Definition of payee covered u/s 7, holder u/s 8 and holder in due course u/s 9 of The N.I. Act,1881. You said that(time 8:14) holder or payee can file a court case u/s 138 . But section 142 of the N.I Act says payee or holder in due course can file a case u/s 138. As per section 142 of the N.I.Act I think that the holder is not competent to file a case u/s 138 against the drawer. Kindly clear the ambiguity.

sir, respondent issued a cheque to petitioner by according to their agreement. and in bank petitioner finds that cheque is dishonoured due to insufficient funds. and also respondent does not reply to the notice of petitioner given by the court to give due amount. here accused is liable under sec 138 of ni act, offence is completed. but if accused has given payment to petitioner with its applicable interests filing the case by petitioner ,,then also petitioner wants to persue the case even after getting the whole amount, but still petitioner wants to persue the case. my question is whether the court has power to dismiss the case,,because accused has given all amount with its applicable interests to petitioner. also, how we can defence the accused..? how case can be dismissed?
