It’s the same thing if a tree falls onto your home. If you can prove that there was nothing that could be done, then insurance writes it off as that act.

Insurance companies like to collect premiums for eons and then refuse to pay out. This man paid his premiums for 38 years and now he needs back what he's paid for all those years. Someone has to be decent to this man and condemn the place. A Zoning Administrator should be able to do this in his county. I feel for the guy, work all your life for a nice place and now you have to deal with headaches and people not owning up. I hope he gets every penny and can build a new place.

The next thing he has to worry about is the appraiser. The insurance company will send out their "appraiser" who will then proceed to appraise this condemned house at what he thinks will be best for his employer. What will be the going price of condemned houses in the area? How much will his house be worth? That's the big question. Crooks all around.

Id take and salvage all the good stuff, like the kitchen cabinets, counters, appliances, light fixtures, ceiling fans, hvac heating and air units, interior and exterior doors and windows, bathroom fixtures, toilets and vanities, tub, garage doors and openers, electric circuit breaker box. Take all of this stuff store it in movable trailers or pods units. See if insurance co will give you money to build a new house, and you reuse all these items thus saving your insursnce co money, heck when the house is bulldozed, the bricks can even be reclaimed, and reused on your new home. Several years back i did this to a home that was unlivable. Home was 10 yrs old. Me and 5 others had the house gutted of all valuable materials in a matter of less than a week. Had to rent several pods units to store everything we salvaged. Homeowner purchased new land, and rebuilt a house almost identical to the one that was condemmed by using the original blue prints. You can obtain copies of the blue prints from your local city hall. All homes have their blue prints on file. Needless to say it was fun salvaging all the items and then reusing them in the new house. Since i am a heating and air guy i reinstalled the original hvac unit, and did a lot of the electrical work. Such a nice house you have. Very sad to see it sinking.

When he realized what was happening, he scrambled to get out but, it was too late! People heard him screaming for help but, the earth caved in on him, making it impossible for him to be rescued. Without hesitation, the hole was sealed immediately to his family's dismay. I hope the city and insurance company make a decision soon before it's too late! I wish he could move out or somewhere else until these foolish bureaucratic clowns get their s**t together. Good luck sir.

Building homes and discovering they are on top of sink holes are happening more often than the public realize.
Anyone remember the show " Hard Copy"? I remember they featured one of the first public stories about this, a young man was swallowed by a sink hole as he slept in back room of his house. His older brother was in front of the home at the time and couldn't save him. The local news had captured the older brother crying out and trying to dig his brother out with his hands as first responders were grabbing him and pulling him away.
Through the years other people have gone to the press about discovering their homes were unleveled and causing massive damages due to cracks only to learn there was a sink hole underneath which caused the shift in its foundation.
I can't say it enough to survey the land extensively and more than once and with more than one contractor.

Then make sure that property is on record to never allow building on it again. If he has to continue to wait for something to be done his house could crash in and kill him. If I was him though…I would already be packing everything and moving it into one of those portable storage containers to be moved away from there if the whole thing starts collapsing so at least you would have all your things.
