Is a Settlement Imminent? - The ACC Looks to the Florida Supreme Court to Pause the FSU Lawsuit

  • The ACC has turned to the Florida Supreme Court in an effort to get the FSU legal proceedings paused until the North Carolina Court rules. The Big Mountain provides an update as to what the ACC is requesting the Supreme Court, gives an update on the Clemson case in South Carolina, and also provides an update as to the proceedings with the North Carolina Supreme Court.
    The fellas also give their thoughts on if these proceedings, along with the newly announced ESPN & ACC media rights extension, will lead to a settlement in the near future.

    Loved your joint podcast with TJ. SCOSF is in Tally, just like the all the other courts. There will not be any change. It was obvious the ACC rushed to file to beat FSU's filing. I don't think this will end unless both parties settle.

    I think if the new deal has a new expiration date of 2029-2032, the case gets dropped. I keep hearing different info on if a new expiration date is in the extension.

    There's nothing the ACC can do to make FSU happy short of letting them out early. They can't get any of the schools remotely close to the big two.

      I agree, and the ACC most likely wants FSU out. Why not allow FSU to move to the BIG12 while the legal matters get resolved?

    If the ACC does make the changes necessary in their media deal to make these three schools happy, there is a strong possibility that the lawsuits may be withdrawn.

    Lawyer here (although a very average one at best). I typically cringe when non lawyers share their thoughts on litigation and strategy. But you guys did a good job here. Hat tip to you both!

    Thanks for the update.
    I don't particularly like the idea of a "branding" fund to distribute more money to the schools that get more broadcast views. But if they constructed some thresholds for the various platforms maybe. For instance FSU or Clemson are going to primarily appear on ABC and ESPN and Syracuse or Wake Forrest are going to appear primarily on CW and ACCN. Obviously we know where the high viewership will be found. So if they set it up to reward both for exceeding a number that would be fair. If an ESPN Saturday afternoon game usually gets 2 million views and Clemson draws 2.5 million they get a bonus. If a Saturday afternoon CW game usually gets 400, 000 views and Wake Forrest draws 500,000 they get a bonus. But if it is just the big ABC and ESPN games that are rewarded then seems completely unfair and I don't see how most conference schools would go for that, especially if it is a given that those top 3 or 4 schools are going to leave as soon as they financially are able to do so.
    As for in some way reducing the cost of leaving the conference in 2031 and beyond I think that should be a no go. As each year passes the cost of leaving is greatly reduced already. That is enough of a discount. If FSU and Clemson want to continue with the lawsuits then so be it. These cases are going to drag on for years to come, regardless of the outcome. FSU and Clemson would be better served by embracing the efforts the conference has and is making to accommodate them and save their money. If circumstances are such that they have a place in another conference in five or ten years then buy your way out with the money you would have spent in the lawsuits and PE and any other sources they might have.
    Personally I think the college landscape in the 2030s will be so different than it is now that all this effort will be time and money wasted.

    Any Federal court almost certainly will have to rely on the Florida court determination re sovereign immunity, And certainly you are correct that the FL S.Ct. will find sovereign immunity.

    HEY BIG MOUNTAIN.. Some advice, put your big cups or thermos bottles on books or wood so we can actually see them above the mics gear..
    I'm assuming you're probably also selling them?
    If not, you still want people to see your brand name on them. Can't when they are behind the mics.

    FSU hasn't won a title since the BCS era. It's playoff/NY6 record is 1-3. And its 2024 season record is 2-10. The Seminoles are in a supine position here to say that the ACC caused all of this. Regarding the 'brand initiative' the FSU brand is big for the ACC; but, not overall college football. No way FSU thinks it should get paid as much as Ohio State which is #1. This is very high level of delusional.

      FSU should get as much as Nebraska, Northwestern, Purdue, Michigan State, Rudgers, Michigan State. You're picking one team in the Big 10. It's every team in the conference that gets more than FSU. I agree that Ohio State deserves more than FSU but it's not about one team against another but the lousy ACC vs the B1G.

      Fun fact: only six teams have won a natty since fsu last title. One of them is FSU’s rival.
      Another fun fact: 7-1 SMU played an undefeated Pitt team on the acc network while a 1 win fsu team was routinely being placed on espn because the gap in brand value is just that massive. More people will watch a bad fsu team than will watch 80 percent of the other teams in acc even if they are good.

      FSU is undefeated vs Ohio State and has a winning record vs Michigan. Even Ohio State cannot say that this year 😂
