      Way back in the early 80s the NRA and the pro Gun lobby pressed Congress into abolishing the ATF. The reason they didn't go through with it was that the US Goverment was going to transfer ATF responsibilities to the Secret Service. The Gun Lobby ultimately decided to leave things as they were.

      The Bureau of Alcohol, Tobacco, Firearms and Explosives' (ATF) law enforcement legacy began in 1791 when the first tax on whiskey was passed under President George Washington and U.S. Department of the Treasury Secretary Alexander Hamilton.

      That tax on alcohol and tobacco products only lasted until 1802. [Fire]Arms were not taxed until 1934, when the Democrat Party created the "National Firearms Act of 1934", creating a tax equivalent to 100+% "taxation". The responsibility for collecting this patently UNconstitutional "tax" was given to the Alcohol Tax Unit (ATU) of the Treasury Department, created after passage of Amendment XXI abolished Prohibition. That unit lasted until after passage of the Democrat Party's "Gun Control Act of 1968", which the Democrats derived from an archived copy of the "Nazi Weapons Laws of 1938". The ATU subsequently "morphed" into the Bureau of Alcohol, Tobacco and Firearms (BATF) ... narcissisticly self-named as "ATF" ... in 1972. There is no *actual* constitutional authority for the "F" part to ever have been created in the first place.

      atf doesnt need to exist. tobacco killing millions of people, alcohol killing millions of people guns killing thousands and most of them by police.
      they exist for what reason? to make tobacco safe for public use yet all these vapes go pretty much unregulated.
      alcohol for what reason? you can go to pretty much any store and buy it yet it causes so many types of cancer.
      firearms for what reason? turning law abiding citizens into felons for no reason at all. while the dangerous felons who dont care about the law illegally carry...

      @@Smoketownedcmade it that a “legal” rifle barrel was 16” or longer and anything shorter was considered an SBR (short barreled rifle). Shotguns are 18” as was rifles, but the gubment sold a bunch (100s of thousands?) of old surplus rifles to the public, but they only had 16” barrels so everyone who bought one was now a felon. The powers that be then changed the law/rule to 16” to prevent everyone from being a felon or having to pay the tax and register. There’s a bunch of other stuff in it as well involving suppressors and other things. That’s just my vague recollection but there’s more to it. NFA requires you to have a welded on muzzle device on a 14.5” to make it 16” but then you’re stuck with that device and can’t change gas blocks or decide on a different muzzle device. It’s stupid.

      Agreed, it should immediately render all of those “opinions” null and void. They will most likely all have to be challenged in court one by one unless at some point SCOTUS directly addresses authority of ATF “opinions” in a future ruling.

    Why are there no lawsuits stating that there is no text, History ,or tradition of taxing, regulating, or registering firearms that are in common use by the length of their barrel? The whole thing is unconstitutional. No need for a pistol brace at that point...

      THIS is exactly what I've been saying. Once a government act or law is struck down as unconstitutional, the responsible parties should all be charged with treason and dealt with as such. Suddenly there would be a lot more respect for Constitutional protections. As it is, there's just a little pie in the face and then they go right back to the drawing board for another try.

      Yes, but SCOTUS has no history of interpreting this as a right to any and all arms. On the contrary, past rulings have recognized the idea of limits for private ownership.
      Let’s focus on reversing state “rosters”, feature restrictions, magazine limits, etc. If we just get recognition for common usage semi auto rifles with normal capacity magazines and whatever furniture we want to put on them, that would be a huge win (especially for all our fellow citizens in Blue jurisdictions - an infringement against one is an infringement against all).

      Correct. It's either a rifle, carbine or pistol. The length of the barrel should have no bearing on wether or not it is illegal without a tax stamp. Essentially the tax stamp is unconstitutional because it taxes a right.

      The good thing he did was have Thomas in seat. However, keep in mind it was Trump who was in on bump stock bans, leading to this entire pistol brace issue. And then there's the Red Flag laws he applauded. You read that right.

      The ATF no longer have the power to come up with new rules, laws and or regulations, Because the Supreme Court of Justice just struck down CHEVRON, which means, government agencies no longer have the power to come up with new laws, rules and or regulations, without the approval of Congress, therefore I wouldn't worry too much about that

      sure, but what is their penalty if they do not? The problem is that there is no defined penalty for going against the chevron ruling. The penalty should be prison for a minimum of 5 years and a personal fine of 1 million minimum.

    I really don't "have a dog in this fight", meaning I don't own a controversial firearm. But I really don't see the big deal.
    Since the Supreme Court has already ruled that when it comes to firearms laws, we MUST consider history and tradition. I would be willing to wager that in a museum somewhere, there's a rifle or musket from colonial times, where the original owner cut the barrel down to make it easier to use in a buggy or coach.

      Technically, "SBR"s have always been around and I recall specific regiments/units even using them as far back as the US revolution. They are not standard but they have their use in specific situations.

      Remember, the Bruen test is text first, followed by historical tradition of firearms regulations. If the conduct addressed by the statute or rule implicates the TEXT of the 2nd Amendment (as virtually anything pertaining to firearms automatically does since ALL firearms are arms), the conduct is presumptively protected by the 2A. At that point, THE BURDEN SHIFTS to the government to come forth with MULTIPLE, widely accepted analogous laws on the books and that were actually enforced at the time of the ratification of the 2A (1791) addressing the same societal problem in the same way. If the government does not identify multiple (i.e., widely accepted) specific historical laws implementing a tradition of a specific type of firearms regulation that was meant to address the same type of societal problem and that operated in the same way from the founding era, the modern day law being challenged is presumptively unconstitutional!
      The pro-2A side NEVER bears the burden to provide a historical counterargument to a technical firearms regulation to win the case except to point out limitations to the government's claimed historical analogs. We win by default. The court must abide by the 2nd Amendments "unqualified command" (i.e., shall not be infringed.)
      "History" of the kind proffered by (revisionist) historians does us no good, except when it can be used as a confirmatory example to discredit supposed government analogous regulations.
      The only history that matters is history of the laws actually on the books and enforced in enough jurisdictions as to establish that it was the prevailing theory at the time of the founding that an analogous law pertaining to specific conduct with arms would have been deemed acceptable under the 2A. There isn't much for the government to work with: basically, don't murder, rape, or rob people using guns and expect to get away with it using the 2A as your defense. That is pretty much the only relevant historical tradition of firearms regulation.
      Own whatever you want. Carry whatever you want wherever you want, basically. That's the core protection of the 2A.

      If I didn't have family ties or something keeping me in Illinois I would think about moving. Fighting a state government that won't adhere to the constitution or the supreme court is a losing battle. Sure, giving up on your state doesn't seem like a patriotic thing to do but if enough people leave those tax dollars will leave as well.

      Not if it goes against the Federal law following the Constitution. But the State can do other things to screw with the 2A. Scotus may then nullify those rulings also. Got em on the run for a change. If we lose the majority in Scotis, the laws may shift back later even though the Leftists are screaming about bias in the rulings, their people would bias things also. Kiss our grits. Good rulings be happening. Constitutional.

    If you would just be a bit more clear and concise describing the matters you discuss, rather than the long winded legal jargon that most don't want to hear, or understand, you may win over a bit of that 60% unsubscribed. Most people want the simplest form of explanation. That doesn't mean it has to be dumbed down. Just clear, and to the point.
