Political pressure can be brought, of course, but only the President has the power to pardon him. However, the most likely outcome of the court martial is that he will be discharged. I know, he already resigned, but it hasn't gone through yet. They will want to make a statement. And cut off any VA benefits he might have been eligible for.

If they charge him, he goes to a court-martial. If he is acquitted, problem solved. If he is convicted, but they simply discharge him, problem solved (as far as needing to be freed). If they convict and sentence him (the only scenario under which he will not be free) the Presidential pardon will be needed. I'm not trying to minimize this. But as far as what can be done, he will either be freed by the military, or he will need a pardon.

I support what he did, but this was the required response. This is military order and discipline. We cannot have military members popping off to the internet every time they disagree with their superiors, even if it is for a good reason. There is a hearing and probably a court-martial coming up; they may acquit him, or, more likely, give him a slap on the wrist.

Schiller is not saying he should not be jailed....He is saying that honor and the military law requires the ranking officers to occupy their own cells for their offenses.

Political pressure can be brought, of course, but only the President has the power to pardon him. However, the most likely outcome of the court martial is that he will be discharged. I know, he already resigned, but it hasn't gone through yet. They will want to make a statement. And cut off any VA benefits he might have been eligible for.

@@kooldudematt1 They are preparing an Article 32 hearing. At the end of that hearing, they must either charge or release him. If they release him, problem solved. If they charge him, he goes to a court-martial. If he is acquitted, problem solved. If he is convicted, but they simply discharge him, problem solved (as far as needing to be freed). If they convict and sentence him (the only scenario under which he will not be free) the Presidential pardon will be needed.
I'm not trying to minimize this. But as far as what can be done, he will either be freed by the military, or he will need a pardon.

In the past, (until the Iran Contra affair 80s) the people would unite and create an outcry to keep Military Generals in check. (Like McCarthy and Vietnam 60s 70s) Before the divide people would lay aside partisan differences and allow obvious traitors to be arrested by the Judge Advocate Generals Office where a tribunal would decide whether or not someone had committed sedition, subversion or treason. Milley, it appears, is guilty of the later two. However, once they make it political, one third of the population will defend his actions.
