In master duel, you'll not even be given the option to try this play. In the paper IRL TCG players often do this not realizing it's illegal, Inform them. If someone does this on purpose and you informed them, and you catch them, they may have been cheating, ask your judge to investigate.

Yes, you can't try to activate a card you cannot resolve at the time to activate it.

No. Master Duel just applies the card game’s rules as religiously as possible. The only reason you perceive it as worse is because you’re breaking one of the game’s rules and gaining illegal advantage off of it knowingly or unknowingly.
