    The difference I see between the MW poaching penalty and the PAC liquidation clauses are the poaching penalty was purely punitive against the PAC and in addition to exit fees, whereas the PAC liquidation fee is in leu of exit fees. Another difference that the PAC would argue is a poaching fee has nothing to do with a scheduling agreement, but a liquidation clause is relevant to this agreement. The liquidation clause is just protection against teams bailing and leaving teams in a conference that has a '26 deadline to have 8 members or dissolve. I'm not sure where the specific numbers came from, but it could be tied to the value of the PAC "war chest" money that comes in '26. I don't know how much money comes in over time, but I know that war chest isn't the lump sum that some people think it is.

      @@TheBigMountainPodcast Sure but again the PAC would argue the poaching penalty was punitive in both a uniquely excessive and unrelated way whereas the liquidation clause is protection against cold feet causing a sudden catastrophe. Personally i see a pretty big difference even if the definition of punitive can be argued in both cases.

    First, the show's name is "The Joe Beaver Show." From radio station 1240 AM in Corvallis (KJOE radio). When quoting or paraphrasing someone or something please try to get the name correct. Second, you were somewhat correct in what Alan Thayer had to say. What I took from Mr Thayer's conversation was the PAC submitted the Anti-trust Lawsuit to get it in Federal Court to get the upper hand.I took, from the interview, was the lawsuit served two purposes: 1. To get the upper hand in negotiations over the MWC (question the validity of poaching penalties and open possibilities for the departing five to file exiting penalties). 2. Send a message to the P2 conferences that there maybe a Anti-trust lawsuit in their future for things such as unequal CFP payout distributions to schools. In reference to number one, the MWC promised UNLV & AF 25 million if they stayed. The departing five schools will likely pay those funds in installments. They may suit to lower the fees as well. However the poaching penalties will not be payed until the current court case is settled. Thus possibly causing the MWC hurry towards a settlement. This is just my personal guess,. I find it interesting that the MWC has not filed any opposing lawsuit or official opposition to the PAC's lawsuit (i.e. request for dismissal). At least I haven't heard of any, but maybe you have. It has been three weeks since the filing and basically we haven't heard anything from either party. Maybe the PAC12 & MWC are already in discussions for a settlement. I don't know how long the case will take a Federal court to hear. FYI, It is the same law office that were used in the PAC2 vs the PAC12 President (George K & the departing ten). They specialize in contract law as does Alan Thayer, as well as Anti-Trust law. Especially in the differing American sport world. Keker, Van Nest & Peters's client list are the likes of: Major League Baseball Players Association, Google Inc., Visa Inc, American Honda Company, & Electronic Arts. So I think they probably have an idea of what they are doing. I thin JY also said the PAC2 had little to no chance to win vs President George K & the departing ten. If number two would happen, all D1 schools not in the P2 would likely join that lawsuit.

    Looking at the agreement and comparing the pac whatever and the mountain west. We now have physical proof that a PAC whatever college degree is not very valuable. Anyone looking at signing this are truly idiotic. After Nevada beat Oregon state, what higher level of football is there. Nothing worth this new pac whatever contract. I am more convinced that the two should have just joined the mountain west. Ego over common sense, this is the most stupid issue I have seen in some time. The mountain west is in a much better and stronger position, period

      Congrats to Nevada, that game nearly broke me. But still OSU hold more media & brand value than any of the schools in the MWC, BSU might be right around that same range. One game doesn't change that. I wish they would have merged, but they didn't. I wasn't in the office when it was decided. The truth of the matter is that BSU, FSU & SDSU got tired of making the same amount when the remaining schools were not pulling their weight in pulling media value and putting money into athletics. CSU has as has AF, but i think AF wasn't chosen for other reasons. The MWC Football champions since 1999: BSU-5, FSU-4, BYU-4, Utah-4, SDSU-3, CSU-3, TCU-4, USU-1, SJSU-1 (COVID 2020). AF, Hawaii, Nevada, UNLV, NMU, Wyoming all at zero. So I think the PAC chose wisely. USU had the opportunity to join & jumped on the bandwagon & stated they would pay any & all of their own fees& penalties. They saw the chance for a larger media deal & took it.

      Oregon State would have rolled through the MWC in 2022 and 2023. I wonder what happened after that? Oh, right...they got left behind, their coach and staff and returning players all jumped ship. On top of that, the defense has some huge number of players out due to injury right now. Not making excuses, Nevada won the game and that's a fact. But this isn't the Oregon State that was before, though it probably won't be like this for long in part because of the reasons stated by @jeh58

    The difference is that the MWC has only one A4 potential school and that is UNLV, so in essence it means nothing.

      That's an idiotic comment. 5 years ago no one would have considered UNLV a prospect for Big 12 or any P5 conference. They are considered now because they've had recent success. Same reason the Whack Pac wanted Fresneck, Boise, and SDSU, they've had "recent success". All of those teams have been horrible for a period over the last 25 years with the exception of Boise. If Bronco turns UNM around and they go undefeated and are packing 45K per game at University Stadium, I guarantee they'll be considered for P4 inclusion. This goes for any current MWC, AAC, or Whack Pac school.

      @@ABQREDorGREEN Wrong on Fresno & SDSU as well. USU has had it moments as well. All of them above what is left of the MWC, except for Air Force. Pthe PAC grabbed the schools with the most media value and brand value with BSU, FSU, & SDSU (in that order) except for AF.

    I think the 1-5 for the locks was due after the 6-0 picks 2 weeks ago. Combinations of tough matchups (OSU vs Oregon, Penn St. vs USC, etc.) and few underdog teams outperforming (Purdue, Northwestern, Wisconsin, CSU, etc.) made Week 7 just overall tough slate for anyone picking. I like Week 8's matchups much better and I think there's a couple really good pick 'ems as well as good teams coming back from the bye like Navy, Michigan, Indiana which should make picking easier. The remaining questions from watching Week 6 and Week 7 is whether the underdogs like Northwestern and Wisconsin are truly breaking out or they just faced average opponents/underperforming opponents. I'm personally really liking the way Northwestern seems to be operating - their QB in particular is a great runner who can scramble well from the pocket. Indiana and Maryland both had trouble dealing with him (Maryland in particular couldn't adjust well). NW's defense also performed pretty well those two weeks. Wisconsin seems to be hitting their stride with both their offense and defense firing at the same time, so a team to watch out for sure, although I do think Rutgers just flat out fell on their faces with stupid turnovers and coaching decisions.

    Half way through the season , I am more amazed the pac whatever decided to split the mountain west into two equal conferences. Beside the money, which the pac whatever has no leg to stand on in court. This was all about ego and stupidity, a merger made sense and these so called elites showed how little a college education is really worth, the dumbest thing I have ever seen

    Here is my take on Penn St. This might be the most impressive coaching job in the Franklin Era. Why? 1: Coming back from 14 down in the Coliseum ( which is obvious). 2: Less obvious: Franklin who is over cautious in his game management, went for it twice on fourth and long, realizing that converting was more likely then stopping USC on downs.I would also note we actually saw some excitement from him instead of having his arms folded like Mike Tomlin does ( as a Steelers as well as a Nittany Lion fan I hate that).

      I actually expected PSU to come back and tie the game in the 3rd, they are so good in the second half. I was worried that once it was tied PSU would struggle to keep scoring with USC, but thankfully they had enough to get to overtime and was able to ride the momentum to the win. I'm still a little worried, it was once again a very slow start. If they can play 4 quarters then they deserve the number 3 ranking or higher, but until then I'm still a little cautious

    3-3 is definitely not where we wanna be at all. keene hasnt progressed much this year, our defense is slow and to make matters worse, our coaches such or at least 1 of them..not great year to be a bulldog

    The Lobos are improving every week, Bronco is just getting them going. Confidence is starting to build, there really isn't anyone on their schedule that they can't beat. It wouldn't surprise me if they eeked out a Bowl invite by seasons end. Defense was absolutely terrible to start the season, now they are solid to bad. Once again, the offense can score with anyone and they are adding to that every week.

      Oh man we can't wait for the game here in a couple weeks. Boise State has something to show the entire country this season. UNLV you guys are definitely having a monster season. But watch out for the Broncos. We're firing on all cylinders now

    As a big 12 fan, I truly want the MWC to survive and thrive. I've always been a fan of their schools and enjoy playing them as well, UNM specifically. I would shoot for Sam Houston since TX State declined. That should be the school to jump after. While they don't bring a lot as far as media market, Huntsville is a very small sliver of the Houston market, and while you wouldn't get much as far as eyeballs at first, the potential for Sam Houston to grab more is certainly there. UTEP currently would bring more eyeballs than Sam Houston being in El Paso. Sam Houston has made HUGE strides in their program and have invested a lot of money into it. They are very much an up and coming school and I wouldn't miss the opportunity.

    It's too bad that Texas State said no. That being said make Hawaii a full time member and add NMSU and Sac State. Unfortunately, the Montana schools want to stay in the Big Sky. Tarleton State to Conference USA.

      TXST would have been a huge get. But it’s not surprising they chose to stay in the SBC. CUSA has said they can lose another member without looking to add. Looks like if Tarleton wants to move to FBS, a MWC invite is their only chance for the foreseeable future.

    Was there mutual assent and consideration? If so, you have a contract. It does not matter whether or not a lawyer draws it up, or what it says at the top of the page. Thanks for the update on the Mountain West. They are doing what I believed that they would do. They are trying to be the best conference that they can be. I honestly don't know why Northern Illinois would be interested in the MWC, and believe the MWC should pursue the Dakotas, if they want CTZ teams.

    A MOU is generally not binding. It generally provides time to negotiate the final terms of a contract. If there is a signed separate grant of rights that document can be binding even if the MOU is not binding. The MOU may merely provide terms which if not fulfilled would give teams an opportunity to opt out of the binding grant of rights.

      1. I have several other targets ahead of them. 2. I am not sure they are ready and willing. I’ve seen varying opinions about them making the jump. 3. They need travel partners. It can’t just be NDSU (which I rank ahead of SDSU). I’d gladly welcome either of them but there are several issues that give me pause right now.

    I'm sure Las Vegas would push for Hawaii full membership because of the impact on tourism and local business. Hawaii travels well to Vegas. There are so many Hawaii transplants in Vegas that it's called the 9th Island. But excessive travel subsidies are a sore point. Now that the MWC is faced with the expense and uncertainty of bringing in a dilutive FCS school as an 8th full member, Hawaii's full membership makes more sense. It solves the full membership problem and, in part, basketball scheduling (sounds strange, but SJSU was the travel partner in the WAC). It buys time to recruit football-only or non-football members.

      Agree. It has the most upside if they get the travel subsidies figured out. But, if the conference wants to focus on going into the central times zone, that could be a detractor. The 8th member is going to be very telling which direction they choose.

    Some people donʻt realize how popular Hawaiʻi is in Asia and the Pacific Islands. lots of them attend the school and have been a huge viewing audience for years through streaming and on demand. Hawaiʻi’s current tv rights go through Spectrum Hawaiʻi where they have two channels that broadcasts sports, through pay per view, streaming, and internet. And while football is huge, other non traditional revenue sports also make money for the school, especially Womenʻs and Menʻs volleyball. We are talking about thousands of season ticket holders with game attendance in the six thousand to ten thousand regularly. Average tickets go for $16 and up. Not to mention recruitment reach into Samoa, New Zealand, Japan to name a few. The state of Hawaiʻiʻs population is about 1.5 million and when a UH game is on, you can find many bars and restaurants showing the games live. The problem is, Hawaiʻi fits better with the Big West, academically and probably culturally too.

      Uh american football is a very very very distant rank compared to Rugby in all pacific island nations - its not even remotely close. In fact Australian football is arguably a greater draw than american football.
