The rule is clear: if the penalty is just a fine and no jail time, it's just an operating expense for the company
I've been saying this for years. These companies blatantly disregard the law because they know the worst they'll face is some temporary bad PR and miniscule fine. There are no real consequences for corporations.

Exactly. I stopped using Ebay because they banned my account twice for simply trying to sell a monitor. I contacted their support and received an automated response. No explanation as to why my account was being banned.

It's extra crazy because the "blog" they went after was a TINY niche e-commerce news site. The other "this sounds like a bad movie" fact is the former head of security dude is ex-cia and it really makes you wonder what other dirt is in his past.

It makes me wonder how many people they did this to that we don't know about, or how many other companies do this kind of stuff. It is a breath of fresh air to see a C-level exec get held responsible for something though.

I think it bothers me that they got away with relatively little for how awful the crime was. 3 million is nothing, especially from a company as large as ebay. Not to mention only a single person potentially getting 5 years in prison is awful. Honestly I don't think the punishment is large enough to deter this behavior in the future

There needs to be jail time if you're mailing someone funeral reefs and books about losing spouses. That is a clear death threat to me.

You're not wrong, but it has to be proven that was the intent. A funeral wreath and a book about losing a spouse isn't technically a threat. If they sent those items with a letter saying "your spouse will die", then it's a threat.

The part I don't get is why Ebay's hostility was so disproportionate. People write critical articles about companies all the time. The typical corporate response is to just roll with it and wait for it to be forgotten about. This escalation would only make sense if they had truly damning evidence that could bankrupt the company.

It was probably staff who took it personally, they do have teams monitoring social media.
I genuinely sold products on eBay and every staff i spoke to was genuinely harassing. Taking perfectly normal items down and giving no reason. That place is toxic af.

That's cause they're not allowed to change the email forms they send to customers. It's all Macros. All the staff are allowed to do is confirm that something was taken down correctly, or reverse it.

As I remember, they got caught because one of the employees dropped off dead animal package at their house, and she rented a car to deliver the package. The police traced that car to her and she squealed on everyone else.
Yup, and before that, they had no clue who was doing it but had suspicions it was ebay but no one believed them until the police traced the car back to the employee. That's the only reason they were caught, a rental car paper trail.
Not only that, but now there's precedent to bait ebay into doing the same for a payout.
I love the “you are allowed to film but you should give it to the police” logic, because unless the value of stolen property is above a certain amount, the police are literally just gonna watch the footage for 2 seconds, and throw their hands up and go “Welp, they didn’t announce their names and addresses, dunno who they are, can’t find them, investigation over.” Which is how literally almost all police forces operate.
The fine needs to be increased, $3m for that is way too low, and the then CEO should also be looking at jail time.
Just remember that "Jail" for the well to do is not the same as for regular population. At worst it's a minimal security facility in the tropics.
@@RobertCentric sure, but having a prison sentence in the CV is not yet a requirement to become a cooperate executive, so this kind of sabbatical would be a unique separating factor for a C-Level executive of a customer facing company!
Now that the fine has been established they should still have the option of suing each person independently.

I'm surprised no one is saying to boycott eBay. This isn't just one bad apple at a corporation - it's seven of them including at least two high ranking employees, one of them being the freaking CEO! They have pleaded guilty and the Court is considering jail time too, so this isn't me overreacting to an 'evil' corporation - they have actually been proven in Court to be evil.
If this isn't boycott-worthy, then I don't know what is. 🤬

This story came across my radar a while ago. I had the same exact reaction. Absolutely wild that the CEO at the time got to walk away with a multi-million dollar severance package after this.
Oh and btw, besides the tailing with a rental car paid for by a corporate account, they also got caught because they bought a gift card to pay for the pig fetus and it came back to a Walgreens or CVS across the street from Ebay headquarters, with one of the convicted people being photographed by security cameras buying the gift card. Crazy stuff.
Why the gift card? Have they not heard of cash? Like he didn't want it to be traced back to him but he thought that the only way to buy something is with a card and actually didn't know that cash existed.

The craziest thing is maybe that there were 7 people in on this (possibly more?) who were equally deranged, or at least had no issue following insane orders from superiors.
I sometimes suspect that psychopathy is way more prevalent than we think - and that you are increasingly likely to find them the higher up you go in powerful organizations. It explains a lot of the needless cruel suffering in this world, and it is really scary to think about.

Anyone that was complicit in this, deserves to do hard time and this couple should be awarded a lot more than 3 million. E-bay probably makes more than that in a day, and therefore, it is hardly a deterrent against stopping them from doing this again.
Honestly, I don't think the couple gets the 3 million. It was a criminal charge so the penalty likely goes to the state. The couple will have to sue the civilly to get any compensation.

I can't imagine the emotional trauma knowing that many of these people are still free and could at any point continue to threaten your life.

eBay permanently suspended me while i was selling an iPad case. No reason given except "for the safety of their customers". eBay can rot in hell.
I got that for listing a 6700k cpu a few years back. First ever item listed. Lifetime ban for being a "danger" to their community. No service line to talk to. Eventually found a live person via the Facebook and was told, roughly, "We will not tell people what rule they broke as we do not want people to avoid breaking the rules. Now stop messaging us. You are banned forever and there is no appeal process for a rule breaking as severe as yours."
Instead of the employees going to jail, they should send Ebay to jail -- you know, because Citizens United

Best case scenario this is all the eBay people did because they plead guilty, there’s a good chance they did a lot more that never came out.
this stuff with ebay may seem like a crazy story to most of y'all but in countries like south korea where i worked for over 4 years and i am sure on other, poorer countries, too these kinds of things happen frequently and corruption / getting harassed by an entire company happens there to a day to day basis. even the south korean government is still corrupt towards foreigners. and i also witnessed very crazy things here in germany, too. Some people are just nuts (in a bad way)

I live in Thailand and one of the biggest things that comes to mind, a few years back Mazda knowingly sold cars with defective engines, and owners tried to set up some kind of class-action lawsuit. Only to be counter-sued by Mazda for tarnishing their name (there are very strong anti-libel laws here)...

I don't understand why Businesses that are this s pernicious do not get their business licenses revoked, at least in the jurisdictions where these rulings are made. If my own company did this, I would for sure not be allowed to operate in my state, but the most giant businesses get a free pass. Ebay, Equifax, etc... how much harm is too much harm to continue operation? Given the damage that these businesses have inflicted, and can still operate, that's a scary thought. There needs to be much harsher penalties for stuff like this.

I will never understand why fines to companies are so low, that companies are better off doing illegal stuff, because they win more money than they have to pay. Even in this case they didn't make money out of it, 3M is literally nothing for them, and this was bad enough to diserve a lor more.

They have been playing crooked games for years. If you post anything on their forum complaining about anything on the site, usually within 5 minutes you will have another supposed seller reply to you telling you how wrong you are and saying why ebay is perfect and the problem is yours not theirs. That's been going on almost since the founding of ebay.

I used to work for UPS. The things I saw with my own eyes at UPS were abhorrent. I have no idea how they manage to get away with what they do. It opened my eyes about the "legal system." It's deeply corrupt and saddening.

In South Africa we may no longer have access to the CCTV footage from a fuel station where someone broke into our car and stole a laptop bag because the thief didn't give permission to be recorded or have footage shared.
I bought a water filter one time from ebay, it came used, I tried to return it and they closed my account for fraud. Never again will I use that garbage site.

And because this is a Cali based company I am sure the court was very understanding of the hard times the employees were going through and made sure they got a nice warm blanket and some milk during the court trials.
Ebay and Paypal is a very sick organisation with no Govt regulation. I used to be a business seller but was treated appalingly and when going to court over part of it had their lawyer {Ebays Australian adress] trying to cover up and telling me she would be after huge costs. So extortion. THEN when it went to a Govt Tribunal they were trying to tell them that they had no authority over them and it had to be Ebay in Zurick. Which did not go down well with the tribunal chair.
NOT a trustworthy operation and also one with no idea of retail business. When I eventually gave up with them the fees and charges went through the roof. And the compulsory Paypal just doubled the costs. And you have no other way to pay now.

This sounds exacly like what Scientology "allegedly" does to ex-members who speak out publicly against the organization. They even have a name for it. Wouldn't be at all surprised to learn these people are members, given the stark similarity.
The thing with the porch pirates is similar to what "data protection" activists have done in Germany, but we have it even worse: Not only can we not release it to the public without blurring everything "identifiable" or "private", just the act of filming can already consitute a violation of privacy
Get this: If you have a dashcam in your car and send it in as prove for something (accident, someone violated a law, etc.), not only may it not even be recognised as evidence in court because the judge doesn't want to (and even if it might be dismissed as "not identifiable enough" even with the license plate on record), you might get sued by the other party or random bystanders appearing in the footage because you "filmed them without their explicit permission". It has happened before.
Can you sue the government for filming you without your consent with road cameras?
Filming in public is legal in Germany if the focus isn't on a particular person, so they don't have grounds. I think even filming a person is legal if you don't publish it, but don't quote me on that.

This would have gone very different if they did this and showed up to a person's home in a pro constitutional pro 2A state like Texas or Montana or something. They only had the balls to do this crazy crap because it was in Massachusetts. I have arachnophobia if I received that box full of spiders then they showed up and attacked my home I'd have a strong mental insanity defense.

My partner has an evil step-mom her same exact age.
Her step mom literally does this kind of stuff to her. She has been harassing her for decades - has been taken to court, has been given a no-contact order.
Now she just uses bots and pays 3rd parties to harass her.

@@Ryan-093 I'm no expert, but with all the bs coming from the "they/them' cult, who want criminal charges if I can't tell what the f 'they' are, this seems apropos to label this a 'woke' idea. It aligns perfectly with the 'feelings over facts' crowd and the 'abolish the police' crowd and the "criminals rights" crowd.
"Innocent Until Proven Guilty" only exists inside the courtroom. Think about it: if the police assume this person is innocent, why are they arresting them?
