help further. you can always ask the party you submitted the forms to if the jurat that was notarized will suffice. (a lawyer)

      The party who typed the flawed jurat was the same notary who signed and stamped the flawed jurat for the CADLT, which he also prepared as a Legal Document Assistant - LDA (he's both a notary and a LDA). I'll likely consult an attorney to record a corrective CADLT (which is flawless in itself) just to correct the flawed jurat typed & signed by the notary/LDA. Thank you very much for your time and effort to try and help me on this matter. I very much appreciate it.

      you should attach the certificate to the document it belongs to. you don’t want to give anyone the opportunity to attach that certificate to anything else.

    If they have their own document that uses Notarial words do we still attach our own certificate too?

      as long as their document has all the necessary wording and it is an acceptable certificate for your state then yes, you can use theirs.

    In ups store they only attached SWORN BEFORE ME statement, no notary acknowledgment certificate.
    So it is legal ?

      hello! I didn't write my actual commission name due to privacy... but yes, when you are doing an actual certificate...you want to write your name the way it is listed on your commission ☺️
