How can a court pronounce say otherwise that the law makers who declared their defection to another party publicly before the HALLOWED Chamber and before Nigerians and the whole world on national TV did not defect?

Because you lack how court VS. the constitution works. Saying something doesn't mean you do it. Just like if you kill someone and you said in a TV show that you did not kill her. Can that be taken as you don't kill her. In law, we have what we call substantial proof of evidence. Mere Saying is out it. It can only lead to investigation.
