    As a probationer, he is required to disclose to any LEO that he is on probation, if he is asked. When the officer asked, "Are you on probation or parole?" it's highly likely that the terms of his probation required him to say, "Yes." He's not allowed to just not answer.

    Funny how it's impossible to be trespassed from public property and yet it happens all the time.
    Also it's not up to JC to dismiss the officer as he was not the party who called him. Also he can't exactly tell him to go BACK to work as coming there to trespass him literally IS his work so he never stopped working, if anything he doesn't stop till JC is gone.

    I filed a formal complaint with the VA Office of the Inspector General against Jimmy about his visit at the Branson VA yesterday. I even used my electronic signature I have from the VA.
    According to the VA OIG, only veterans, their family, and their guest are allowed to video in lobbies and corridors without permission. Not some non-veteran garden gnome.

    Sometimes I feel like when the police show up for a frauditor trespass they should just walk in and arrest them. No chances to leave, just arrested, taken to jail, and charged with trespass. It's not the authority of the police telling you to leave a property that makes it trespassing it's the authority of the people responsible for the property that makes it trespassing. The moment someone with that authority asks someone to leave and they refuse to do so they are guilty of trespassing. You don't get to wait for the police to show up to ask you to leave, if they are showing up to ask you to leave you've already committed the crime and the police are under no obligation to give you extra chances to leave. They do so because if they can get you to leave then the problem is resolved without the added hassle of involving the justice system.

    I thought when you were on probation, one of the standard requirements is to report ANY CONTACT with police. Doesn't matter if you were or were not arrested, if police have contacted you in any way, that has to be reported. There's also a lower standard for searches and seizures when you're on probation. It's weird, it's almost like as an exchange for staying your ass out of jail, you have to comply with certain requirements that the average non-probation citizen doesn't have to.

    Doesn't a person on probation or parole have to report ANY AND ALL police interactions to his probation officer?
    Pretty sure that's standard for the conditions of probation or parole.
    See, most probationers or parolees go out of their way to avoid interactions with the police because it's usually required they report said interactions.
    AND being trespassed probably falls under the things he would have to report to his probation officer.
    I wonder if his probation officer knows his youtube channel?

      He also is required to say he’s on probation when he’s asked by LE. He violated his probation by refusing to answer.

    I thought that as part of the terms of probation you have to tell any police officer that you are on probation when asked.

    I think all should send emails to the Chief of Police in West Plains commenting on great a job Brixey did and would have been perfect if would have just arrested him when he didn't leave on first order to leave.

    If you are on probation I believe YOU ARE REQUIRED to answer questions from law enforcement about your probation status. As such he just violated his probation.
    I am sure the prosecutor would LOVE this video.

      Perhaps you can ask YOUR jailhouse lawyer about that issue when you next check-in at the gray bar hotel.

In order to be eligible to serve probation in lieu of incarceration, the offender must consent to waive several rights, including the right to refuse search of their personal property, vehicle, or residence upon any contact with law enforcement or a P&P officer. The offender also agrees that they must notify, upon any contact with law enforcement, to disclose their Probation/Parole status, and also voluntarily waives their right to fight extradition in the event of an arrest out-of-state. All these conditions are voluntarily agreed to by any individual on Probation, Parole or Supervised Release and are a condition of probation. Failure to do so is a P&P violation punishable by arrest or probation revocation (and the subsequent imposition of whatever sentence you got probation to try and avoid) source: I work for a law enforcement agency in Southern Missouri and deal with individuals on P&P on a daily basis

      @@valerielewis5831 cool story, here in Florida we have the 4th amendment. And while I agree my PO can come and look through my house, the police can not. Nor do I have to provide ID or answer any questions. Now some folks have signed 4th amendment waivers and do have to provide such, but not all. Source, I'm on probation and audit daily. I refuse daily.

    I don't know about Missouri, but in California if you are on probation or parole and you have any contact with any kind of peace officer and they ask you if you are, you are REQUIRED to answer and answer truthfully. Not doing so is a violation.
    That applies if you are on parole from state prison OR any of the types of formal ( reporting to a probation officer) or informal county level probation.
    ALSO, they have taken measures to protect the information behind the glass by laminating it so it cannot be readily seen through, unless you take extraordinary measures like getting right up against it and/or cupping your hands around your face and so forth. However, they are not required to take extraneous measures to circumvent your extraneous measures and can indeed a lawfully order you to stop doing that.

    Isn't he required to identify as being on probation if asked by a law enforcement officer? I hope that it's considered a violation. I also hope the judge sees this video before making up his mind.
