- The plaintiff purchased a car from the defendant, but it turned out to be a piece of junk. When the plaintiff returned the vehicle, she says the defendant gave her a check that bounced, so the plaintiff is suing. The defendant believes the plaintiff just got swindled by a private inspection company. Regardless, the defendant took the car back and sent her a check, which she cashed.

The owner seems to speak and understand English perfectly well.
Lol. Plaintiff needs to use this as a learning experience. NEVER take a USED car to a FRANCHISE dealership, UNLESS they sold you the car, and it already went through their shop BEFORE the purchase. Service is their top revenue source, and they will TEAR APART a $3,200 Honda Pilot. Lol. The things listed were maintenance parts, and should be done, but, DO NOT affect inspection. Verdict for the defendant.
They always conveniently decide when they speak English or not.
I wish I would have had a 5 year maintenance contract with the crap truck I bought from a local dealership. I sued them and won.
Defendant purposely wrote 2013 knowing that the bank wouldn't cash those checks written to the plaintiff. Glad the plaintiff caught her that second time...

How did you come to that conclusion 😅. The plaintiff had already received and cashed a good check from them before the case. It was pointless for the plaintiff to even bring it up because they had already made good on the refund.
So why would she purposely start to write 2013 then correct to 2p18 the second time?

First indication there's a problem with the seller is when she says we gave her a free five year maintenance contract.
Always buyer beware when buying any car cause it’s crazy when they just mess up a few days later or months later, which is very possible some cars are just junk and places are just wanting to get rid of or people just trying to get rid of just beware…
I think this dealer was pushing the time for delay to screw the buyer over. How does anyone, especially a dealer, confuse ½ a decade when writing a check, twice? Beware of this place.
A lot of shops will try and get you to pay for repairs that you don't need.

7:30 No Harvey. You can buy a car AS IS. Then you fix the car so that it can pass inspection. HAPPENS ALL THE TIME. Depends on the terms of your deal.
Also, it depends on the state. I believe in California, the car has to be able to pass smog inspections before it can be sold.

wow. she missed out on getting all her money. does she even realize had she taken it to a states inspection site, she could've gotten a written notice to take back to dealer and got all her money back??? what stopped her from doing that? inexperience? or communication issue? something. she pretty much blew it... some states don't have inspection so once u sign the lemon problems are urs. but in her case she had a few days to handle it and get her cash back. smh

If you buy a brand new car from one dealer and take it to another dealer the same day they will always find something they claim to be wrong with it
I'm a dealer in Missouri. In this state if you take your car to a shop and they do a 100 point inspection and find the cooling system or the transmission needs to be flushed that is on you. BUT, the car must pass the state safety inspection or the dealer (me) must do any repairs to make it pass. That is why we generally take the cars in ahead of time to get them safety inspected. Shops are far more likely to recommend services to a customer who just bought a car figuring they will go ahead and get them done not knowing the actual condition. The defendant did a lot for the plaintiff and it is unfortunate that the plaintiff was so inexperienced. I hope she does better in her future dealings. As far as the defendant writing the wrong date on the check I thought possibly she had just written her 8 really sloppy and it looked like a 3 but I guess she really did write in a 3. That is really odd. Some people are saying intentional scam but maybe she has a medical reason. My mom had a mild stroke and writes the wrong date all the time. Maybe that defendant should go to a doctor? Just sayin'.
But someone who doesn’t know what year it is when they write a check isn’t telling the truth either.

The defendants were more than accommodating with a 5 year warranty. The plaintiff was looking for a way out because she already saw another vehicle she wanted. They paid her back minus what the contract said she would be out. If she really believed it was a bad car she should've got the failed inspection paper and got all of it back. The plaintiff is the one who seems to be trying to get over.
The plaintiff wasn't going to win this case regardless on if she signed the contract or not.
She didn't win cause she cashed the check it was a done deal.
