    *International law* is very clear on the South China Sea:
    - parts of it belong to some ASEAN countries including the Philippines 🇵🇭,
    - the rest of it is the international water,
    - no part of it belongs to China🇨🇳 or Taiwan🇹🇼.

    The South China Sea does not belong to China simply because it is called as such. Neither does the Arabian Sea, the Gulf of Mexico, the Sea of Japan or the Indian Ocean belongs to Saudi Arabia, Mexico, Japan or India. This names are simply for navigational purposes and doesn’t mean ownership. Even historically, ancient maps from the Song Dynasty in the year 960 until the end of the Qing Dynasty in the 20th century, shows China's territorial claims ends in the Hainan island to the south. Moreover, the historical map of Murillo Velarde of 1696-1753 disproves China’s claim but instead strengthens further the Philippines claim. This is why the 2016 Arbitral Court at The Hague ruled in favor of the Philippines and nullified China’s “9 dash line” claim over the South China Sea.
    China’s scholars and legal experts knew of the predicament and difficulty of proving historical claims over the South China Sea. This is why China refused to participate in the proceedings and instead claim that the court has no jurisdiction over it. To overturn and ignore the decision favoring the Philippines, China comes out with another “10 dash line” claim over the South China Sea and uses military superiority as well as bullying to achieve its goal.
    China’s reputation in adhering to international law is actually at stake. Remember that China is a signatory to the UNCOS law. By signing in December 10, 1982, China undertakes and obliges itself to respect the EEZ ‘s of each country. China’s claim of ownership to almost the entire South China Sea by having its coastguards patrol the area as if it were their territorial lake is a blatant violation of international law. Again, to emphasize, China uses military superiority and bullying to achieve their goal. Standing firm to what is right is simply what the Philippines is doing and China’s actions is simply a question of greed.

      As early as 1279, China's Yuan Dynasty government discovered and named Huangyan Island. Maps published by subsequent Chinese governments marked the island as belonging to China's territory. In 1945, U.S. warships helped the then government of the Republic of China (now the government of Taiwan) conduct exploration on Huangyan Island. At that time the Philippines was still a colony of the United States. In the Philippine Territorial Sea Baseline Act of 1961, the 118° east longitude line is the western boundary of the Philippine territory, and Huangyan Island is beyond this. On February 5, 1990, the Philippine Ambassador to Germany, Bianfenido, explicitly stated in his letter to German radio enthusiast Dieter that "according to the Philippine Ministry of Map and Resource Information, Huangyan Island is not within Philippine territorial sovereignty.". In the documents issued by the Philippine Department of National Maps and Resource Information on October 18, 1994, and the Philippine Amateur Radio Association to the American Amateur Radio Association on November 18, 1994, it was confirmed that "the territorial boundaries and sovereignty of the Philippines are defined by Article 3 of the Paris Treaty of December 10, 1898, and Huangyan Island is located outside the Philippine territorial boundaries.". The Philippines has never made a territorial claim to Huangyan Island before 1992.
      The South China Sea dispute between China and the Philippines was not submitted to the International Tribunal for the Law of the Sea. Under the provisions of Annex VII of the UNCLOS, the Philippines initiated arbitration proceedings. Section 2 of Chapter 15 of the UNCLOS stipulates that a country has the right to declare its choice of one or more "compulsory procedures that can issue binding awards" including the International Court of Justice, the International Tribunal for the Law of the Sea and Annex VII arbitration. China has not yet made a choice . At the same time, China has declared that it will not accept arbitration proposed by the Philippines. The entire arbitration process was paid for by the Philippine government, and China did not participate. Therefore, this so-called arbitration is illegal. Why does China refuse to recognize the legitimacy of this arbitration? According to Cambodian Prime Minister Hun Sen’s description, long before the illegal arbitral tribunal made its decision, Japanese officials approached Hun Sen and informed him that the arbitral tribunal would make a decision in favor of the Philippines, hoping that Hun Sen could declare support for the decision.

      On maritime side, all thieves countries grabbing Chinese islands when R.O.C. (Taiwan) was oust UN in 1972. And P.R.C. as weak at that time.

    Its high time for the Philippines to file for damages. If the Philippines can't develop the fisheries and oil in its EEZ because of China's refusal to abide by its legal obligations through its signing of UNCLOS. Just imagine the billions of dollars of potential and actual loses incurred by the Philippines for not bein able to fish and drill for oil.     Am not a lawyer. But as I understand from a country’s 220 miles from the land it is an EEZ of the said country like the Phils.
    More of that distance is an international waters. China maybe can claim that area..

      You can't freely claim any international waters. You should have a valid territorial claim in the first place. China's 9-dashed line claim in 1947 was deemed invalid by the international court. If we talk about territorial claim, the Philippines has the strongest, because its old map dates back to 1734 followed by maps in 1800, then Treaty of Paris and Treaty of Washington. China does not have that kind of evidence and documents. They just draw an imaginary 9 dashed line in 1946 and announced it on 1947. No one acknowledged it.

Philippines has its own allies. if asean or some of the SEA allied with Philippines, that's fine. if not, that's fine, too. as long as they don't bother the rights of the Philippines, then no argument there.

      It's an intimidation play. They wanted to build trade and economic alliances with Belt and Road, but just could not bring themselves to abandon their old nationalistic fantasies that requires territorial expansion into every part of the map that they claim as historically theirs.     If Philippines claimed China acted aggressively, then what is her response? Complain and complain, hope someone nice will heard it and offer a helping hand. Be realistic, if you wanted to start a quarrel, you settle yourself or beg for forgiveness if you are weak and stay away. So embarrass by her action as a ASEAN partner.

      That is outright fakenews.
      China never followed any agreements with the Philippines and most of the talks failed before it became an agreement because China wants the Philippines to accept first that China owns the whole SCS. China's condition is unacceptable in the first place, thus nothing is happening. China just use these talks to buy time while it is illegaly and forcibly reclaiming reefs into islands and put military bases there to have de facto control.
